AN ORDINANCE OF THE CITY COIJNCIL QF THE CITY OF PEARLAND,
TEXAS, DETERMINING A PUBLIC CONVENtENCE AND NECESSITY TO
ACQUIRE FEE SIMP�.E TITLE F�R THE CONSTRUCTION O� ROAD,
DRAINAGE AND UTiLITY IMPROVEMENTS QN CERTAIN REAL
PROPERTY DESCRIBED HEREfN; AUTHORIZING THE CITY ATTORNEY,
OR HiS DESIGNEE, AND OTHER CITY OFFICIALS TO TAKE SUCH
ACTiONS AS ARE NECESSARY TO ACQUIRE PROPERTY, l.4CATED
WiTH1N THE C1TY, BY DONATION, PURCHASE, OR BY THE EXERCISE
OF THE POWER OF EMINENT �OMAIN; AND DECLARING AN
EMERGENCY AS THE CONSTRUCTION OF MUNICIPAL
IMPROVEMENTS BEARS DIRECTLY UPON THE HEALTH, SAFETY AND
WELFARE OF THE CITIZENRY; AND PROVlDING AN EFFECTIVE DATE.
WHEREAS, the City Council recognizes that a pubiic con�enience and necessity
exists for the location, construction, operation, and main#enanc� af road, drainage and
util�ty impro�emen#s on certain reaf property descri�ed hereir�; and
WHEREAS, accordingly, the City Counci[ hereby acknowledges that it is in the
public's best interest to acquire fee s�mple fiitle to certain property for the construction of
road, drainage and utility improvements on said property; naw, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section't. The C�fiy Council hereby finds and determines that a pubfic
convenience and necessify exists for fhe cor�str�ction of road, drainage and utilify
improvemenfs on certain real property located in Brazoria County, Texas.
Section 2. The public con�enience and necessity requires the acquisition of right-
of way, by donat�on, purchase, condemnation, or otherwise, of certain real property locatecf
within the C�ty and sifuated in Brazoria County, more particularly described in Exhihits "A"
and "B" at�ached here�o and incorporated herein for all purposes.
Section 3. The City Attorney, or his designee, and other City officials are hereby
authorized ar�d directed, on behalf of th� City to take such actions as are necessary to

acquire the property, described in Exhibits "A" and "B" and any impro�ements thereon,
either by donafion, purchase or the exercise of the power of eminent domain.
Section 4. The City Cauncil hereby declares tha� a public emergency exists for
the acquisition of said praperty as �he cansfruction af road, drainage and utility
improvemenfs bears directly upan �he health, safety, and wel�Fare of the citizenry; therefore
this Ordinance shall be passed finally on its firsf and only reading and sha[I take effect
immediately upon its passage and appro�ai by the Ci�y Co�ncil.
