PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Jamila Johnson of Brewer and Escalante Associates spoke for ExxonMobil. She explained that they are proposing a convenience store/gas station on this property. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST SE Curtis Delane, Attorney for Shepherd United Methodist Church, stated that they are concerned about the large number of businesses being built in the area. Director of Community Development and Services Gene Tumlinson stated that there is an existing convenience store outside the City limits on one corner and the other two corners are vacant. VI. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Multi -Family Dwelling District (MF) to Multi - Family Dwelling District (MF -S) Specific Use on the following described property, to wit: Legal Description: Lots 33-36, Block 35, Pearland Townsite, Brazoria Co., TX (2330 N. San Antonio) Owner: Gail Windam & Tommy Luttrell 2330 N. San Antonio Pearl and, TX 77581 Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the record. Director of Community Development and Services Gene Tumlinson stated that this request is for a one chair beauty shop in an existing home. 111. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Ws Gail Windam, 2330 N. San Antonio, explained that she is proposing to remodel her garage for a one chair hair salon so that she can semi -retire. She stated that she has been cutting hair in Pearland for approximately twenty-two years. She added that there will not be any major changes to the home, except the addition of a circle drive. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Orlen Pat O'Day, Box 162, explained that he lost the sale. of a piece of property because the City wants to run a street through it. He added that the First Baptist Church wanted to clear a lot near this property for parking and the City denied it. He also stated that now he has a home for sale across the street from this property. He does not think that the new homeowner would want to live across from a beauty salon. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Council Member Helen Beckman asked Ms. Windam if she lives at this location. Ms. Windam stated that she does live there and has for approximately twenty years. She added that she is only proposing to remodel the garage and install a circle drive. VI. Director of Community Development and Services Gene Tumlinson stated that the property is approximately three acres which is the current requirement for mobile home parks. VI. Edwards 7412 Kelving Houston, TX 77030 Agent: Mauris Hardcastle Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the record. Director of Community Development and Services Gene Tumlinson showed the location maps. Executive Director of Economic Development Corporation Mike Chance explained that the EDC was started in 1995 to promote businesses and raise the tax base. He stated that the City must have property zoned for Commercial and Industrial in order to entice these businesses to come to Pearland. Mr. Chance explained that this property adjoins the railroad, therefore, it is good for industrial use. He added that the property is included on the Comprehensive Plan as a Foreign Trade Zone. He also stated that this property is across from other industrial type businesses and the City has proposed an overpass for truck access. I11. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Charlie Eason of Hardcastle Real Estate, 6302 Broadway Street, explained that there is no manufacturing facility nearthis property, nor does it touch the railroad as Mike Chance had stated. He stated that the residents in the area would prefer more residential development. He added that as a real estate company, they have had no contacts interested in this property as Commercial or Industrial. Renee West, 6302 Broadway Street, explained that from a developers point of view, she stated that the railroad is not a concern. She stated that there are hundreds of acres for industrial use available on Mykawa. She added that there are no industrial businesses rushing to purchase those properties. Ms. West asked if the City would really want heavy industrial businesses with hazardous materials and explosives next to a school. She also stated that these businesses would include a lot of heavy truck traffic. Mary Edwards, 16235 CR 143, explained that this property is not next to the railroad tracks. She urged the City to change the zoning on this property to residential. She stated that there has been no interest in this land as Commercial or Industrial. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Dr. Glenn Garrison, 1902 Meadow Creek, presented a letter from the Pearland Independent School District Board of Trustees in opposition to this zone change request. He stated that a home worth $130,000.00 with a $10,000.00 homestead exemption would generate $968.00 in taxes. He explained that the school district would be spending more on this subdivision than it would bring in. He added that the Commercial percentage of the tax base has dropped significantly in the last few years, therefore, residential is carrying the tax base at this time. V. T. & B. R.R. Co. survey, A-508, Brazoria Co., TX (Veterans Drive @ Bailey Road) Owner: Read Partners L.P. & Kitty L. Read 6135 Olympia Houston, TX 77057 Agent: Mauris Hardcastle of Hardcastle Real Estate 62 Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the record. Director of Community Development and Services Gene Tumlinson showed the location map. He stated that the property was annexed into the City in October, 1997. He added that the Comprehensive Plan shows the property as blue - light industrial. 111. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Charlie Eason of Hardcastle Real Estate, 6302 Broadway Street, explained that this tract is directly South of the property considered in Zone Change Applications No. 908 and 909. He stated that it will be combined with those two tracts for development purposes. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Dr. Glenn Garrison, 1902 Meadow Creek, stated that the school district does not intend to hinder residential development, but asks that the properties be zoned to nothing less than R-1. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Council Member Woody Owens asked if there was any reason that this property could not be zoned R-1 or R-2, rather than R-3. Charlie Eason of Hardcastle Real Estate stated that he can not say why, but the property owner has requested R-3. Renee West of West Development stated that West Oaks subdivision is zoned R-3. A lengthy discussion ensued regarding the differences between R-1, R-2 and R-3. VI. ADJOURNMENT The Joint Public Hearing adjourned at 7:20 PM. Zoning Application No. 926 & Specific Use No. 82 1. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Mike Hogg, 3734 CR 541, explained that they did not realize that this property had been annexed by the City until after they were purchasing it. He stated that they are in the process of closing on the property now. He added that they have already hired a contractor.
