Ord. 0277 03-07-74ORDINANCE NO. AN ORDINANCE PRESCRIBING RATES TO BE CHARGED FOR DISTRIBUTION AND SALE OF NATURAL GAS WITH- IN THE CITY OF ALVIN, TEXAS, AND REPEALING ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALVIN, TEXAS: Section 1. The following rates and charges are hereby fixed as the maximum monthly net rates and charges, and are hereby authorized for distribution and sale of natural gas in the City of Alvin (the "City") to be applied and used by Houston Natural Gas Corporation (the "Company") its successors or assigns. RESIDENTIAL AND COMMERCIAL RATES NET MONTHLY RATE: The net monthly bill shall be based upon the following rates: First 400 cu. ft. or less $2.50 Next 2,600 cu. ft. 14.0 ¢ per 100 cu.ft. Next 3,000 cu. ft. 12.5 ¢ per 100 cu. ft. Next 4,000 cu. ft. 10.5 ¢ per 100 cu.ft. Next 10,000 cu. ft. 9.0 k per 100 cu.ft. Over 20,000 cu. ft. 7.5 k per 100 cu.ft. The above rates are net rates and will apply to all bills paid within 10 days of date of rendition. If bills are not paid within 10 days, gross rates shall apply, which rates shall be the above net rates plus one cent (1 ct.) per Ccf of gas consumed per month. Ccf as used herein means one hundred (100) cubic feet of natural gas. The penalty charged shall not, however, exceed the sum of $3.00 in any one month. The rates hereinabove set out shall be effective and applicable to distribution and sale of natural gas during all monthly billing periods commencing after the effective date of this ordinance, unless and until such rates shall be changed hereafter in accordance with law. Section 2. The foregoing rates are predicated upon the domestic City Gate Rate of 41.8 cents per Mcf permitted effec- tive May 1, 1973, pursuant to the order of the Railroad Commission of Texas dated October 13, 1972, in Gas Utilities Docket No. 483. If such City Gate Rate becomes higher or lower from time to time as orders of the Railroad Commission may permit, the rate herein fixed for residential and commercial use shall be likewise adjusted in an amount equivalent to the change in the City Gate Rate, minus or plus, as may be appropriate. Whenever an increase or decrease in the foregoing rates becomes appropriate under the foregoing adjustment provisions, the Company shall promptly file with the City Secretary a sworn statement setting forth the changes in the City Gate Rate and the resulting adjustment of the rates. Each such adjustment shall become effective for bills rendered on or after the first day of the billing month following the month in which such statement is filed. Section 3. The Company shall establish and post in its office, rate schedules providing monthly billing rates complying with Section 1. of this ordinance and may establish special contract rate schedules for large volume commercial or indus- trial use providing other rates and charges lower than the maximum rates established by Sections 1. and 2. hereof. In determining whether other rates are higher or lower than the rates set forth in this Ordinance, periods of twelve (12) consecutive months shall be considered, that is, if the con- sumer has a written contract with the utility, then the twelve (12) month period shall be calculated from the effective date of any such contract, or thereafter from any anniversary date of the contract. Section 4. The City Council shall have full power to regulate the rates and charges of Houston Natural Gas Corpora- tion, its successors and assigns, within the corporate limits of Alvin, Texas, or any extension thereof, and nothing herein contained shall'impair or diminish such power or any incidence thereof. Section 5. The City of Alvin, Texas, does not part with, but expressly reserves the right and duty, at all times, to exercise in the interest of the public, full regulation and control of the operations of Houston Natural Gas Corporation in respect of all matters connected with police powers of the City of Alvin, Texas, now or hereafter vested in it or its governing body. Section 6. All ordinances, resolutions, or parts thereof in conflict herewith are hereby repealed insofar but only insofar as such conflict exists. Section 7. Ordinance No. 70-U passed on final reading on the 17th day of December, 1970 is hereby in all respects repealed. Section 8.
