Ord. 0364 10-25-77ORDINANCE NO. 364 AN ORDINANCE PRESCRIBING RESIDENTIAL, GENERAL SERVICE, INDUSTRIAL AND MUNICIPAL RATES TO BE CHARGED BY COMMUNITY PUBLIC SERVICE COMPANY FOR SALE OF ELECTRICITY WITHIN THE CITY OF PEARLAND, TEXAS, AND REPEALING ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: SECTION 1. The rates set forth in the attached schedules marked Exhibit "A", consisting of fifteen (15) pages, for the residential, general service, industrial and municipal service are hereby established as the rates to be charged by Community Public Service Company for the sale of electric service for residentiallgeneral service, industrial and municipal service within the City of Pearland, Texas. Said Rates shall be effective on all billing made the effective date of this ordinance. SECTION 2. All ordinances, -resolutions, or parts hereof in conflict herewith are hereby expressly repealed. Service may be furnished at other voltages when special ar- rangements are made in advance with company. Type of Service Unmetered, automatically controlled flood lighting operating every night from dusk to dawn. The company will install, own, operate and maintain overhead lights, photo -electrically controlled, each mounted on an existing service pole or poles; such service shall be limited to 120 volt service. Monthly Rate $ 8.60 net per 400 watt, 19,100 lumen mercury vapor lamp. 9.60 net per 400 watt, 26,500 lumen metal halide lamp. 14.30 net per 1,000 watt, 71,000 lumen metal halide lamp. SOUTHEAST in VIFION EXI1Hf1T "A-7 • INDUSTRIAL POWER SERVICE OFF PEAK SUPPLEMENTAL F!RM ELECTRIC SERVICE RIDER Available for Any customer taking service under Industrial Power Service Rate Schedule where customer wishes to purchase power and energy during company's off-peak hours for the operation of certain facilities which will be oper- ated only during such off-peak hours and which will exceed customer's annual on -peak requirements or any customer who owns, operates, and maintains an electric generating plant to supply a portion of customer's electric service requirements, and desires company to supply firm electric service which is supplemental to customer's own gener ation. Customer will not operate in parallel with his own generation except to the extent necessary to electrically interconnect for load transfer without interruption of service. Service under this rate is special and company will not•be obligated to furnish such service unless it presently has sufficient electrical capacity avail- able to provide the amount of service required. The company is not obligated to make additional off-peak capacity available when the company's off-peak KVA load exceeds 30% of the preceding on -peak KVA load. This off-peak service rider is not applicable to new customers takin service from October 16 through May 14, nor existing customers adding new facilities during such period. The terms of Industrial Power Service Schedule are modified only as follows: Determination of KVA (a) If the off-peak KVA is less than the annual on -peak KVA, the KVA shall be determined in accordance with the applicable rate schedule. (b) If in the current month the off-peak KVA is more than the annua on -peak KVA, the off-peak KVA in excess of the annual on -peak KVA shall be billed at $1.40 per KVA per month with the annual on -peak KVA billed in accordance with the Industrial Power Ser- vice rate schedule. Definition of Terms: On -Peak Hours Company's on -peak hours are designated as of the date hereof as bein from 8 a.m. to 10 p.m. each Monday through Friday starting on May 1 and continuing through October 15 each year. Labor Day and Independence Day (July 4) shall not be considered on -peak. If July 4 occurs on Sunday, then the following Mon-, day shall not be considered on -peak. The Comoany's on -peak hours may be changed from time to time and Customer will be notified'36 months prior to such change becoming effective. Off -Peak Hours Company's off-peak hours are all hours of the year not designated a on -peak hours. On -Peak KVA On -peak KVA. is the average KVA supplied during the 15-minute period of maximum use during the on -peak hours of the billing month. Annual On -Peak The greater of (1) the highest on -peak KVA previously established, KVA (2) 66S of the highest off-peak KVA established in the 12 months ending with the current month. Off -Peak KVA Off-peak KVA is the average KVA supplied during the 15-minute per- iod of maximum use during the off-peak hours of the billing month. Type of Service Unmetered, automatically controlled mercury vapor or high pressure sodium street lighting and/or sign lighting where the city or other governmental agency owns, installs and provides for the maintenance of the system; or company provides maintenance in accordance with Schedule II below. SOU/TIIF.AST DIVISION .SUPPLEMENTAL ELECTRIC SERVICE EXHI1111'1' "A-13" Available for Any customer served under any of company's standard rate schedules (except customers served under Industrial Power Service), who main- tains and operates an electric generating plant and who desires company to supply firm electric service which is supplemental to customer's own generation. The terms of the rate schedule under which customer is taking service are modified only as follows: Minimum Bill $2.50 per KVA per month but not less than $25.00 per month. Determination The initial amount of load in KVA which customer require-5 and company of KVA agrees to furnish. Should customer require supplemental electric Service in excess of the initial amount of load contracted for, the maximum amount required shall be used for billing purposes for 12 consecutive months. Requirements in excess of the initial amount of load contracted for will be deter- mined, at company's option, either by connected load count or measured by meter as the average KVA supplied during the 15-minute period of maximum use. Special Terms Customer will provide at his own expense and subject to approval by and Conditions company the protective devices required to connect to the company's facilities. Service under this rate is special and company will not be obilgated to furnish such service unless it presently has sufficient elec-. trical capacity available to provide the amount of service required. SOUTHEAST DIVISION EXI111 I'I' "A-15" -PURCHASE POWER COST ADJUSTMENT - RIDER PCA /ORM •u.• Electric service billed under all applicable rate schedules shall be subject to a Power Cost Adjustment (PCA) for increases or decreases during the current month (exclusive of fuel adjustment charges) in (1) the total adjustment charges to Company by its power supplier above or below a base of .0144t/KWH, and (2) the base energy and demand charges above those in effect on January 1, 1977. Monthly KWH charges on all applicable rate schedules shall be increased or decreased by the sum of PPA and PPB calculated according to the following formulas. S = All kilowatt hours estimated to be sold and recorded in the current month by the Company. T Estimated composite tax rate for gross receipts and other revenue related taxes for the Company expressed as a decimal. CF = A correction factor to be applied during the current month to provide for an allowance due to variance between actual PPA adjustment revenues and actual PPA adjustment expenses for the second preceding month prior to the current month. The calculation of the correction factor is as follows: CF = [(A) x (1-T ] - B, where A is the actual revenues received from the PPA adjustment factor applied in the second preceding month, and B is the actual adjustment expenses which have been paid to the supplier of purchase power in the second preceding month. BI = Any increase in base rates (in t/KWH) which are approved after January 1, 1977, by any regulatory commission having jurisdiction.
