AN ORDINANCE OF TH� CITY COUNCIL OF TNE CITY OF PEARLAND,
TEXAS, DETERMINING A PUBLIC CONVENIENCE AND NECESSiTY TO
ACQUIRE FEE SIMPLE TITLE FOR THE CONSTRUCTION OF ROAD,
DRAINAGE AND UTILITY 1MPROVEMENTS ON CERTAIN REAL
PROPERTY DESCRIBED HERE[N; AUTH4RIZING THE CITYATTORNEY,
OR HIS DESlGNEE, AND OTHER C1TY OFFIClALS TO TAKE SUCH
ACTIONS AS ARE NECESSARY TO ACQUIRE PROPERTY, LOCATED
WITHIN THE CITY, BY DONATION, PURCHASE, OR BY THE EXERCISE
OF THE POWER �F EMINENT DOMAIN; AND DECLARiNG AN
EMERGENCY AS THE CQNSTRUCTIQN OF MUNICIPAL
IMPROVEMENTS BEARS DIRECTLY UPON THE HEALTH, SAFETYAN�
WELFARE OF THE CITIZENRY; AND PROVlDING AN EFFECTIVE DATE.
WHEREAS, the City Council recognizes fhat a public convenier�ce and necessity
exists for the locatian, construction, operation, and mainfenance ofi road, drainage and
utility improWements on certain r�al prop�rty described herein; and
WHEREAS, accvrdingly, fhe City Cauncil hereby acknow[edges tha� it is in the
public's best interest to acqu�re fee simple tit[e fo certain property for the construction of
road, drainage and utility improvements on said property; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS;
Section 'I . The City Council hereby finds and de�ermines that a public
conWenience anc� necess�ty exists for fhe consfructian af road, drainage and uti[ity
improvemenfis on certain rea[ property locate� in Brazoria County, Texas.
Section 2. The public convenience and necess�ty req€aires the acquisition o'f right-
of-way, by donation, purchase, condemnation, or otherwise, of certain real property Iocated
within the Cify and situated in Brazoria County, more particularly descri�ed in Exhibits "A°
and "B" attached hereto and incorporated herein �or all p�rposes.
Section 3. The City Attor�ey, or his designee, and other City officials are hereby
authorized and directed, on behalf of the City to take such actions as are necessary fio

acc�uire the property, described in Exhibits "A" and "B" and any �mpro�ements th�r�on,
either by donation, purchase or the exercise of ��e power of eminent domain.
Sec#ion 4. The City Council hereby declares that a public emergency exists for
the acquisition of said property as the constr�ction of road, drainage and utility
improvemen�s bears direc�ly upon the l�ealth, safety, and welfare ofit}�e citizenry; therefore
this Ordir�ance shall be passed finally on ifs first and only reading and shall #a[ce e�Fect
immediately upon its passage and approval by fhe City Council.
