A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AWARDING A BID FOR CONSTRUCTION SERVICES
ASSOCIATED WITH THE UNIVERSITY OF HOUSTON CLEAR LAKE
PEARLAND CAMPUS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That the City opened bids for construction services associated with the
University of Houston Clear Lake Pearland Campus, and such bids have been reviewed
and tabulated.
Section 2. That the City Council hereby awards the bid to Boring and Tunneling
Company of America in the amount of $96,122.
Section 3. The City Manager or his designee is hereby authorized to execute a
contract for construction services associated with the University of Houston Clear Lake
Pearland Campus.

Huitt-Zollars, Inc. (HZ) has reviewed the four(4) bids submitted on the referenced:project.
Attached-is a,copy of the bid tabulation for the four bids received. Boring &Tunneling;Co.:of
America (Bortunco) submitted the lowest bid of$96,122.
However, Bortunco's mobilization bid item (Item No. 1) exceeds the 3% maximum allowed for
the project:(maximum 3% of total bid price minus Item No. 1). This miscalculation can be
corrected;by limiting Bortunco's mobilization amount to the requiired:3% and adjusting the
remaining schedule of valves.so that the total bid price is equal to Bortunco's.bid.
HZ has reviewed the bids and feels the bid prices are appropriate for the work involved.
Bortunco has completed similar projects in a satisfactory manner. If the.City accepts the
proposed adjustment to the Mobilization Item issue, we recommend that the City of Pearland
award the contract based on the:low bid of$96,122 to Bortunco.

Pursuant to the published Invitation to Bidders, and Instructions to Bidders, the undersigned
Bidder hereby proposes to do all the work and furnish all necessary superintendence, labor,
machinery, equipment, tools and materials, and whatever else may be necessary to.complete all
the work described in or reasonably inferable from the Contract Documents for the construction of
the Underground Primary Feeder for U of H Clear Lake, Pearland Campus with all related
appurtenances,complete,tested, and operational,in accordance with the Plans, and Specifications
prepared by the Engineer, Huitt-Zollars,Inc., under the City of Pearland's inspection for the unit
prices or applicable prices set forth in Exhibit "A", bid form, which bears the undersigned's
initials for identification. It is understood that,in the event any changes are ordered on any part of
the Work, the applicable unit prices bid shall apply as additions to or deductions from the total
prices for the parts of the Work so changed.
The Bid Security required under the Instructions to Bidders is included with this Bid Proposal.
The Bidder agrees to submit to the Owner the Qualifications of Bidder, including the Financial
Statement of Bidder,as required by the Instructions to Bidders if requested to do so as a condition
of the Bid review.
The Bidder binds himself, upon acceptance of his proposal, to execute the Standard Form of
Agreement and furnish a Performance Bond and a Payment Bond, each in the amount of one
hundred percent (100%) of the total Contract Price, according to the forms included in. the
Contract Documents, for performing and completing the said work within the time stated and for
the prices stated in Exhibit"A"of this proposaL
The undersigned Bidder agrees to commence work within 10 days after the date of a written notice
to commence work. It is understood that the Work is to be Substantially Complete within 60 +j

' after the date of the notice to commence work. Time for Substantial Completion shall begin on
.the date established by the notice to commence work. The Contractor will pay liquidated damages
in the amount(s) specified in Document 00500 — Standard Form of Agreement in the event the
Work is not Substantially Complete in this time limit
It is agreed that the Contract Price may be increased or decreased to cover work added,altered,or I
deleted by order of the Engineer,in accordance with the provisions of the General Conditions of
Agreement.
The undersigned agrees that the amounts bid in this Bid Proposal will not be withdrawn or
modified for sixty(60)days following date of Bid Proposal opening, or such longer period as may
be agreed to in writing by the City of Pearland and Bidder.
It is understood that in the event the Successful Bidder fails to enter into the Standard Form of
Agreement and/or to furnish a Performance Bond and Payment Bond, each in the amount of one
hundred (100) percent of the Contract Price, within ten (10) days of the Notice of Award, the
Successful Bidder will forfeit the Bid Security as provided in the Instructions to Bidders. Unless
otherwise expressly provided herein,all references to"day(s)"shall mean calendar day(s).
The following Addenda have been received. The modifications to the Bidding Documents noted
therein have been considered and all costs thereto are included in the Bid Proposal prices.

Please find attached the Terms and Conditions (T&C) package, applicable for
providing City of Pearland with the requested underground service of 450 kVA from a
500 kVA, 12.47 kV - 480Y/277 V, 3 phase, 4 wire, pad mounted transformer. Also
included in this agreement are specifications for the installation of (1) 12.47 kV
underground feeder extension.
After applying a credit for standard overhead service, the cost for the facilities required to
provide the requested underground service is as follows:

DIFFERENCE IN COST $ 4,100
The above cost is based on using CenterPoint Energy's (CNP) standard installation
equipment and includes no overtime premiums. The standard overhead service credit is
based on installing (3) 167 kVA, pole mounted transformers and associated overhead
facilities.
After applying a partial credit for the standard. overhead feeder tie, the cost for the
facilities required providing the requested underground feeder extension is as follows:

no overtime premiums. Actual route of all facilities is dependent upon the location of the
facilities and easements in relation to any existing or planned retention ponds as well as
any designated or future wetland areas. No CNP facilities or easements will be
allowed in a designated or future wetland area.

6.3 AGREEMENTS AND FORMS
6.3.1 FACILITIES EXTENSION AGREEMENT
This Facilities Extension Agreement is entered into by and between CITY OF PEARLAND
,herein called"Retail
Customer"and CenterPoint Energy Houston Electric,LLC,herein called"Company"(hereinafter
referred to as Agreement)for the construction,extension,installation,modification,repair,upgrade,
conversion,relocation,de-energization or removal of Company's Delivery System,including temporary
facilities(hereinafter referred to as facilities extension or extension),as described herein.
This Agreement covers the facilities extension to Retail Customer location at 1200 PEARLAND PKWY
The Company agrees to accept payment of$90,584 Dollars
to be paid by the Retail Customer,as a Non-Refundable Construction Payment in connection
with the Retail Customer request to extend Company facilities to the above described location as
follows:INSTALLATION OF NON STANDARD CENTERPOINT ENERGY DISTRIBUTION FACILITIES
In consideration of said Non-Refundable Payment,to be paid to Company by Retail Customer
prior to commencement of construction, Company agrees to install and operate lines and
equipment necessary to distribute electric service to the identified location under the following
General Conditions:
• Company shall at all times have title to and complete ownership and control over
facilities installed by Company.
• Retail Customer must make satisfactory payment arrangements(if payment is required to
extend Company facilities)and sign and return this Agreement before Company can
proceed with the requested extension.
• Extension of service facilities is contingent on acquisition of all necessary easements and
rights of way

Nothing herein contained within this Agreement shall be construed as a waiver or relinquishment
by Company of any right that it has or may hereafter have to discontinue service for or on
account of default in the payment of any bill owing or to become owing thereafter for any other
reason or cause stated in Company's Tariff.
This Agreement shall not be binding upon Company unless and until it is signed by an
authorized representative of the Company.
