E r 1 C/] 28 (� ^A^t 35 _ 12 ORDINANCE NO. 297 AN ORDINANCE DETERMINING THE NECESSITY FOR THE ESTABLISHING OF BUILDING LINES FOR CERTAIN PUBLIC ROADWAYS WITHIN THE CORPORATE CITY LIMITS OF THE CITY OF PEARLAND, TEXAS; APPROVING THE LOCATIONS THEREOF; DIRECTING THAT BUILDING PERMITS NOT TO BE ISSUED FOR ANY WORK WITHIN SUCH BUILDING LINES; CONTAINING CERTAIN OTHER PROVISIONS RELATING TO ANY EXISTING STRUCTURES WITHIN SAID BUILDING LINES; DIRECTING THAT A CERTIFIED COPY OF THIS INSTRUMENT BE FILED FOR RECORD; PROVIDING A SAVINGS CLAUSE, AN EFFECTIVE DATE THEREOF, AND REPEALING ANY PARTS OF ORDINANCES IN CONFLICT THEREWITH; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND;TEXAS: Section 1. The City Council of the City of Pearland hereby finds and determines that the public necessity and convenience require the establishing of building lines for the following public roadways within the Corporate limits of the City of Pearland, to -wit; 1. Dixie Farm Road 2. Yost Road 3. John Lizer Road 4. Industrial Road 5. Magnolia Street 6. Walnut Street 7. Orange Street 8. Scott Street 9. Mykawa Road 10. McLean Road Section 2. Be it further ordained that said building lines for the streets and roadway heretofore described in Section T.shall be and the same are hereby established in accordance with the descriptions thereof which are attached hereto, and made a part of this ordinance for all purposes, as Exhibit "A". The area between said lines as shown and as fully described in particularity in Exhibit "A" of this ordinance is hereby established as an area between said building lines in which no new structure shall be permitted to be built and the Building Inspector and/or Building Official of the City of Pearland is hereby directed to refuse all building permits for the erection of any new structures and to refuse all building permits for the repair of all existing structures which are destroyed or partially destroyed by fire or other casualty, where the cost of the repairs or reconstruction are in excess of twenty five (2.5%) percent of the building's Market Value as determined by the current City Property Tax Assessment, Section 4. All existing structures extending within such building lines shall be required to conform to the new line within a period of not more than twenty-five (25) years from the date of enactment of this ordinance. Section 5. The City Secretary is hereby authorized and directed to cause a certified copy of this ordinance and all exhibits to be filed for record in the office of the County Clerk of Brazoria County, Texas, Section 6. If any part of any section, portion or part of this ordinance shall be held by a Court of Competent Jurisdiction to be void or unconstitutional, the rest and remainder of such ordinance not held to, be void or unconstitutional shall continue to remain in full force and effect, and any such partial illegality shall not affect the same as a whole, Section 7. Any ordinance or parts of ordinances heretofore passed by the City Council in conflict with this ordinance are hereby expressly repealed to the extent of such conflict, and Ordinance No. 278, heretofore L , i f f Vel 1 28.A"E • 37 passed by the City Council on the 12th day of June, 1974, is hereby expressly repealed all and singular. Section 8. This ordinance shall take effect and be in full force and effect from and after its adoption, passage and approval upon Second and Final reading. Cobk .Certified City Secretary CITY OF PEARLAND, TEXAS By / (- Carlton McComb Mayor - 3 - £ i t 1228 PAC 3 THE CITY OF PEARLAND, TEXAS Building lines for the following public roadways within the City of Pearland, Texas shall be in accordance with the following specifications and futher in accordance with the specifications contained in the Land Use and Urban Development Ordinance No. 246: Dixie Farm Road from the Southwest bank of Clear Creek, southerly, approximately 10,700 feet to the South City limit line. The minimum building lines for each land use classification shall be measured from a point sixty (601) feet on either side of the centerline of Dixie Farm Road. Yost Road from the Northeast right-of-way line of F. M. 518 (Broadway) northerly approximately 4,125 feet to the Southwest property line of lot 1, Block 11, Sleepyhollow Addition extended. The minimum building lines for each land use classification shall be measured froma point forty (401) feet on either side of the centerline of Yost Road. John Lizer Road from the Northeast right-of-way of Highway 35 easterly approximately 3,750 feet to the West bank of Mary's Creek. The minimum building lines for each land use classification shall be measured from a point forty (40') feet either side of the centerline of John Lizer Road. Industrial Road from the Southwest right-of-way line of Highway 35 westerly approximately 4,200 feet to the East right-of-way line of the Pearland Site Road. The minimum building lines for each land use classification shall be measured from a point forty (40') feet on either side of the centerline of Industrial Road. Magnolia Street from the West right-of-way line of the Pearland Site Road westerly approximately 4,950 feet to the West property line of Tract 11 Ryan Acres Addition extended. The minimum builing lines for each land use classification shall be measured from a point forty (40') feet on either side of the centerline of Magnolia Street. Walnut Street from it's intersection with F. M. 518 (Broadway) at Barry Rose Road westerly approximately 7,500 feet to the East right-of-way line of McLean. The minimum building lines for each land use classi- fication shall be measured from a point sixty (60') feet on either side of the centerline of Walnut Street. Orange Street from the West right-of-way line of Woody Road easterly approximately 8,500 feet to the East right-of-way line of Briar Circle. The minimum building lines for each land use classification shall be measured from a point forty (40') feet on either side of the centerline of Orange Street. EXHIBIT " A " E E II Scott Street from the West right-of-way line of Mykawa Road Westerly approximately 2,050 feet to the East right-of-way line of Woody Road. The minimum building lines for each land use classification shall be measured from a point forty (40') feet on either side of the centerline of Scott Street, Mykawa Road from the North right-of-way line of Orange Street approximately 5,900 feet to the North property line of Brooklyn Acres Subidivision extended. The minimum building lines for each land use classification shall be measured from a point fifty (50') feet on either side of the center line of Mykawa Road, McLean Road from the South right-of-way line of P. M. 518 (Broadway) approximately 8,600 feet South to the South City limits.
