Ord. 0246-079 07-12-82ORDINANCE NO. 246-79 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 246, KNOWN AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS; PROVIDING FOR AMENDMENT OF THE LAND USE DISTRICT MAP; PROVIDING AN EFFECTIVE DATE AND CONTAIN- ING OTHER PROVISIONS RELATING TO THE SUBJECT. WHEREAS, NORM KUBBINS, Agent for STEVE REYBURN, Owner of the property, filed February 19, 1982, an application for amendment pursuant to Article IV, Section 00-10 of the Land Use and Urban Development Ordinance of the City, for. approval of a change in the land use all as provided for in Section 00-10, said property being legally described in the original application for amendment attached hereto, and made a part hereof for all purposes, as Exhibit "A"; and WHEREAS, on the 16th day of March, 1982, a public hearing was held before the Planning and Zoning Commission of the City of Pearland, Texas, all in accordance with the provisions of Article IV, Section 10-2 (4) and (5) of Ordinance No. 246; and WHEREAS, on the 18th day of March, 1982, the Planning and Zoning Commission of the City submitted their report and recommendation to the City Council regarding the proposed amendment application of NORM KUBBINS, Agent for STEVE REYBURN, Owner of the property, whereby they recommended and approved a change of classification for the properties described in Exhibit "A" from its existing classification of PD (Pre -Development District) to M-1 (Industrial District - Performance Standard Class A); and WHEREAS, upon receipt of the report from the Planning and Zoning Com- mission, the City Council thereafter gave notice of a public hearing to be held on April 12, 1982, by publication in the official newspaper of the City, the affidavit of publication being attached hereto and made a part hereof for all purposes, as Exhibit "B", said call and notice being in strict conformity with the provisions of Artice IV, Section 10-2 (6) of Ordinance No. 246; and WHEREAS, a public hearing was held on the application of NORM KUBBINS, Agent for STEVE REYBURN, Owner of the property, by the City Council at its regular meeting held on April 12, 1982; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, having been fully advised in the premises, find that in the case of the application of NORM KUBBINS, Agent for STEVE REYBURN, Owner of the property, facts were presented which, in the judgment of the City would justify the approval of said application, it is therefore, A. D., 1982. ATTEST: ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: The following described property located within the corporate City Limits of the City of Pearland, Texas, recorded owner being STEVE REYBURN, and presently classified as PD (Pre -Development District) is hereby for all purposes changed and re-classified as M-1 (Industrial District - Performance Standard Class A: 4.121 ACRE TRACT OF LAND, being a portion of a 5.734 acre tract of land Annexed by the City of Pearland, Out of Lots 6 & 7 Containing Called 29.2 Acres Each, Out of the H. Masterson Subdivision of Section No. 5, H.T. & B. R.R. Co. Survey, Abstract 237, in Brazoria County, Texas as Per Map of Said Subdivision Records in Volume 28, Page 6, of the Deed Records of Brazoria County, Texas, and Being More Particularly Described by Metes and Bounds as Follows: BEGINNING at a 4 inchosquare concrete monument in the existing City Limits boundary, said point bears N. 0 58' 57" W. a distance of 1367.67 feet from an exist- ing concrete monument in the City Limits boundary which is in close proximity to the north right-of-way of Orange Street at the Woody Road intersection; THENCE N. 89° 27' 29" W. along the common line between the aforementioned Lots 6 and 7, Abstract 237, a distance of 500.00 feet to a corner; THENCE N. 0° 40' 09" W. at a common Line between Lots 6 and 7 and continue in all a distance of 359.45 feet to a 4 inch concrete monument for corner; THENCE S. 89° 27' 29" E. a distance of 500.00 feet to a 4 inch square concrete monument in the west City Limits line of Pearland, Texas; THENCE S. 0° 32' 48" E. along and with said west City Limits line of the City of Pearland, a distance of 359.45 feet to the place of beginning and containing 4.121 Acres of Land. II. The City Secretary is hereby directed to cause to be prepared an amendment to the official Land Use District Map of the City, pursuant to the provisions of Section 00-5 of Ordinance No. 246, and consistent with the approval herein granted for the re-classification of the hereinabove described property. This Ordinance shall become effective after its passage and approval on second and final reading.
