Ord. 1392 2010-02-08ORDINANCE NO. 1392 AN ORDINANCE OF THE CITY COUNC[L OF THE CITY OF PEARLAND, TEXAS, DETERMINING A PUBL[C CONVENIENCE AND NECESSITY TO ACQUIRE FEE SIMPLE TITLE FOR THE CONSTRUCTION OF ROAD, DRAINAGE AND UTILITY IMPROVEMENTS ON CERTA[N REAL PROPERTY DESCRIBED HEREIN; AUTHORIZING THE C[TYATTORNEY, OR HIS DES[GNEE, AND OTHER CITY OFFICIALS TO TAKE SUCH ACTIONS AS ARE NECESSARY TO ACQUIRE PROPERTY, LOCATED WITHW THE CITY, BY DONATiON, PURCHASE, OR BY THE EXERCISE OF THE PQWER OF EMINENT DQMAIN; AND DECLARING AN EMERGENCY AS THE CONSTRUCTION OF MUNICIPAL IMPROVEMENTS BEARS DIRECTLY UPON THE HEALTH, SAFETY AND WELFARE OF THE C[T[ZENRY; AND PROV�DING AN EFFECTIVE DATE. WHEREAS, the Ci�y Cauncil recog�izes tha� a public con�enience and necessity exists for �he locatian, cansfrucfion, operation, and maintenance of road, drainage and utility impro�emen�s on certain real property described F�erein; and WHEREAS, accordingly, the City Council hereby acknowledges that it is in fhe public's best ir�terest to acquire fee simple title #o certain property for the construction of road, drainage and utility impro�ements on said property; now, therefore, BE {T ORDAINED BY THE C1TY COUNCIL OF THE CITY OF PEARLAND, TEXAS: S�ction 1. The City Council hereby finds ar�d determines tha# a public con�enience and necessity exists #or the construction of raad, drainage and utility impravements on certam real property located in Brazoria County, T�xas. Sectior� 2. The public convenience and n�cessity re�uires the acquisifion of right- of-way, by donation, purchase, candemnation, ar otherwise, afi certa�r� real property located within t�e City and situated in Brazoria Counfy, more particularly �escribed in Exhibits "A" and "B" attached hereto and incorporated herein for all purposes. Sectior� 3. The City Attorney, or his designee, and other City officials are hereby aufhorized and d�recfed, on behalf ofi the City to tafce such actions as are necessary to ORD[NANCE NO. 1392 acquire the property, described in Exhibits "A" and "B" and any improvements thereon, e�ther by donation, purchase or the exerc�se of the power of eminent domain. Section 4. The City Council heref�y declares that a public emergency exists for the acquisitio� of said property as the consfruction of road, drainage and ufiility improvem�nts bears directly upan the hea[th, safety, and welfare o#the citizenry; therefore this Ordinance shall be passed finally on its first and only reading and shal] take effect immediate�y upon its passage and appro�al �y the City Council.
