Ord. 0281 06-12-74ORDINANCE NO. 2 8 1 AN ORDINANCE ANNEXING CERTAIN PROPERTY AND TERRITORY TO THE CITY OF PEARLAND, TEXAS, AND EXTENDING THE CORPORATION LIMITS OF SAID CITY TO INCLUDE AND EMBRACE SAID TERRITORY WHICH IS ADJACENT TO AND CONTIGUOUS WITH THE PRESENT CORPORATION LIMITS OF SAID CITY AND IS NOT WITHIN THE CITY LIMITS OF ANY OTHER CITY AND LIES WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE CITY. OF PEARLAND; SAID TERRITORY BEING FULLY DESCRIBED BY METES AND BOUNDS IN THIS ORDINANCE; PRESCRIBING THE VOTING PRECINCTS FOR THE FUTURE INHABITANTS WITHIN SAID ANNEXED TERRITORY; PLACING SUCH FUTURE INHABITANTS ON EQUAL FOOTING WITH THE PRESENT INHABITANTS OF THE CITY OF PEARLAND: PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, FRANK D. BARRINGER has heretofore filed a Petition for Annexation with the City Council of the City of Pearland, Texas, pursuant to the Constitution and Laws of the State of Texas, including particularly Articles'974g, Vernon's Texas Civil Statutes, as amended, which Petition des- cribes the land to be annexed by metes and bounds and is duly acknowledged as required for deeds by each and every person or corporation having an interest in said land; WHEREAS, pursuant to notice given to the public, by publication on May 2nd, 1974, in the Sun Progress, a newspaper. of general circulation within said City and within the territory described in the Petition for Annexation, a public hearing has been held before the City Council of the City of Pearland, Texas, where the City Council heard such Petition and the arguments for and against same and all interested persons were provided an opportunity to be heard on the proposed annexation of the property and territory described in said Petition and hereinafter described in this ordinance, in the Council Room at City Hall of the City of Pearland, Texas, on the 13th day of May, 1974, which date is not more than twenty (20) and not less than ten (10) days prior to the institution of annexation procedures; WHEREAS, the hereinafter described territory lies within the extraterritorial jurisdiction of the City of Pearland, Texas; 1. 0 C WHEREAS, the land and territory hereinafter described is not more than one-half (1/2) mile in width, is vacant and without residents lies adjacent to and adjoins the City of Pearland, Texas, is contiguous with the presently existing city limits and is not within any other city; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. The Petition for Annexation of Frank D. Barringer is hereby granted in all respects and the following described vacant land and territory lying contiguous and adjacent to the City of Pearland, Texas, which land does not exceed one-half (1/2) mile in width is hereby received by, added and annexed to the City of Pearland, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Pearland, Texas, and the present boundary limits of the City and the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Pearland, Texas, which land and territory is more particularly described as follows, to -wit: 54.2755 acres of land in Brazoria County, Texas being part of Lot 9 and Lot 10, Section 5 of the H. T. & B. R. R. Company, Survey A-237 the plat of which is recorded in Deed Book 28, Page 6 of the Brazoria County Deed Records, said 54.2755 Acre tract of land being more particularly described by metes and bounds as follows: BEGINNING at a Fence Corner Post found marking the Northwest Corner of said Lot 9 and the Northwest Corner of that certain tract of land described in Vol. 417, Pg. 137 of the Brazoria County Deed Records, same being the Northwest Corner of the tract of land herein described; THENCE S. 89°59'45" E. with the fenced North line of said Lot 9 and the North line of that tract of, land described in Vol. 417, Page 137 of the Brazoria County Deed Records, a distance of 1045.56 feet to a 5/8 inch Iron Rod set on the West right of way line of Woody Road marking the Northwest corner of that certain 10 foot strip of land conveyed to Brazoria County for road widening by deed recorded in Vol. 843, Pg. 133 of the Brazoria County Deed Records, same being the Northeast Corner of the tract of land herein described; 2. THENCE South with the West line of WoodyRoad and said 10 foot strip, a distance of 2'137.97 feet to a 5/8 inch Iron Rod set marking the most easterly Southeast Corner of the tract of land herein described; THENCE N. 89°46'00" W. a distance of 208.71 feet to a 5/8 inch Iron Rod set marking a Corner of the tract of land herein described; THENCE South, a distance of 208.71 feet to a 5/8 inch Iron Rod set on the North line of F. M. Highway 518, marking the most westerly Southeast Corner of the tract of land herein described; THENCE N. 89°46'00" W. with the North line of said F. M. Highway 518, a distance of 686.85 feet to a Boat Spike set in an asphalt diveway marking the most easterly Southwest Corner of the tract of land herein described; THENCE North with the East line of that certain 1 Acre tract of land described in Vol. 465. Pg. 100 of the Brazoria County Deed Records, a distance of 209.66 feet to a 5/8 inch Iron Rod set marking the Northeast Corner of said 1 acre tract, same being a Corner of the tract of land herein described; THENCE N. 89°46'00" W. with the North line of said 1 Acre tract a distance of 150.00 feet to a 5/8 inch Iron Rod set on the West line of said Lot 10 marking the Northwest Corner of said 1 Acre tract, same being the most westerly Southwest Corner of the tract of land herein described; THENCE North with the West line of Lot 10 and the centerline of a 75 foot wide drainage easement, a distance of 2051.84 feet to the Place of Beginning and containing 54.2755 Acres of land, more or less. Section 2. The above territory and the area so annexed shall be a part of the City of Pearland, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Pearland, Texas, and any future inhabitants thereof shall be entitled to all rights and privileges of other citizens of said City, and shall be bound by the acts, ordinances, resolutions and regulations of the City of Pearland. Section 3. That any future inhabitants of the territory hereby annexed for the purpose of voting, shall vote until otherwise changed, in the respective voting precinct contiguous thereto in the City of Pearland, Texas. 3, Section 4. If any section, sub -section, word, sentence or phrase of this ordinance is held to be invalid it shall not affect the remaining provisions of this ordinance. Section 5. The City Secretary is hereby directed to file a certified copy of this ordinance together with a copy or duplicate of the Petition for Annexation of Frank D. Barringer in the office of the County Clerk of Brazoria County, Texas. Section 6. The City Secretary is hereby authorized and directed to publish a copy of this ordinance in accordance with the terms and provisions of the laws of the State of Texas. Section 7. That this Ordinance shall be effective after its passage and approval upon second and final reading. PETITION FOR ANNEXATION THE STATE OF TEXAS § COUNTY OF BRAZORIA § TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: That, FRANK D. BARRINGER, of Houston, Harris County, Texas, being the owner of land and territory hereinafter. described,. which land is located and situated immediately contiguous andadjacent to the existing corporate boundary and limits of the City of Pearland, Texas, is not more than one-half (1/2) mile in width, and is vacant and is without residents, does hereby petition and request that the Honorable Mayor and City Council of said city annex the land herein described into and make said land a part of the corporate limits of the City of Pearland, Texas, in accordance with the laws of the State of Texas, including, but not by the way -of limitation, Article 974g, Vernon's Texas Civil Statutes, as amended. The land which the. Petitioner, FRANK D. BARRINGER, asks to be considered for annexation is described by metes and bounds, as described in Exhibit "A" attached hereto and made a part hereof for all purposes.
