Ord. 1409 2010-02-08OR�INANCE N�. �409 AIV 9R91NAIVCE OF TH� CITY C9�NC1� 9F TH� GITY 9F P�AFZ�A[V9, TEXAS, DETERMINING A PUBLIC CONVENIENCE AND NECESSITY TD ACQUIRE FEE SIMPLE TITLE FOR THE CONSTRUCTION OF ROAD, DRAINAGE AND UTIL[TY IMPROVEMENTS ON CERTA[N REAL PROPERTY DESCRIBED HEREIN; AUTHORIZING THE C[TYATTORNEY, OR HIS DESIGNEE, AND OTHER CITY QFFICIALS TO TAKE SUCH ACTIONS AS ARE NECESSARY TO ACQUIRE PROPERTY, LOCATE� WITHIN THE CITY, BY DONATION, PURCHASE, OR BY THE EXERCISE OF THE POWER OF EMINENT DOMAIN; AND DECLARING AN EMERGENCY AS THE C4NSTRUCTION 4F MUN�CIPAL IMPROVEMENTS BEARS DIRECTLY UPON THE HEALTH, SAFETY AND WELFARE OF THE CITIZENRY; AN� PROVIDING AN EFFECTIVE �ATE. WHEREAS, the City Ca�ncil recagn�zes that a public convenience and necessity exisfs for the Iocation, construction, operation, and mainfenance of road, drainage and u�ility improvements on certain real property descr�bed herein; and WHEREAS, accordingly, the City Cauncil hereby acknowledges that it is in the publfc's best interest to acquire fee simple title fo cer�a�n property for the canstruct�on of road, drainage and uti[ity impro�ements on said property; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE C1TY OF PEARLAND, TEXAS: Section 1. The City Council hereby finds and determines that a public con�enience and necessity exists for fhe cons�ruction of road, dra�nage and ut�lity impro�emer�ts on certain real property located in Brazoria Cou�ty, Texas. Section 2. The public convenience and necessity requires the acquisition of right- of-way, by donation, purchase, condemnation, or ot�erwise, of certain real property located w�thin the City and situated in Brazoria County, more particularly descri�ed in Exhibits "A" and "B" attached herefo and incorporated herein for all p�rposes. Sec�ion 3. The City Attorney, or his des�gnee, and ofher City officials are hereby authorized and directed, on behalf of t�e City to take such actions as are necessary to ORDtNANCE NO. 1409 acquire the property, described in Exh�b�fs "A" an� "B" and any impro�ements thereon, either by donation, purchase or the exercise of the pawer of eminenf damain. Section 4. The City Council hereby declares that a public emergency exis�s for the acquisitian of said property as the construction of road, drainage and utility imprvvemenfs �ears directly upon the health, safety, and welfare af the citizenry; therefore th�s Ordinance sha[I be passed finally on its first and only reading anc! shall take eff�ct immediately upon its passage and approval �y fhe City Counc�l.
