Ord. 0180 08-28-69ORDINANCE NO. J S0 AN ORDINANCE PROVIDING FOR THE APPOINTMENT OF A CITY ADMINISTRATOR, DEFINING HIS QUALIFICATIONS AND TERM OF EMPLOYMENT, PRESCRIBING CERTAIN DUTIES WHICH HE IS TO PERFORM, AND GRANTING HIM THE AUTHORITY TO CONTRACT FOR THE EXPENDITURE OF BUDGETED FUNDS NOT TO EXCEED $1,000.00. BE. IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, BRAZORIA COUNTY, TEXAS: SECTION I. [APPOINTMENT] That the City Council shall appoint a City Administrator who shall be the chief administrative and executive officer of the City, and shall be responsible to the City Council for the admin- istration of all the affairs of the City. The City Administrator shall have and exercise all powers of the City and he shall be charged with the enforcement of all laws and ordinances within the City insofar as their enforcement is within the powers of the City. The City Administrator shall attend all meetings of the City Council, shall keep the Council informed as to the affairs of the City, and shall recommend to the Council such actions that may be necessary and expedient for the welfare of the City. SECTION II. [QUALIFICATIONS] The City Administrator shallbe chosen by the City Council solely on the basis of his executive and administrative training, experience, and ability. The City Administrator shall not be appointed for a definite period of time, but may be removed at the will and pleasure of the City Council for any reason, by a vote of the majority of the entire Council. SECTION III. [GENERAL DUTIES] In addition to all powers and duties specifically assigned to him by the City Council of the City, the City Administrator shall also perform the following specific duties: 1. The City Administrator shall hire and discharge all employees authorized by the City Council to be hired, at such compensation that may be set or authorized by the City Council. All employees shall perform their duties subject to the direction of the City Adminis- trator or that of the superior to whom the City Admin- istrator may assign such employee. Provided, that such Administrator may delegate to any other official or employee the authority to hire or discharge any employees so authorized. The City Council and its members shall deal with the administrative services and their employees solely through the City Adminis- trator and neither the City Council or any member thereof shall give orders to any subordinate of the City Administrator, either publicly or privately. 2. The City Administrator shall prepare the annual budget and submit it to the City Council, and be responsible for its administration after its adoption. 3 The City Administrator shall prepare and submit to the Council as of the end of each fiscal year a report on the finances and administrative activities of the City for the preceding year. 4. The City Administrator shall keep the City Council ad- vised of the financial condition and future needs of the City and make such recommendations as may seem desirable.. 7. The City Administrator shall examine all proposed documents to which the City may be a party, and shall have the duty to see to it that all terms of any contract to which the City is a party are fully performed by all parties thereto. It shall be the duty of the City Administrator to see to the publication of all notices, ordinances or other documents required by law to be published, and to prepare or cause to be prepared, all reports which the City,or any officials thereof are required by law to prepare. The City Administrator shall keep a current inventory showing all real and personal property of the City and its location, and shall be responsible for the care and custody of all such property, including equipment, buildings, parks and all other city property, which is not by law assigned to some other officer or body for care and control. SECTION IV. [EXPENDITURES] That the City Council hereby conveys unto the City Administrator the authority to contract for all budgeted expenditures not to exceed $1,000.00 without further approval of the City Council. Contracts for more than $500.00 shall be let to the lowest and best re- sponsible bidder after there has been opportunity for competitive bidding. PASSED AND APPROVED this _qrQ day of , 1969.
