Ord. 0246-087 08-08-83ORDINANCE NO. 246-87 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 246, KNOWN AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS; PROVIDING FOR AMENDMENT OF THE LAND USE DISTRICT MAP; PROVIDING AN EFFECTIVE DATE AND CONTAIN- ING OTHER PROVISIONS RELATING TO THE SUBJECT. WHEREAS, BAZEL E. CROWE, Agent for W.E.L. HARTMAN, Owner of the property, filed June 9, 1983, an application for amendment pursuant to Article IV, Section 00-10 of the Land Use and Urban Development Ordinance of the City, for approval of a change in the land use all as provided for in Section 00-10, said property being legally described in the original application for amendment attached hereto, and made a part hereof for all purposes, as Exhibit "A"; and WHEREAS, on the 21st day of June, 1983, a public hearing was held before the Planning and Zoning Commission of the City of Pearland, Texas, all in accor- dance with the provisions of Article IV, Section 10-2 (4) and (5) of Ordinance No. 246; and WHEREAS, on the 23rd day of June, 1983, the Planning and Zoning Commis- sion of the City submitted their report and recommendation to the City Council re- garding the proposed amendment application of BAZEL E. CROWE, Agent for W.E.L. HARTMAN, Owner, whereby they disapproved a change of classification for the prop- erties described in Exhibit "A", from their existing classification of Medium Density Single Family Dwelling District (R-2) to Plan Approval (Single Family Detached Residences), as shown in Exhibit "B" attached; and WHEREAS, upon receipt of the report of the Planning and Zoning Commission the City Council thereafter gave notice of a public hearing to be held on July 11, 1983, by publication in the official newspaper of the City, the affidavit of publi- cation being attached hereto and made a part hereof for all purposes, as Exhibit "C", said call and notice being in strict conformity with the provisions of Article IV, Section 10-2 (6) of Ordinance No. 246; and WHEREAS, a public hearing was held on the application of BAZEL E. CROWE, Agent for W.E.L. HARTMAN, Owner, by the City Council at its regular meeting held on July 11, 1983; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of BAZEL E. CROWE, Agent for W.E.L. HARTMAN, Owner, facts were presented which, in the judgment of the City would justify the approval of said application and thereby upon a majority vote as required by Ordinance No. 246, the City Council did in all things approve said application, it is therefore ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I The following described property located within the corporate City Limits of the City of Pearland, Texas, recorded owner being W.E.L. HARTMAN, andpresently classified as Medium Density Single Family Dwelling District (R-2) is hereby for all purposes changed and re-classified as Plan Approval (Single Family Detached Residences) as shown on Exhibit "B" attached: BEING 78.841 Acres of Land, more or less, same being the North Half (N1/2) of the Southeast 1/4, Section 14, of the H.T.&B.R.R. Survey, Abstract 509 in Brazoria County, Texas; said 78.841 Acres of Land, more or less, being more particularly described by metes and bounds as follows: COMMENCING for reference at the centerline of County Road 553 and the West line of the Pearland City Limits; THENCE North 00°04'49" East, a distance of 620.00 feet to an Iron Rod set for corner, same being the Northwest Corner of the tract herein described and the POINT OF BEGINNING; THENCE South 89°37'31" East with the Pearland City Limit Line, a distance of 131.9.96 feet to an Iron Rod found for angle point; THENCE North 89°36'44" East passing at 1280.09 feet the West side of a 10 foot wide road easement dedicated for street widening in Volume 845, Page 752 of the Brazoria County Deed Records, and continuing on for a total distance of 1290.09 feet to an Iron Rod found for corner, same being the Northeast Corner of the tract herein described and lying in the West right-of-way line of County Road 104 (50 foot wide); THENCE South 00°00'00" West, with the said right-of-way line of County Road 104, a distance of 1319.70 feet to an Iron Rod found for corner, same being the Southeast Corner of the tract herein described; THENCE South 89°59'52" West, passing at 10 feet the West line of the aforementioned 10' wide road easement, and continuing on for a total distance of 2611.84 feet to an Iron Rod found for corner, same being the Southwest Corner of the tract herein described; THENCE North 00°04'49" East, passing at 699.70 feet the centerline of County Road 553 and continuing on for a total distance of 1319.70 feet to the POINT OF BEGINNING and containing 78.841 acres of land, more or less. II. The City Secretary is hereby directed to cause to be prepared- ah amend- ment to the official Land Use District Map of the City, pursuant to the provisions of Section 00-5 of Ordinance No. 246, and consistent with the approval herein granted for the re-classification of the hereinabove described property.
