AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AUTHORIZ-
ING THE MAYOR TO EXECUTE AND THE CITY SECRETARY TO ATTEST
A CONTRACT BETWEEN THE CITY OF PEARLAND AND THE CITY OF
HOUSTON PURSUANT TO AND IN ACCORD WITH THE PROVISIONS OF
ARTICLE 970a, V. T. C. S. , APPORTIONING THE OVERLAPPING
EXTRATERRITORIAL JURISDICTION OF BOTH CITIES; STATING BY
REFERENCE THE TERMS OF SAID CONTRACT AND SPECIFICALLY
APPROVING SAME; AND PROVIDING EFFECTIVE DATE HEREOF:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS:
Section 1. The Mayor is hereby authorized to execute and the City
Secretary to attest a contract with the City of Houston, a municipal
corporation, under the terms of which the City of Pearland and the City
of Houston are, pursuant to the provisions of Article 970a, Vernon's
Annotated Civil Statutes of Texas, apportioning the overlapping extra-
territorial jurisdiction of the cities of Pearland and Houston within the
limits of Harris County, Texas, each city relinquishing a portion of its
extraterritorial jurisdiction to the other to provide a mutually agreed
upon boundary between the extraterritorial jurisdictions of the two cities.
Such contract also provides that the City of Houston is releasing to the
City of Pearland the overlapping extraterritorial jurisdiction, being that
area 1/2 mile from the southern and western city limits of the City of
Pearland as they existed on August 22, 1963, within Brazoria County,
Texas. A copy of such contract is attached hereto for reference and
marked "Exhibit "A". "
Section 2. The City Council hereby approves the form and substance
of said contract prepared and approved by the City of Houston and hereby
specifically approves the description of the line of mutual apportionment

AN ORDINANCE RELEASING. A. CERTAIN 32.73 ACRE TRACT OF LAND,
MOR:. 0R LESS, FROM THE -EXCLUSIVE EXTRATERRITORIAL JURISDICTION
OF THE CITY -OF HOUSTON; AUTHORIZING ITS`INCLUSION WITHIN THE'
EXCLUSIVE -EXTRATERRITORIAL JURISDICTION OF THE CITY OF PEARLAND;
SPECIFICALLY -CONSENTING -TO -ITS ANNEXATION BY THE CITY OF PEARLAND;
AND DECLARING AN EMERGENCY.;.
WHEREAS, by Ordinance No. 70-218 passed February 11, 1970

the overlapping extraterritorial jurisdictions of both cities; and
WHEREAS, the execution of such contract was subsequently
authorized by the City Council of the City of Pearland by its
Ordinance No. 188 passed February 26, 1970; and
WHEREAS, it was the intent of both cities that all of the
properties being developed as Green Tee Terrace Subdivision be
included within the extraterritorial jurisdiction of the City of
Pearland; and

WHEREAS, it has come to the attention of the City of Houston
and the City of Pearland that a certain 32.73 acre tract of land,
more or less, ,being a part of Green Tee Terrace Subdivision, was
inadvertently included within that portion of the apportioned
extraterritorial jurisdiction of the City of Houston; THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HOUSTON:-
Section 1. That the following described tract of land
containing 32.73 acres, more or less, and lying within the exclusive--_
extraterritorial- jurisdiction of the City of Houston is hereby
released by -the City of Houston so that it shall hereafter be a
part of the exclusive extraterritorial jurisdiction of the City of
Pearland•=
BEGINNING at a point in the southeasterly line of the
E. M.-House Survey A-1075, same also being the north-
westerly line of the-W. D. C. Hall Survey A-23 and the
northeasterly -projection of the northwesterly line of
Green Tee Terrace Subdivision, Section 2-1-said point
being located 2000 feet northeasterly from the south-
westerly -corner of the E. M. HousetSurvey A-1075;
THENCE N 45° 00' 30° E along the northwesterly line of
the:W. D. C. Hall Survey A-23 and the northeasterly
projeetion of the northwesterly line of Green Tee
Terrace Subdivision, Section 2, a distance of 683.79
feet more or less, to the northeasterly corner of a
certain 462.5732 acre tract of land in the W. D. C.
Hall Survey A-23, described as "First Tract' in that
certain deed. from James W. Fair, Trustee, dated July 10,
1968 as_recorded Volume 7529, Page 11, Harris County
Deed Records;
THENCE S 45° 17' 22" E along the northeasterly line of
said "First Tract", a distance of 2084.91 feet, to the
southeasterly corner of said "First Tract";
THENCE S 45° 00' 25" W along the northeasterly extension
of the southeasterly line of Green Tee Terrace Subdivision,
Section 2, a distance of 683.79 feet more or less, to a
point for corner, said point being the intersection with
an imaginary line located 2000 feet northeasterly from
the southwesterly corner of the E. 14. House Survey A-1075
and perpendicular and at right angles to the southeasterly
line of the E. M. House Survey A-1075 and the north-
westerly line of the W. D. C. Hall Survey A-23;
THENCE N 45° 17' 22" ','1 a distance of 2085 feet more or
less to the POINT OF BE,GIVNING containing 32.73 acres
of land more or less.

