TEXAS, DETERMIN[NG A PUBLlC CONVENIENCE AND NECESSITY TO
ACQUIRE FEE SIMPLE TITLE FOR THE CONSTRUCTION OF ROAD,
DRAINAGE AND LITILITY IMPROVEMENTS ON CERTAIN REAL
PROPERTY DESCRIBED HEREIN; AUTHORIZING THE CITY ATTORNEY,
OR HIS DESIGNEE, AND OTHER CITY OFFICIALS TO TAKE SUCH
ACTIONS AS ARE NECESSARY T4 ACQUIRE PRQPERTY, LOCATED
WITHIN THE ClTY, BY DONATION, PURCHASE, OR BY THE EXERCISE
OF THE POWER OF EMINENT DOMAIN; AND DECLARING AN
EMERGENCY AS THE CONSTRUCTION OF MUNICIPAL
IMPROVEMENTS BEARS DIRECTLY UPON THE HEALTH, SAFETY AND
WELFARE OF THE CITIZENRY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council recognizes thaf a public con�enience anc� necessity
exists for the location, construction, operation, and mainfenance of raad, dra�nage and
utility impro�ements on certain real property described �erein; and
WHEREAS, accordingly, the City Council hereby acknowledges tf�at it is in the
pubiic's best interest to acquire fee simple title to certain property #or the construcfion of
road, drainage and utility improvements on said property; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 9. The City Council hereby finds and determines that a public
convenience and necessity exists for the construction of road, c[rainage and ufility
impro�ements on certain real property located in Brazaria County, Texas.
Section 2. The public c�nvenience and necessiiy requires the acqu�sition of right-
of-way, by donatior�, purchase, condemnation, or othennrise, of certain real p�operty located
within the City and situated in Brazoria County, more particularly described in Exhibits "A"
and "B" attached hereto and incorporated herein for afl purposes.
Section 3. The Ci�y Attorney, ar his designee, and other City officials are hereby
authorized and direcfed, on behalf of the City to take such actions as are necessary ta

acquire the property, described in Exhibits "`A" and `B" and any improvements thereo�,
either by donation, purchase or the exercise of the power of eminent domain.
Section 4. The City Council hereby declares that a public emergency exists for
the acquisition of said property as the construction of road, drainage and utility
impro�ements bears directly upon the health, safety, and welfare of the citizenry; therefore
this Ordinance shall be passed fina[ly an its f�rst and only reading and shal[ #ake effect
immediately upon ifis passage and appro�al by fhe City Council.
