Ord. 1408 2010-02-08ORDINANCE NO. 7408 AN �RDINANCE �F TH� CITY COUNC[L OF THE CITY 4F PEARLAND, TEXAS, DETERMINING A PUBLIC CONVENIENCE AND NECESSITY TO ACQUIRE FEE SIMPLE TITLE FOR THE CONSTRUCTION OF ROAD, DRAINAGE AND UTILITY IMPROVEMENTS ON CERTAIN REAL PROPERTY DESCRIBE� HEREIN; AUTHORIZ[NG THE C�TY ATTORNEY, OR HIS DESIGNEE, AND OTHER CfTY OFFICfALS TO TAKE SUCH ACTIONS AS ARE NECESSARY TO ACQUlRE PROPERTY, LOCATED WITHIN THE CITY, BY DONATIQN, PURCHASE, OR BY THE EXERCISE QF THE POWER OF EMENENT D�MAIN; AND DECLARING AN EMERGENCY AS THE CONSTRUCTION OF MUN1CtPAL IMPROVEMENTS BEARS DIRECTLY UPON THE HEALTH, SAFETYAND WELFARE OF THE CITIZENRY; AND PROV[DING AN EFFECTIVE DATE. WHEREAS, the City Council recognizes thaf a public con�enience and necessity exists for the Iacation, construction, operation, a�d maintenance of road, drainage and utilify improvemenfs on cer�ain reai property described herein; and WHEREAS, accordingly, the City Counci[ hereby acknowledges that it is in the public's best interest to acquire fee simple title to certain property for the construction of road, drair�age and utility improvements on said proper�y; now, therefore, BE !T ORDAINE� BY THE CITY COUNCIL OF THE C[TY OF PEARLAND, TEXAS; Section 1. The City Council hereby finds and determines that a public conven�ence and necessity exisfs for the construction of road, c{rainage and utility impro�ements on cer�ain real property located in Brazoria County, Texas, Section 2. The pu�lic can�enience and necessity requires th� acquisitian of �ight- of way, by donation, purchase, condemnation, ar atherwise, of certain rea[ property located wi�hin fihe City and situated in Brazoria County, more particularly described in Exhibits "A" and "B" attached hereto and incorporated herein for all purposes. Section 3. The City Attorney, or hES designee, and other City officials are hereby authorized and directed, on behalf of the City to take such actions as are necessary to ORDINANCE NO. '1408 acquire the property, described in Exhibits "A" and "B° and any impravements thereon, either by donation, purchase or the exercise o# the power of eminenf damain. Section 4. The City Council hereby dec[ares fhat a public emergency exis�s for the acquisitian of said property as the construcfi�on of road, drainage and utility improvements bears direct[y upon the health, safety, and weifare of the citizenry; therefore this Ordinance shal[ be passed f�nally an its first and anly reading and shall take effect immedia�ely upon its passage and approval by the City Council.
