(a) Massage establishment is hereby defined to mean any building, room, place or establishment other than regularly licensed hospital where manipulated massage or manipulated exercises are practiced Upon the human body for compensation by anyone not a duly licensed physician, whether with or' without the use of mechanical therapeutic or bath- ing devices, and shall include Turkish bath houses. SECTION 3: Fee, proration. The annual license fee shall be .~_~ ~ Dollars for each such establishment. If such license is obtained between January first and June thirtien%h of any year, the full amount of such fee shall be paid. No refund shall ever be made of any such license fees. SECTION 4: Revocation. Any ~icense issued hereunder may be revoked by the chief of police or the director of public health for a violation of' this article or any ordinance of the city or any law of the State of Texas by the licensee. Revoca- tion shall be effected by written notice to the licensee. SECTION 5: Health card required of employees. At the applicant shall and time of making application for such licenses, furnish to the health department the names addresses of all employees of such establishment and sexes; SECTION 7: Establishment not to accommodate both advertising to indicate sex of patrons. It shall be unlawful for any massage establish- ment to accommodate both male and female patrons. Any massage establishment that advertises its services shall clearly indicate in all advertising whether it accommodates male or female patrons. SECTION 8:. Employing prostitutes, vagrants, immoral characters. It shall be unlawful for any person operating such an establishment to employ a known prositute in any capacity therein. The Chief of Police shall refuse to approve the issuance of a license to any establishment which employes any person convicted of any crime involving moral turpitude in any state, municipal or federal court, or which employes a woman who has been convicted of vagrancy or prostitution, or who is a known prostitute. The Chief of Police shall refuse to approve the issuance of a license to any massage establishment ~hich accommodates both male and female patrons, or to any massage establishment in which persons of one sex massage persons of the opposite sex. SECTION 9: Closing hours; use as sleeping quarters. No Turkish bath or massage establishment shall be kept open for any purpose between the hours of ten o'clock of all employees, both on duty and list shall be shown to all proper police and health department upon cense required herein shall be exhibited in such establishments. It shall be the duty of every person conducting a Turkish bath or massage establishment to keep the same at all times in a clean and sanitary condi- tion. Ail instruments and mechanical, therapeutic, and bathing devices or parts thereof that come into contact with the human body shall be sterilized by a modern and approved method of sterilization, before initial use, and any such instruments and devices or parts thereof, after having been used upon one patron, shall be sterilized be- fore being used upon another. All masseurs and operators shall wash their hands thoroughly before administering massage manipulations to each patron accommodated. No person suffering from a communicable disease shall work or be employed in a massage establishment. SECTION 13: Any person violating any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be fined in any sum not exceed- lng TWO HUNDRED($200.00)DOLLARS.
