AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE
NO. 246, KNOWN AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE
OF THE CITY OF PEARLAND, TEXAS; PROVIDING FOR AMENDMENT OF THE
LAND USE DISTRICT MAP; PROVIDING AN EFFECTIVE DATE AND CONTAIN-
ING OTHER PROVISIONS RELATING TO THE SUBJECT.
WHEREAS, WILLIAM G. RICHTER, Agent for W. C. ADAMS and S. A. SHUKANE,
Owners of the property, filed June 5, 1984, an application for amendment pursuant
to Article IV, Section 00-10 of the Land Use and Urban Development Ordinance of the
City, for approval of a change in the land use all as provided for in Section 00-10,
said property being legally described in the original application for amendment
attached hereto, and made a part hereof for all purposes, as Exhibit "A"; and
WHEREAS, on the 19th day of June, 1984, a public hearing was held before
the Planning and Zoning Commission of the City of Pearland, Texas, all in accordance
with the provisions of Article IV, Section 10-2 (4) and (5) of Ordinance No. 246; and
WHEREAS, on the 25th day of June, 1984, the Planning and Zoning Commission
of the City submitted their report and recommendation to the City Council regarding
the proposed amendment application of WILLIAM G. RICHTER, Agent for W. C. ADAMS and
S. A. SHUKANE, Owners of the property, whereby they recommended and approved a
change of classification for the property described in Exhibit "A" from its existing
classification of Planned Unit (PU) to Plan Approval (Exhibit "B"); and
WHEREAS, upon receipt of the report from the Planning and Zoning Commission.
the City Council thereafter gave notice of a public hearing to be held on July 23,
1984, by publication in the official newspaper of the City, the affidavit of publi-
cation being attached hereto and made a part hereof for all purposes, as Exhibit "C"
said call and notice being in strict conformity with the provisions of Article IV,
Section 10-2 (6) of Ordinance No. 246; and
WHEREAS, a public hearing was held on the application of WILLIAM G. RICHTER,
Agent for W. C. ADAMS and S. A. SHUKANE, Owners of the property, by the City Council
at its regular meeting held on July 23, 1984; and
WHEREAS, the City Council having fully heard the testimony and argument of
all interested parties, having been fully advised in the premises, finds that in the
case of the application of WILLIAM G. RICHTER, Agent for W. C. ADAMS and S. A.
SHUKANE, Owners of the property, facts were presented which, in the judgment of the
City would justify the approval of said application it is therefore,
ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
The following described property located within the corporate City Limits
of the City of Pearland, Texas, recorded owners being W. C. ADAMS and S. A. SHUKANE,
and presently classified as PU (Planned Unit) is hereby for all purposes change and
re-classified as PA (Plan Approval), as shown in Exhibit "B" attached hereto:
A 6.352 Acre Tract of Land, Out of Lot 24 of the W. Zychlinski
Subdivision of Section 4, H.T.&B. Survey, Abstract No. 543,
Brazoria County, Texas, according to the Map or Plat recorded
in Volume 29, Page 43 of the Deed Records of Brazoria County,
Texas.
BEGINNING at a point in the West line of Lot 24 of the said W. Zychlinski
Subdivision and in the North line of a 60 ft. public road (Orange St.) and 30 feet
from the Southwest corner of Lot 24;
THENCE N. 00° 36' W., a distance of 906.35 feet along the West line of Lot
24 to an iron pipe marking the Northwest corner of Lot 24;
THENCE N. 89° 50' E., a distance of 325.16 feet along the North line of Lot
24 to an iron pipe for corner;
THENCE S. 00° 36' E., a distance of 371.83 feet to an iron pipe for corner;
THENCE S. 89° 53' W., a distance of 19.70 feet to an iron pipe for corner;
THENCE S. 00° 46' E., a distance of 369.46 feet to an iron pipe for corner
in the Centerline of a Houston Pipeline Company 30 ft. easement;
THENCE S. 27° 40' W., a distance of 187.41 feet along the Centerline of the
Houston Pipeline Company easement to an iron pipe in the North line of a 60 ft. Public
Road (Orange St.);
THENCE West along the North line of said 60 ft. road (Orange St.) at 200
feet pass an iron pipe and an iron rod and continuing a total distance of 216.47 feet
to the PLACE OF BEGINNING and containing 6.352 Acres, more or less.
II.
The City Secretary is hereby directed to cause to be prepared an amendment
to the official Land Use District Map of the City, pursuant to the provisions of
Section 00-5 of Ordinance No. 246, and consistent with the approval herein granted
for the re-classification of the hereinabove described property.
This Ordinance shall become effective after its passage and approval on
second and final reading.
