Ord. 1412 2010-02-08ORDINANCE NO. 1412 AN �RDINANC� OF TH€ GITY C9�1NC1� OF THE CITY �F PEARLAND, TEXAS, DETERMINING A PUBL�C CONVENIENCE AND NECESSITY TO ACQUIRE FEE SIMPLE TITLE FOR THE CONSTRUCT[ON OF ROAD, DRAiNAGE AND UTILITY IMPROVEMENTS ON CERTAIN REAL PROPERTY DESCRIBED HEREIN; AUTHQRIZING THE CITY ATTORNEY, OR HtS DESIGNEE, AND OTHER CITY OFFICIALS TO TAKE SUCH ACTIONS AS ARE NECESSARY TO ACQUIRE PROPERTY, LOCATED WITHIN THE CITY, BY DONATION, PURCHASE, OR BY THE EXERCISE OF THE POWER OF EMINENT DOMAIN; AND DECLARING AN EMERGENCY AS THE CONSTRUCTION OF MUNICIPAL IMPROVEMENTS BEARS DIRECTLY UPON THE HEALTH, SAFETYAND WELFARE OF THE CITIZENRY; AND PRQVIDING AN EFFECTIVE DATE. WHEREAS, the City Council recognizes that a puE�lic con�enience and necessifiy exists for the location, construction, operation, and maintenance of road, drainage and ut�lity improvements an certain real property described herein; ar�d WHEREAS, accordingly, the City Counci! hereby acknawledges that it is in the public's best interest to acqUire fee simpfe tifle to certain property for the construction of road, drainage and utility improvements on said property; now, there�ore, BE IT ORDAINED BY THE CITY COUNCIL OF THE C1TY OF PEARLAND, TEXAS: Section 1. The City Council hereby fir�ds and determines that a public convenience and necessity exisfs for the canstruction of road, drainage ar�d u�ility improvements an c�rtain real properky located in Brazoria County, Texas. Section 2. The pubfic con��nience and necessity requir�s the acquisition of right- of-way, by donation, pUrchase, condemnatior�, or otherwise, af certain real property located within the Cify and situated in Brazoria County, more par�icufarly described in Exhibits "A" and "B" attached hereto and incorporated here�n fior all purposes. Section 3. The City Attorney, or his designee, and afher City officials are hereby authorized and directed, on behalf of the City to fake such actions as are necessary �o ORDINANCE NO. '�412 acquire the property, described in Exhibifs "A" and "B" and any improvements thereon, either by danation, purchase or th� exercis� of the power of eminent domairt. Section 4. The City Cauncil hereby declares that a public emerg�ncy exists far the acquisition of said property as the constructian of raad, drainage and utili#y improvements bears directly upon the health, safety, and welfare o� the cifizenry; therefore #his Ordinance shall be passed finally on its firs� and only reading and sha[l �aKe effect immediately upon its passage and approval by the City Council.
