AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE
NO. 246, KNOWN AS THE LAND USE AND URBAN DEVELOPMENT ORDINANCE
OF THE CITY OF PEARLAND, TEXAS; PROVIDING FOR AMENDMENT OF THE
LAND USE DISTRICT MAP; PROVIDING AN EFFECTIVE DATE AND CONTAIN-
ING OTHER PROVISIONS RELATING TO THE SUBJECT.
WHEREAS, RONALD HAUSMAN, Agent for CHARLES T. CORWIN, PAT R. GREEN,
JAMES A. KENT and LARRY B. WILLIAMS, Owners of the property, filed May 6, 1985,
an application for amendment pursuant to Article IV, Section 00-10 of the Land
Use and Urban Development Ordinance of the City, for approval of a change in the
land use all as provided for in Section 00-10, said property being legally de-
scribed in the original application for amendment attached hereto, and made a
part hereof for all purposes, as Exhibit "A", and
WHEREAS, on the 21st day of May, 1985, a public hearing was held before
the Planning and Zoning Commission of the City of Pearland, Texas, all in accordance
with the provisions of Article IV, Section 10-2 (4) and (5) of Ordinance No. 246;
and
WHEREAS, on the 24th day of May, 1985, the Planning and Zoning Commission
of the City submitted their report and recommendation to the City Council regarding
the proposed amendment application of RONALD HAUSMAN, Agent for CHARLES T. CORWIN,
PAT R. GREEN, JAMES A. KENT AND LARRY B. WILLIAMS, Owners of the property, whereby
they recommended and approved a change of classification for the property described
in Exhibit "A" from its existing classification of Medium Density Single Family
Dwelling District (R-2) to Office and Professional (OP).
WHEREAS, upon receipt of the report from the Planning and Zoning Commission,
the City Council thereafter gave notice of a public hearing to be held on June 10, 1985,
by publication in the official newspaper of the City, the affidavit of publication being
attached hereto and made a part hereof for all purposes, as Exhibit "B", said call and
notice being in strict conformity with the provisions of Article IV, Section 10-2 (6)
of Ordinance No. 246; and
WHEREAS, a public hearing was held on the application of RONALD HAUSMAN, Agent
for CHARLES T. CORWIN, PAT R. GREEN, JAMES A. KENT and LARRY B. WILLIAMS, Owners of the
property, by the City Council at its regular meeting held on June 10, 1985; and
WHEREAS, the City Council having fully heard the testimony and argument of
all interested parties, having been fully advised in the premises, finds that in the
case of the application of RONALD HAUSMAN, Agent for CHARLES T. CORWIN, PAT R. GREEN,
JAMES A. KENT and LARRY B. WILLIAMS, Owners of the property, facts were presented which,
in the judgment of the City would justify the approval of said application, it is there-
fore,
ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
The following described property located within the corporate City Limits
of the City of Pearland, Texas, recorded owners being CHARLES T. CORWIN, PAT R. GREEN,
JAMES A. KENT and LARRY B. WILLIAMS, and presently classified as R-2 (Medium Density
Single Family Dwelling District) is hereby for all purposes changed and re-classified
as OP (Office and Professional):
16.5802 Acres (or 722,235 square feet) of land out of the
Thomas J. Green Survey, A-198, Brazoria County, Texas, and
being out of the northwesterly part of that certain 25.117
acre tract described in Deed dated April 11, 1952, from
Marion A. Bailey et vir to Jennie J. Settegast recorded in
Vol. 532, Pg. 506, Brazoria County Deed Records, said 16.5802
acres of land being described as follows:
BEGINNING at a 3" iron pipe at the east corner of the 60 foot wide right-of-
way of Stratford Street, as shown on the plat of Sherwood Subdivision, Section 2, re-
corded in Vol. 11, Pg. 87, Brazoria County Map Records, on the northwest line of said
25.117 acre tract, from which a 6" by 6" concrete monument at the north corner of said
25.117 acre tract on the southwest right-of-way line of State Highway FM 518, Pearland-
Friendswood Road, 100 feet wide, bears North 45° 49' East 447.08 feet;
THENCE South 62° 53' 18" East with the projection of the northeasterly right-
of-way line of said Stratford Street 606.09 feet to a 14" iron pipe for corner on the
southeast line of a 9.8988 acre tract out of the northwesterly part of the southeast
half of said 25.117 acre tract;
THENCE South 45° 49' West with said southeast line 1354.67 feet to a 14"
iron pipe for corner at the south corner of said 9.8988 acre tract on the southwest
line of said 25.117 acre tract, from which a 6" by 6" concrete monument on said line
bears South 44 18' East 69.25 feet;
THENCE North 44° 18' West with said line 574.08 feet to a 14" iron pipe for
corner at the west corner of said 25.117 acre tract;
THENCE North 45° 49' East with the northwest line of said 25.117 acre tract
1161.47 feet to the PLACE OF BEGINNING.
II.
The City Secretary is hereby directed to cause to be prepared an amendment
to the official Land Use District Map of the City, pursuant to the provisions of
Section 00-5 of Ordinance No. 246, and consistent with the approval herein granted
for the re-classification of the hereinabove described property.
This Ordinance shall become effective after its passage and approval on
second and final reading.
