AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE
NO. 246, KNOWN AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE
OF THE CITY OF PEARLAND, TEXAS; PROVIDING FOR AMENDMENT OF THE
LAND USE DISTRICT MAP; PROVIDING AN EFFECTIVE DATE AND CONTAIN-
ING OTHER PROVISIONS RELATING TO THE SUBJECT.
WHEREAS, DAVID S. MILLER, Agent for MARTHA ALEXANDER CROUCH, Owner of the
property, filed September 25, 1981 (and amended on December 10, 1981), an application
for amendment pursuant to Article IV, Section 00-10 of the Land Use and Urban Develop-
ment Ordinance of the City, for approval of a change in use all as provided for
in Section 00-10, said property being legally described in the original application
for amendment attached hereto (and amended on December 10, 1981), and made a part
hereof for all purposes, as Exhibit "A"; and
WHEREAS, on the 20th day of October, 1981, a public hearing was held before
the Planning and Zoning Commission of the City of Pearland, Texas, all in accordance
with the provisions of Article IV, Section 10-2 (4) and (5) of Ordinance No. 246; and
WHEREAS, on the 22nd day of October, 1981, the Planning and Zoning Com-
mission of the City submitted their report and recommendation to the City Council
regarding the proposed original application of DAVID S. MILLER, Agent for MARTHA
ALEXANDER CROUCH, Owner, whereby they disapproved a change of classification for.
the properties described in Exhibit "A" (original application); and
WHEREAS, upon receipt of the report of the Planning and Zoning Commission
the City Council thereafter gave notice of a public hearing to be held on November 23,
1981, by publication in the official newspaper of the City, the affidavit of publi-
cation being attached hereto and made a part hereof for all purposes, as Exhibit "B",
said call and notice being in strict conformity with the provisions of Article IV,
Section 10-2 (6) of Ordinance No. 246; and
WHEREAS, a public hearing was held on the original application of DAVID S.
MILLER, Agent for MARTHA ALEXANDER CROUCH, Owner, by the City Council at its regular
meeting held on November 23, 1981; and
WHEREAS, on December 10, 1981, an amended application was filed by DAVID S.
MILLER, Agent for MARTHA ALEXANDER CROUCH, Owner, and was considered by the City
Council on December 14, 1981; and
WHEREAS, the City Council having fully heard the testimony and argument of
all interested parties, and having been fully advised in the premises, finds that in
the case of the amended application (Exhibit "C") of DAVID S. MILLER, Agent for
MARTHA ALEXANDER CROUCH, Owner, facts were presented which, in the judgment of the
City would justify the approval of said amended application, and thereby upon a
majority vote as required by Ordinance No. 246, the City Council did in all things
approved said amended application, it is therefore
ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS;
I.
(A) The following described property located within the corporation City Limits
of the City of Pearland, Texas,recorded owner being MARTHA ALEXANDER CROUCH and
presently classified as Planned Unit is hereby for all purposes changed and re-
classified as General Business:
All of that certain 6.6907 acre tract of land located in the Thomas J.
Green Survey, Abstract No. 198, Brazoria County, Texas, also being out
of and a part of the C. H. and Helen F. Alexander Estate 140.6899 acre
tract of land, said 6..6907 acre tract of land being more particularly
described by metes and bounds as follows, to -wit:
BEGINNING at a point in the northerly right-of-way line of Farm to Market
Highway No. 518 at it's intersection with the northwest line of a strip of land, 30.00
feet wide, set aside for the widening of Whitehead Road,_ for the southeasterly corner
of the herein described tract from which a 1/2 inch iron rod found for the southeasterly
corner of the said 140.6899 acre tract bears South 64 deg. 21 min. 27 sec. East, 31.70
feet;
THENCE, North 64 deg. 21 min. 27 sec. West, along and with the said northerly
right-of-way line of Farm to Market Highway No. 518, a total distance of 386.31 feet
to a point for the southeasterly corner of a strip of land, 60.00 feet wide, set aside
for a road, and the southwesterly corner of the herein described tract;
THENCE, North 25 deg. 38 min. 33 sec. East, along and with the easterly line
of the said strip of land, 60.00 feet wide, a total distance of 598.59 feet to a point
for the southwesterly corner 'of an 8.9164 acre tract and the northwesterly line of the
herein described tract;
THENCE, South. 64 deg. 01 min. 35 sec.. East, along and with the. southerly
line of the said 8.9164 acre tract, a total distance of 589.69 feet to.a point in the
northwesterly line of the said strip of -land, 30.00 feet wide, for its southeasterly
corner and the northeasterly corner of the herein described tract;
THENCE, South 44 deg. 30 min. 26 sec. West, along and with the said north-
westerly line of the said strip of land, 30.00 feet wide, a total distance of 628.96
feet to the PLACE OF BEGINNING and containing 6.6907.acres of land.
(B) The following described property located within.the corporate City Limits
of the City of Pearland, Texas; recorded owner being MARTHA ALEXANDER CROUCH and
presently classified as Planned Unit is hereby for all purposes changed and re-
classified as General Business:
A11 of that certain 2.5407 acre tract of land located in the Thomas J.
Green Survey, Abstract No. 198, Brazoria County, Texas, also being out
of and a part of the C. H. and Helen F. Alexander Estate 140.6899 acre
tract of land, said 2.5407 acre tract of land being more particularly
described by metes and bounds as follows, to -wit:
BEGINNING at a 1/2 inch iron rod found in the northerly -right-of-way line
of Farm to Market Highway No. 518 for the common southerly corner of a C. H. and Helen
F. Alexander Estate 172.0566 acre tract'and the said 140..6899 acre tract, same being
the southwesterly corner of the herein described tract; .

described by metes and bounds as follows, to -wit:

Section 00-5 of Ordinance No. 246, and consistent with the approval herein granted
for the re-classification of the hereinabove described property.
III.
This Ordinance shall become effective after its passage and approval on
second and final reading.
