Ord. 0187 02-26-70ORDINANCE NO. / 8 7 AN ORDINANCE CREATING A LIBRARY BOARD IN .AND FOR THE CITY OF PEARLAND, TEXAS, PROVIDING FOR QUALIFICATIONS AND TERMS OF OFFICE FOR DIRECTORS OF SAID BOARD; PROVIDING FOR ORGANIZATION, POWERS AND FUNCTION OF SAID BOARD; PROVIDING FOR THE ESTABLISHMENT OF RULES AND REGULATIONS BY SAID BOARD; DEFINING POWERS OF CITY COUNCIL; PROVIDING A SAVINGS CLAUSE AND PROVIDING EFFECTIVE DATE HEREOF: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: SECTION 1: Creation. There is hereby created a board of library directors for the City to be known as the Pearland Library Board. The board shall consist of Seven directors, one director of which shall be designated as heairman, to be appointed by the Mayor by and with the • consent of the Council. The Mayor shall, with the advise and consent of the Council, designate one of the members as Chairman. SECTION 2: Qualifications. Directors of the Library Board shall reside within the City, and be persons qualified to perform the duties of such board. SECTION 3: Term of Directors. The initial board of directors shall be appointed and hold office as follows: (a) Three Directors to be appointed for three years; (b) Two Directors to be appointed for two years; and (c) Two Directors to be appointed for one year. Members thereafter appointed or reappointed shall hold office for a term of three years from the date of their appointments and until their success sors shall be appointed and qualified. Directors shall serve without com- pensation but may be reimbursed for any personal expense incurred in the performance of their duties. SECTION 4: Organization of Board: (a) A majority of the directors of the board shall constitute a quorum for the transaction of business, and they may hold general. or special meetings in the City Hall or other designated meeting places, at such times as they may by order direct. (b) The chairman of the board shall, as soon as possible after appointment, call an election and cause to be elected thereby one of the directors as Secretary and one as Treasurer. The Secretary and Treasurer shall serve for one year terms and may be re-elected for consecutive terms. (c) The Treasurer before entering upon his duties as such shall execute a good and sufficient Fidelity Bond, renewable annually, conditioned for the faithful performance of his duties and for the faithful accounting for all money or funds which by virtue of his office comes into his hands, and to be in such amount, forms and with such securities as may be prescribed and approved by the City Council. The Treasurer shall have the custody of all money and property received by said board of directors from all sources, and shall pay out the same only on vouchers, orders or checks properly co -signed by the Chairman and Treasurer thereof, and the Treasurer shall keep permanent books of records of all such funds, and all receipts and disbursements thereof, and for what purposes received and disbursed, and shall at the end of the City's fiscal year make a report in writing to said board of directors and to the City Council under oath, showing balances, receipts and disbursements, including a statement showing the amount and principal of trust funds on hand and how invested, which report shall be audited by a firm or person designated by the City Council, and if found correct, shall be transmetted to the City Council at the same time that the Treasurer or City Administrator is required to make his annual report, and to be approved and preserved in the same manner, if found correct. (d) The Secretary of said board of directors shall keep a permanent record of the proceedings of the board in the book proveded for that purpose, and shall also keep a permanent record of the several trust funds, from what sources received, the amounts thereof and for what uses and purposes, res- pectively, and he shall annually, at the same time of transmitting the Treasurer's report or audit to the City Council, make a report in writing under oath,to the City Council stating therein, substantially the same matter required to be reported by the Treasurer of said board, which report, if found correct, shall be approved and preserved by the City Council. SECTION 5: Powers and Function. The Library Board shall have the following expressed powers and function.. (a) To determine the purposes of the public library and develop long range plans and programs for public library development and service within the City. (b) To select and employ such personnel, agents or consultants as the board deems necessary for the proper management and development of any and all library facilities and services. (c) To prepare, with recommendations, an annual library operating budget, to be submitted for approval by City Council not less than two months prior to the commencement of the City's fiscal year. (d) To act as the City's agent in all matters relating to State, Federal and County Library Systems. (e) To arrange and conduct any form of publicity relative to its activities for the general purpose of public understanding. (f) To negotiate and enter into agreements and contracts with the United States Government, the State of Texas, Municipal. Corporations or political subdivisions thereof for the planning, developing, construction, or funding of library facilities or other facilities incidental thereto, pro- vided such agreements and contracts are first ratified by the City Council. (g) To accept gifts, donations and grants on behalf of the City for the development of public library facilities. (h) To establish and fix schedules of fees and charges for the use of the public library and attendant facilities and from time to time as the board deems necessary modify the same. (i) To recommend library sites for the present and future develop- ment of libraries within the City. (j) To actively encourage and secure support from the citizens of Pearland for the development of a public library system. SECTION 6: Rules and Regulations. The board of directors shall adopt, enforce and promulgate any reasonable rules and regulations govern- ing the use of any and all facilities and incidental to the purpose and interest of this ordinance. SECTION 7: Powers of City Council. The Mayor and City Council shall have the power to remove from office any or all of said board of directors or the said secretary or treasurer for nonperformance of duties or for misappropriation or wrongful use of fun dscjproperty and to require just and proper accounting of the same. SECTION 8: Savings Clause. If any section, paragraph, clause, or sentence shall be declared void and unenforceable or unconstitutional, it is hereby declared the intention of the City Council of the City of Pearland that the remainder of such ordinance shall remain in full force and effect. SECTION 9: Effective Date. This ordinance shall be effective and be in full force and effect after its passage and publication in the official newspaper of the City of Pearland.
