Ord. 1393 2010-02-08ORDINANCE N4. 1393 A[V ORDINANCE 9F TH� CITY COUNCI� �F THE CfTY OF PEAR�AND, TEXAS, DETERMINING A PUBLIC CONVENf ENCE AND NECESSITY TO ACQUIRE FEE SIMPLE T1TLE F4R THE CONSTRUCTION QF ROAD, DRAINAGE AND UTILITY IMPROVEMENTS ON CERTAIN REAL PROPERTY DESCRIBED HEREIN; AUTHORIZING THE CITY ATTORNEY, OR HIS DESIGNEE, AN� QTHER CITY 4FFICfALS TO TAKE SUCH ACTIONS AS ARE NECESSARY TO ACQUIRE PROPERTY, LOCATED WITH[N THE C1TY, BY DaNATIflN, PURCHASE, OR BY THE EXERCISE OF THE POWER OF EMINENT DOMA[N; AND DECLARfNG AN EMERGENCY AS THE CONSTRUCTION OF MUNICIPAL IMPROVEMENTS BEARS DIRECTLY UPON THE HEALTH, SAFETY AND WELFARE OF THE ClTIZENRY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council recognizes that a pub[ic con�enience and necessity exists for the location, construction, aperation, and maintenance of road, drainage and utility impro�ements on certain real property described herein; and WHEREAS, accordingly, the City Councif hereby acknawledges that it is in the public's best interest to acquire fee simp[e title #o cer�ain property #ar the construct�on of road, drainage and utility improvements on said praperty; naw, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE ClTY OF PEARLAND, TEXAS: Section 1. The Cify Council he�eby #�nds and determines that a pub[ic con�enience and necessity exists for the construction af road, �rainage and utili�y impro�ements on certain real property locafed in Brazoria County, Texas, Section 2. The public con�enience and necessity requ�res the acquisition of righfi- of-way, by donation, purchase, condemnation, or otherwise, of certain rea� property located within the City and situated in Brazoria County, more particularly descrihed in Exhibits "A" and "B" attached hereto and incorporated herein fgr all purposes. Section 3. The City Attarney, or his designee, and ofher City officials are hereby authorized and directed, on hehalf of the City to take such acfions as are necessary to ORD�NANCE NO. 1393 acquire the praperty, describec� in Exhibits "A" and `B" and any impro�ements thereon, either by donation, purchase ar the exercise of the power of eminent domain. Section 4. The City Counc�l hereby declares that a p�ablic emergency exists for the acquisition of said property as the construct�on o# raad, drainage and utility improvements bears d�rectly upon the health, safefy, and welfare af the citizenry; therefore this Ordinar�ce shall be passed finally on its first and or�ly reading and shall fake effect immediately upon its passage and approval by the C��y Caunci[.
