AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS
CREATING A NEW DEPARTMENT OF THE CITY TO BE
KNOWN AS THE EMERGENCY MEDICAL SERVICE DEPART-
MENT; CONTAINING GENERAL PROVISIONS RELATING
TO SAID DEPARTMENT; PROVIDING A SAVINGS CLAUSE
AND PROVIDING AN EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS:
SECTION I.
CREATION: Pursuant to the authority of Section 4.13 of
the Home Rule Charter of the City of Pearland, there is hereby
created, in and for the City of Pearland, a new department under
the general supervision of the City Manager, which shall be known
as the Emergency Medical Service Department, hereinafter referred
to as E.M.S.D..
SECTION II.
FUNCTION: The E.M.S.D. shall perform such emergency
medical service functions within the City, as prescribed by the
City Council, and in addition shall perform such duties outside
the Corporate limits as may be required pursuant to any interlocal
agreement with any other municipality or governmental entity.
SECTION III.
DIRECTOR: There is hereby created the office of Directo
of Emergency Medical Services, who shall be appointed by the City
Manager and approved by the City Council. The City Manager shall
serve as ex officio-director of emergency medical services until
this office is filled by appointment and ratification. The direct
shall have control and supervision over all officers and employees
assigned to the department subject to the control of the City
Manager, and shall be responsible for the general administration
and function of the department.
SECTION IV.
TERM AND SALARY: The Director shall not be appointed fo
a definite term but may be removed at the will and pleasure of the
City Council. The Director shall receive compensation as may be
fixed by the City Council.
SECTION V.
RULES AND REGULATIONS: The Director may make or pre-
scribe such rules and regulations for the conduct of his depart-
ment as he shall deem advisable; such rules, when approved by the
City Council, shall be binding on all officers and employees.
SECTION VI.
REPORTS: The Director shall make such reports to the
City Manager and the City Council as may be required and shall
also make recommendations for rulings, orders or ordinances
respecting emergency medical services whenever he is requested to
do so, or whenever he deems it necessary or advisable.
SECTION VII.
SAVINGS CLAUSE: If any section, sentence, clause,
phrase or portion of, this ordinance is for any reason held invalid
or unconstitutional by any Court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent pro-
vision and such holding shall not affect the validity of the re-
maining portions hereof.
SECTION VIII.
This ordinance shall become effective on and after its
second and final reading.
