Ord. 0329 06-28-76ORDINANCE NUMBER AN ORDINANCE OF THE CITY OF PEARLAND, BRAZORIA AND HARRIS COUNTIES, TEXAS, ADOPTING AND APPROVING THE RATE SCHEDULES OF HOUSTON LIGHTING & POWER COMPANY TO BE KNOWN AS SCHEDULE RS-1 AND SCHEDULE MGS-1 SET FORTH IN EXHIBIT "A" AND EXHIBIT "B" AS ATTACHED HERETO AND MADE A PART HEREOF BY REFERENCE: AND PRO- VIDING FOR AN EFFECTIVE DATE FOR SUCH RATE OR RATES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, BRAZORIA AND HARRIS COUNTIES, TEXAS: SECTION ONE (1): The City Council of the City of Pearland, Brazoria and Harris Counties, Texas, hereby approves and adopts as maximum charges to residential and small commercial users for electricity and electric service the rate schedules of Houston Lighting & Power Company, a public utility doing business under franchise in the City of Pearland, Texas, which schedules shall be known as Schedule RS-1 And Schedule MGS-1, said schedules (in- cluding Riders FC and COS) being attached hereto and marked "Exhibit A" and "Exhibit B" and made a part hereof by reference as is fully copied herein. SECTION TWO (2): The rate and charges prescribed in this ordinance shall apply to all electricity used by each customer to whom such rates are applicable as provided herein from and after each such customer's first regular meter reading following the final adoption of this ordinance. SECTION THREE (3): Within fifteen days after the expiration of each month hereafter, Houston Lighting & Power Company shall file with the City Secretary a statement of (a) its estimated cost of fuel for the succeeding month, showing the cal- culation of the weighted average cost of fuel, adjusted for the variation between the estimated cost and the actual cost of fuel in prior months, and the tentative adjustment under Rider FC of said rate schedules, showing the calculation of said adjustment; and (b) its cost of service adjustment for the succeeding month showing the sum of the 12 months costs and operating revenues exclusive of cost of service revenues less fuel revenue which would have been derived from associated fuel costs adjusted for the variation between the estimated cost and the actual cost of fuel in the second preceding month and the tentative adjustment under Rider COS of said rate schedules, showing the calculation of said adjustment. Each such tentative fuel cost adjustment and cost of service adjustment shall become effective for bills rendered on and after the first day of the next billing month unless, within fifteen days after the filing of such statement, the City Council shall have disapproved such tentative adjustment by motion or resolution. In the event that any such tentative adjustment or change in the fuel cost or the cost of service shall be disapproved by the City Council, such schedule shall continue to be adjusted by the last pre- vious adjustment for prior changes in fuel costs and/or cost of service not so disapproved, until another adjust- ment shall have taken effect hereunder. Within the fif- teen day period provided for its approval or disapproval of any such tentative adjustment, the City Council shall have the right and power to order the filing of any additional or supplemental information or statements, deemed necessary in the public interest, or to order a public hearing with regard to the approval or disapproval of such tentative adjustment. Furthermore, the total of the Cost of Service adjustment for any month shall not exceed .16 per KWH without approval of the City Council. SECTION FOUR (4): For purposes of determining the cost of service adjustment the following policies and procedures cannot be changed without prior approval of the City Council: (a) Depreciation rates applied to plant and equipment; (b) Policies regarding the capitalization of Allowance for Funds Used During Construction ,'ATTEST: including the rate used; (c) Policy of maintaining that portion of capi- talization represented by preferred stock at ten (10) percent or less of total capi- talization.