Section 2. The consent of the City of Houston is hereby
specifically granted to the City of Pearland to annex such 32.73
acre tract of land within its boundaries at such time as it deems.

Section 3. There exists a public emergency requiring that
this ordinance be passed finally on the date of its introduction,
and the ,Mayor having in writing declared the existence of such
emer ency and requested such passage, this ordinance shall be
finally on the date of its introduction, this 21st day of
February 1973, and shall take effect immediately upon

Department and hereby specifically approves the description of the
line of mutual apportionment of the extraterritorial jurisdictions
of the City of Houston and the City of Pearland in Harris County,
Texas, and hereby specifically approves the provision of the contract
releasing to the City of Pearland the overlapping extraterritorial
jurisdiction of the two cities in Brazoria County, Texas.
Section 3. There exists a public emergency requiring that
this ordinance be passed f nally on the date of its introduction, and

THE STATE OF TEXAS
COUNTIES OF HARRIS
AND BRAZORIA
THIS AGREEMENT is made and entered into this 26
day of February 1970, by and between the CITY OF HOUSTON,
Harris County, Texas, a municipal corporation, duly organized and
existing under the laws of the State of Texas, and the CITY OF
PEARLAND, Brazoria County, Texas, a municipal corporation duly
organized and existing under the laws of the State of Texas.
Upon the terms and conditions set forth in this contract,
the CITY OF HOUSTON and CITY OF PEARLAND hereby agree that it is
the mutual desire and intent of the governing bodies of both cities,
• pursuant to Article 970a, V.T.C.S., to apportion the overlapping
extraterritorial jurisdictions of the cities of Houston and Pearland
for the mutual convenience of such cities, to make the future expansion
of municipal services susceptible of comprehensive planning, and to
facilitate the planning of future extensions of the boundaries of
both such cities and do hereby contract as follows:
•I.
The parties agree that the extraterritorial jurisdictions,
as that jurisdiction is defined in the Municipal Annexation Act,
of both the cities of Houston and Pearland overlap in an area within
Harris County, Texas, generally betweenthe present corporate limits
of both such cities and also overlap in an area within Brazoria
County, Texas, generally south and west of the City of Pearland; and
it is recognized by the governing bodies of both cities that it is
to the mutual interest of both cities to apportion such overlapped
extraterritorial jurisdictions as nearly as possible along survey
and property lines. It is also recognized that it is to the best
interest of both cities for the City of Houston to release to the
City of Pearland certain areas of its exclusive extraterritorial

