Ord. 0187-2 1985-02-25ORDINANCE NO. 187-2 AN ORDINANCE AMENDING SECTIONS 15-25, 15-27 15-28, 15-29, 15-30 AND 15-34 OF THE CODE OF ORDINANCES OF THE CITY OF PEARLAND, TEXAS; PROVIDING FOR MEETINGS, ELECTION OF OFFICERS AND THEIR DUTIES, AND POWERS AND FUNCTIONS OF THE PEARLAND LIBRARY BOARD; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; SPECIFICALLY REPEALING SECTIONS 15-31, 15-32, 15-33 and 15-35 OF SAID CODE; HAVING A SAVINGS CLAUSE; PROVIDING FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. Section 15-25 of the Code of Ordinances: of the City of Pearland, Texas, shall be and is hereby amended and shall read as follows: "Section 15-25. Meetings. The Pearland Library Board shall meet at least quarterly at the Pearland Branch Library. The regular meeting time shall be set by the Board. The Chairman may call such special meetings as he deems necessary for the orderly transaction of business by the Board. All meetings shall be public, except where authorized by law to be in closed session." Section 2. Section 15-27 of the Code of Ordinances of the City of Pearland, Texas, shall be and is hereby amended and shall read as follows: "Section 15-27. Election of Chairman and Other Officers. The Officers of the Board shall consist of Chairman, Vice -Chairman, Secretary and Treasurer. These officers shall be elected annually by the Directors from their number at the March meeting of the Board and shall serve for one year terms and may be re-elected for consecutive terms." Section 3. Section 15-28 of the Code of Ordinances of the City of Pearland, Texas, shall be and is hereby amended and shall read as follows: "Section 15-28. Vice -Chairman. The Vice -Chairman shall serve in the stead of the Chairman during the absence or disability of the Chairman, and while so serving shall have all of the duties and powers afforded the Chairman." Section 4. Section 15-29 of the Code of Ordinances of the City of Pearland, Texas, shall be and is hereby amended and shall read as follows: "Section 15-29. Secretary. The Secretary shall keep a permanent record of the proceedings of the Board in a book provided for that purpose." Section 5. Section 15-30 of the Code of Ordinances of the City of Pearland, Texas, shall be and is hereby amended and shall read as follows: "Section 15-30. Treasurer. The Treasurer shall have the custody of all money and property received by said Board from any and all sources, and shall pay out the same only on vouchers, orders or checks properly cosigned by the Chairman and Treasurer. The Treasurer shall keep permanent books of records of all such funds, all receipts and disbursements thereof, and for what purposes received and disbursed. Upon request of the City Council, the Treasurer shall execute a good and sufficient Fidelity Bond conditioned upon the faithful performance of his duties and for the faithful accounting for all funds of the Board." Section 6. Section 15-34 of the Code of Ordinances of the City of Pearland, Texas, shall be and is hereby amended and shall read as follows: "Section 15-34. Powers and Function. The Pearland Library Board shall be advisory in nature and shall perform the following functions: (f) The Board shall advise the Pearland Branch Librarian and the County Library Director of library needs. The Board shall act as a liaison. between the City of Pearland and the County Library System. The Board shall submit to the City Council after consultation with the Pearland Branch Librarian and the County Library Director an annual local operations budget request for the library. The Board shall handle monies given to it for use in support of the library. The Board shall accept gifts, donations and grants on behalf of the City for the development of the library and library facilities. The Board shall cooperate with all other public and private groups in advancing the best interests of the Pearland Branch Library and the Brazoria County Library System. (g) The Board shall render to the City Council all recommendations it considers advisable regarding the library. (h) The Board shall adopt, enforce and promulgate reasonable rules and regulations governing the use of any and all library facilities in order to further the purpose and interest of this Ordinance." Section 7. All Ordinances and parts of Ordinances in conflict herewith are hereby repealed, but only to the extent of, such conflict. Section 8. Sections 15-31 (Annual report by Treasurer), 15-32 (Records), 15-33 (Annual report by Secretary) and 15-35 (Rules and Regulations) of the Code of Ordinances of the City of Pearland, Texas, are hereby expressly repealed. Section 9. If any section, subsection, sentence, clause, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 10. It is the intent of the City Council of the City of Pearland, Texas that this Ordinance shall be codified in the City's official Code of Ordinances as provided hereinabove. Section 11. This being an Ordinance not requiring publication, the same shall be in force and effect from and after its second and final reading and passage thereof.
