A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AWARDING A BID FOR CONSTRUCTION SERVICES
ASSOCIATED WITH THE MAGNOLIA ROAD PROJECT (PHASE 3).
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That the City opened bids for construction services associated with the
Magnolia Road Project, and such bids have been reviewed and tabulated.
Section 2. That the City Council hereby awards the bid to Cross Roads
Industries, Inc., in the amount of $9,822,329.66.
Section 3. The City Manager or his designee is hereby authorized to execute a
contract for construction services associated with the Magnolia Road Project.

Competitive bids for City of Pearland Cop PN: T7001, Bid No. RFB0409-29 Magnolia Road
Expansion were received and opened at 2:00 p.m. on September 9, 2009. Eight bids were
received with Total Bid Prices ranging from $9,822,329.66 to $13,752,424.23. Cross Roads
Industries, Inc. of Tomball, Texas submitted the low bid price of$9,822,329.66.
CobbFendley &Associates, Inc. has tabulated and reviewed all of the bids submitted. Some of
the bids had discrepancies or submitted incomplete bid packages as noted below.
The bid form submitted by Hassell Construction Co. Inc. contains the following discrepancies:
1. The Item 228, Back Flow Preventer - FEBCO 3 765 2 Inch PVB with Enclosure. The
TOTAL QTY is 6 EA. Hassell had a UNIT PRICE of $1,200.00/EA and AMOUNT BID
OF$10.200.00. The correct AMOUNT BID should be $7,200.00.
2. The Item E6, 2" Water Taps & Service Lines — Long Side. The TOTAL QTY is 5 EA.
Hassell had a UNIT PRICE of $720.00/EA and AMOUNT BID OF $3,850.00. The
correct AMOUNT BID should be $3,600.00.
3. The Item E8, Sanitary Sewer Service Recon — Near Side. The TOTAL QTY is 5 EA.
Hassell had a UNIT PRICE of $725.00/EA and AMOUNT BID OF $3,875.00. The
correct AMOUNT BID should be $3,625.00.
This results in a corrected TOTAL BID ITEMS OF$11,111,634.65
The bid form submitted by W. W.Webber, L.L.C. contains the following discrepancies:
1. The Item 68, Metal Beam Guard Fence Transition (Three-Beam). The TOTAL QTY is 2
EA. Webber had a UNIT PRICE of $1,190.00/EA and AMOUNT BID OF $3,800.00.
The correct AMOUNT BID should be$2,380.00.
2. The Item 120, 8" PVC Water Line, Auger Construction. The TOTAL QTY is 120 LF.
Webber had a UNIT PRICE of$30.06/LF and AMOUNT BID OF$4,687.20. The correct
AMOUNT BID should be$3,607,20.
3. The Item 136, 24" PVC Sanitary Sewer, Auger Construction. The TOTAL QTY is 270
LF. Webber had a UNIT PRICE of$115.00/LF and AMOUNT BID OF $31,185.00. The
correct AMOUNT BID should be $31,050.00.

4. The Item 144, REFL PAVE MRK TY (W) 12" (SLD)(100MIL). The TOTAL QTY is 2,200
LF. Webber had a UNIT PRICE of $2.22/LF and AMOUNT BID OF $4,840.00. The
correct AMOUNT BID should be $4,884.00.
This results in a corrected TOTAL BID ITEMS OF$11,361,774.20
The bid form submitted by SER Construction Partners, Ltd. contains the following discrepancy:
The SUBTOTAL ALTERNATE BID ITEMS NO. 3 WAS $92,746.00 and should have been
$92,746.60 . The TOTAL BID ITEMS was correct at$11,607,209.60.
The bid form submitted by J. D. Abrams, L.P. contains the following discrepancy: The Item 144,
REFL PAVE MRK TY (W) 12" (SLD)(100MIL). The TOTAL QTY is 2,200 LF. J. D. Abrams had
a UNIT PRICE of $10.00/LF and AMOUNT BID OF $22.00. The correct AMOUNT BID should
be $22,000.00. This error is due to a misprint in the BID PROPOSAL which lists the
ESTIMATED QUANTITY as 2.200. This results in a corrected TOTAL BID ITEMS OF
$13,752,424.23.
No discrepancies were found in the other bids submitted. The discrepancies noted do not
change the order of(prices)(or) bidders.
The following is a list of the corrected bids for the above referenced project. Only the Subtotal
Base Bid Price and Total Bid Price including Alternates are listed. They are listed from low to

and disputed. Mr. Goza stated that when the next section of the
subdivision was bid,he did not award another contract to Vintage and
would not do business with Vintage again in the future.

Comments: Mr. Christian stated that he was the design engineer for Southgate
subdivision for Lingo Properties. The contractor who performed the work
was Vintage Construction not Cross Roads. Shad Cundiff and Rolando
Villegas were project manager and superintendent. Mr. Christian stated
that in his opinion the project did not go smoothly. Contractor did not
supervise crews and the superintendent was often absent from job, and
crews were not managed. Contractor asked for numerous change orders
which he felt were not justified due to their means and methods. He stated
that would not recommend them for work in the future.

Comments: Mr. Kilambi commented that Cross Roads was a small outfit and seemed
to be tight on cash. He did comment that the workmanship on the project
was good and he didn't know of any change orders. This was one of their
early projects.

Comments: Mr. Beck commented that this was a complicated project near a school
that included waterline adjustments. Cross Roads got off to a slow start on
the project and seemed to be understaffed,but management of Cross
Roads addressed the situation and got the project back on track. The work
was good and the city was happy with the project.

Comments: Mr.Martin stated that Cross Roads may be the best contractor that he has
ever worked with. He said that there were occasions where there were design changes
that many contractors would have asked for extra money,but they did the work without
requesting additional money.

Comments: Mr.Mickelson stated that Harris County had no prior experience with
Cross Roads Industries, and on this project there was a delay in the start
date,but one notice was given,the contractor was slow to start.
Additionally Mr.Mickelson stated that, submittals have been late,
incorrect and rejected for re-submission. He stated that this change order

involved a dispute with a supplier, and the contractor asked for what he
felt was an exorbitant amount for the change order. In an effort to be fair,
the County has tried to work with them,however, the issue came down to
either the contractor following the Engineer's decision on a Directive
Change or be declared in default. At this time he would not recommend
this contractor and recommends vigilance on the owner's part.

at this time it is too early to provide comment on recommendation.

This project consisted of removal and widening of the intersection of Rice Ave.and Westpark
Dr. at US 59. The scope of work included multiple phases of this major intersection. A redesign
by Cross Roads to eliminate conventional road sections of stabilization,cement stabilized base,
bond breaker and concrete pavement to a fast track design consisting of additional concrete
thickness,not only saved the Owner money but also completed the project ahead of schedule.
Other work included signalization, soil nail wall and utility adjustments.
