R2009 -183 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AWARDING A BID FOR CONSTRUCTION SERVICES ASSOCIATEDWITH THE EAST MARY' CREEK REGIONAL DETENTION POND. That the City opened bids for construction services associated with the East Mary's Creek Regional Detention Pond, and such bids have been reviewed and tabulated. Section 2. Low bidder's qualifications and references were reviewed and checked. Along with several positive references,we received a few negative references,two of which were on previous City of Pearland projects. A meeting was held between the low bidder,City of Pearland, Brazoria Drainage District#4 staff, Lentz Engineering,and Freese and Nichols to allow the low bidder to clarify the issues and concerns on previous projects. Low bidder has summarized his clarifications in two letters included in this packet. Low bidder has assured the City and BDD#4 staff that the management of this project will be handled differently and with the utmost efficiency and care. They proposed different project personnel than on past projects. They desire to give the City a quality project so that they can continue to do work for the City in the future. Yost Road-The project was assumed by Triple B after a prior contractor failed to complete the project and the bonding company hired Triple B. The local residents were up in arms understandably due to the project starting then standing unmanned for nearly one year before we were engaged.In an effort to recruit support from the citizens I personally held a residents' meeting(town hall style) at the church located on Yost.During the meeting I explained the circumstances,offered contact information for my people,explained our schedule and did secure the residents support.The project was completed on time and we worked diligently throughout the project to accommodate the residents' concerns. Unfortunately,we did have two issues which caused frustration for the City. We had rain one afternoon after we had poured concrete which caused damage to the finish on the concrete. We also failed to properly install handicap ramps to ADA standards.Both these issues are not representative of Triple B's reputation or my expectations. I offer no excuses for the poor performance and sincerely apologize for same. We did learn from these mistakes and hope the City of Pearland will consider the project as a whole and not focus on the negative only. Cullen Detention Pond- On this project we failed to properly submit technical data for Pavestone blocks required at the outfall.Again,this matter is an embarrassment to me and my partners.There is no acceptable excuse for such an elementary requirement and the people involved have been counseled on the issue.I assure you this will not happen again. I pray these comments are acceptable and that these errors will not adversely affect the City of Pearland's confidence in Triple B's overall ability to professionally complete projects within the City. Triple B Services commenced construction on the project in September of 2008.We were substantially complete February 10th,2009.The project originally involved excavating approximately 180000CY+for a new detention pond with onsite placement of the fill material.It also included concrete pilot channel,storm sewers and establishing vegetation over the site. On or about November 17t 2008 we received a request from the engineer to provide pricing for installing an amenity lake with clay liner in the bottom of the nearly completed detention pond.The dimensions were discussed over the telephone and"unit prices"were provided and accepted.Additionally,we were told of the intent to delete several pay items for work included in our original"unit price"contract(See attached CO). The drawings for the changes were delivered to the field by the inspector and copies were sent to our office.The engineer was responsible for the staking of the project.The actual quantities staked,constructed and verified by the engineer overran the CO quantity. The owner received confirmation of same and has refused to pay for the extra work accusing Triple B of having responsibility for establishing quantities under a"unit price"contract.We had no choice but to file a Mechanic's Lien on the project while we attempt to convince the owner to fulfill his contract obligations. J hope this presentation of additional relevant facts will convince you and the City of Pearland that Triple B did perform its obligations under the contract.These extenuating circumstances have created angst among all involved resulting in an unjustified poor response to a request for recommendation from the engineer of record.
