Ord. 0365 11-14-771*} vot1370 PAGE 896 ORDINANCE NO. 365 AN ORDINANCE AMENDING-. THAT CERTAIN ORDINANCE (ORDINANCE NO. 358), PASSED, APPROVED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, ON THE 8th DAY OF AUGUST, 1977, ANNEXING CERTAIN PROPERTY AND TERRITORY TO THE CITY OF PEAR - LAND; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATIONS, REPEALING ALL ORDINANCES IN CONFLICT, AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT. WHEREAS, on the 8th day of August, 1977, the City Council of the City of Pearland, Texas, meeting in regular. session, passed, approved and adopted Ordinance No. 358, an ordinance annexing certain property and territory to the City of Pearland, Texas; and WHEREAS, the City Council has heretofore found that the field notes of the territory so annexed in Ordinance No. 358, contained a minor typographical error, and that said error should be corrected so as to perfect the record of said property and to prevent future location problems, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: SECTION 1. That certain ordinance (Ordinance No. 358) passed, approved and adopted by the City Council of the City of Pearland, Texas, on August 8, 1977, annexing certain property and territory to the City of Pearland, • Texas, is hereby amended by deleting in its entirety Section 1 thereof and adding as a new Section 1 the following paragraph to -wit: SECTION 1. The following described land and territory lying adjacent to and adjoining the City of Pearland, Texas, hereby is added and annexed to the City of Pearland, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Pearland, Texas, and the present boundary limits of said City,at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Pearland, Texas, which land and territory is more particularly described as follows, to -wit: FIELD NOTES ON 33.646 ACRES OF LAND, Being all of Tract 61 and a Portion of Tract 63 of the George W. Jenkins Subdivision in the W.D.C. Hall League, Abstract 23, and a Portion of Tract 58 of the Hoidale-Coffman Subdivision of the Upper End of the Perry and Austin League, Abstract 55, all Being Situ- ated in Harris County, Texas. BEGINNING at the intersection of the common line between the George W. Jenkins Subdivision and the Hoidale-Coffman Subdivision with the centerline of Clear Creek; Us' t—.::_It- „ VOL1J 10 PAGE 897 a THENCE N. 35° 50' 28" W. along the center of Clear Creek a distance of 14.88 feet to a point for corner; THENCE N. 32° 35' 40" W. along the center of Clear Creek a distance of 240.13 feet to a point for corner; THENCE N. 50° 50' 43" W. along the center of Clear Creek a distance of 265.27 feet to its intersection with the Northwesterly line of Tract 63 of George W. Jenkins Subdivision; THENCE N. 45° 33' 06" E. along the Northwesterly line of Tract 63, a distance of 1547.68 feet to its intersection with the Southwesterly line of Tract 61 of the George W. Jenkins Subdivision; THENCE N. 44°26' 54" W. along the Southwesterly line of 513.33 feet to the West corner of Tract 61; THENCE N. 45° 33106" E. along the Northwesterly line of 424.20 feet to the North corner of Tract 61; THENCE S. 44° 26' 54" E. along the Northeasterly line of Tract 61 at a distance of 1026.66 feet passing a 5/8" iron rod found for the East corner of Tract 61 and continuing in.all a total distance of 1146.66 feet to a point for corner; THENCE S. 45° 33' 06" W. along a line parallel to and 120 feet Southeast of the common line between the George W. Jenkins Subdivision and the Hoidale-Coffman Subdivision a distance of 2012.04 feet.to a point in the centerline of Clear Creek; of;Tract 61 a distance of Tract 61 a distance THENCE N. 35° 50' 28" W. along the center of Clear Creek a distance of 121.36 feet to the PLACE OF BEGINNING and containing 33.646 Acres of Land. SECTION 2. The City Council hereby ratifies, confirms and republishes all other sections contained in Ordinance No. 358, in all respects. SECTION 3. The amendment to Ordinance No. 358 prescribed above shall be effective on and after its passage and approval upon second and final reading: SECTION 4. If any section, sub -section, word, sentence, or phrase of this ordinance is held to be void, invalid or unenforceable, it shall not affect the remaining provisions of this ordinance. SECTION 5. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. SECTION 6. The City Secretary is hereby authorized and directed to publish a copy of this ordinance in accordance with the terms and provisions of the laws of the State of Texas, and the provisions of the Charter of the City of Pearland, Texas.