Jurisdiction in order that a logical and reasonable line of
demarcation between the extraterritorial jurisdictions of both
cities be drawn and to facilitate the orderly planning and future
expansion of both cities. It is, therefore, deemed in the best
interest of both the cities of Pearland and Houston that the
extraterritorial Jurisdictions of such cities in Harris County,
Texas, as provided for in Article 970a, V.T.C.S., shall hereby be
mutually apportioned by and between the two cities along the line
described in Section Il,of this contract and that additionally those
areas within the exclusive extraterritorial Jurisdiction of the
City of Houston lying to the southwest of such line, within Harris
County, Texas, be hereby released to the City of Pearland.
II.
The line dividing the extraterritorial Jurisdiction of the
City of Houston from the extraterritorial jurisdiction of the City
of Pearland within Harris County, Texas, is hereby described as
follows;
BEGINNING at a point in the present city limit line of
the City of Houston as established by Ordinance No. 3351,
passed December 31, 1956, said point being the intersection
of the northeasterly line of the D.H.M. Hunter Survey,
A-36,and the southwesterly line of the H.T. & B.R.R. Co.
Survey, A-416 with the southwesterly extension of the north-
westerly right-of-way line of K1ngspoint Road (formerly
known as Watts Road);
THENCE southeasterly along the northeasterly line of the
D.H.M. Hunter Survey, A-3o and the T.J. Green Survey,
A-290, said line also being the southwesterly line of the
H.T. & B.R.R. Co. Survey, A-410, the George McDougal
Survey, A-564 and the E. M. House Survey, A-1075, to the
southeasterly corner of the T. J. Green Survey, A-290,
same also being the southeast corner of Lot 104, Allison -
Richey Gulf: Coast Homes Company Subdivision and the
southwesterly corner of the E. M. House Survey, A-1075;
THENCE northeasterly along the southeasterly line ofthe
E. M. House Survey, A-1075 a distance of 2,000 feet to
a point for corner;
THENCE southeasterly along a line perpendicular to and
measured at right angles to the southeasterly line of the
E. M. House Survey, A-1075 to its intersection with the
northwesterly line of Jenkins Subdivision, said .line also
being the northwesterly lines of Lot 30 and Lots 33 through
47 of the said Jenkins Subdivision within Harris County;

THENCE northeasterly along the northwesterly line of
Jenkins Subdivision to the northeasterly corner of
Lot 34, Jenkins Subdivision;
THENCE southeasterly along the northeasterly line of Lot 34
and Lot 61, Jenkins Subdivision to the southeasterly
corner of Lot 61, Jenkins Subdivision, said corner
also being in the southeasterly line of the W.D.C. Hall
Survey, A-23;
THENCE northeasterly along the southeasterly line of
the W.D.C. Hall Survey, A-23 a distance of 1,900 feet more
or less, to a point for corner, said point being the
northeasterly corner of the Humble Pipe Line Company
73.2 acre tract located within the Perry & Austin Survey,
A-55, Harris County, Texas; • cz. •
THENCE southeasterly along the northeasterly line of the
said Humble Pipe Line Company 73.2 acre tract and said
line extended southeasterly to its intersection with the
center line of the meanders of Clear Creek and the Harris
County -Galveston County line.
IIL
From and after the date of this contract, the City of Houston
shall have exclusive extraterritorial jurisdiction, to the exclusion
of the City of Pearland, within Harris County, Texas, in that area to
the northeast of the line described in Section II above.
IV.
From and after the date of this contract, the City of Pearland
shall have exclusive extraterritorial jurisdiction, to the exclusion
of the City of Houston, within Harris County, Texas, in that area to
the southwest of the line described in Section II above.
V.
From and after the date of this contract, the City of Houston
releases to the City of Pearland all of the overlapped extraterritorial
jurisdiction of the City of Houston within Brazoria County, Texas,
consisting of a strip one-half mile in width from the southern and
western boundaries of the City of Pearland as they existed on August
22, 1963, to the City of Pearland. �\
VI,
This agreement shall be executed in duplicate, either copy
of which shall be considered to be an original copy, by the Mayor
of each city, attested by the City Secretary and under the corporate
seal of each of said cities.

IN TESTIMONY_ WHEREOF, the cities of Houston and pearland have
authorized the execution of this contract by the appropriate officials,
such authority having been granted by resolution or ordinance of the
respective governing bodies thereof.
