Ord. 0195 04-23-70ORDINANCE NO. 195 AN ORDINANCE ANNEXING CERTAIN PROPERTY AND TERRITORY TO THE CITY OF PEARLAND, TEXAS AND EXTENDING THE CORPORATION LIMITS OF SAID CITY TO INCLUDE AND EMBRACE SAID TERRITORY WHICH IS ADJACENT TO AND CONTIGUOUS WITH THE PRESENT CORPORATE LIMITS OF SAID CITY AND IS NOT WITHIN THE CITY LIMITS OF ANY OTHER CITY AND LIES WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF PEARLAND; SAID TERRITORY BEING FULLY DESCRIBED BY METES AND BOUNDS IN THIS ORDINANCE; PRESCRIBING THE VOTING PRECINCTS FOR THE FUTURE INHABITANTS WITHIN SAID ANNEXED TERRITORY; PLACING SUCH FUTURE INHABI- TANTS ON EQUAL FOOTING WITH PRESENT INHABITANTS OF THE CITY OF PEARLAND; PROVIDING.A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, The Golfcrest Country Club, a Texas non-profit corporation, filed a Petition for Annexation with City Council of the City of Pearland, Texas, pursuant to the Constitution and Laws of the State of Texas, including particularly Articles 97)4.g Vernon's Texas Civil Statutes, as amended, which Petition describes the land to be annexed by metes and.bounds and is duly acknowledged as required for -deeds by each and every person or corporation havinginterest in said land; WHEREAS, pursuant to notice given to the public for publication on April 2,.1970, in the Tri County Sun Progress, a newspaper of general circulation within said City and within the territory described in the Petition for Annexation, a public hearing has been held before the City Council of the City of Pearland, Texas, where City Council heard such Petition and the arguments for and against same and all interested persons were provided an opportunity to be"heard on the proposed annexation of the property and territory described in said petition and hereinafter described in this ordinance, in the Council Room at City Hall of the City of Pearland on the 13th day of April, 1970, which date is not more than twenty (20) and not less than ten (10) days prior to the institution of annexation procedures; WHEREAS, the hereinafter described territory lies within the extraterritorial jurisdiction of the City of Pearland, Texas; WHEREAS, the land and territory hereinafter described is not more than one-half (1/2) mile in width, is vacant and without residents lies adjacent to and adjoins the City of Pearland, Texas, is contiguous with the presently existing city limits and is not within any other city; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, Section 1. The Petition for Annexation of The Golfcrest Country Club Corporation is hereby granted in all respects and the following described vacant land and territory lying contiguous and adjacent to the City of Pearland, Texas, which land does not exceed one-half (1/2) mile in width is hereby, received by, added and annexed to the City of Pearland, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City and the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Pear - land, Texas, to which land and territory is more particularly described as follows, to -wit: A tract of land in Harris County, Texas containing 200.00 acres being a part of and out of that 468.92 acre tract of land described in deed recorded in Volume 1676, Page 362, of the Deed Records of Harris County, Texas in the W.D.C. Hall Survey, Abstract 23, in Harris County, Texas and being more particu- larly described by metes and bounds as follows: BEGINNING at a 1/2 inch iron rdd marking the north- easterly corner of this tract of land herein described, said beginning corner being located S 65° 14' 01" W, a distance of 1896.19 feet from a 1 inch iron pipe marking the northeasterly corner of the aforesaid 468.92 acre tract of land; THENCE N 55° 27' 01" W, a distance of 584.22 feet to a 1/2 inch iron rod for corner; THENCE S 29° 37' 00" W, a distance of 1375.00 feet to a 1/2 inch iron rod for corner; -2- THENCE N 34° 04' 00" W, a distance of 570.00 feet to a 1/2 inch iron rod for corner; THENCE N 51° 07' 00" E, a distance of 1410.00 feet to a 1/2 inch iron rod marking an angle point; THENCE N 19° 01' 21" E, a distance of 310.55 feet to a 1/2 inch iron rod marking an angle point; THENCE N 36° 14' 00" E, a distance of 128.56 feet to a 1/2 inch iron rod marking an angle point; THENCE N 70° 10' 00" E, a distance of 166.44 feet to a 1/2 inch iron rod marking an angle point; THENCE S 86° 59' 00" E, a distance of 125.00 feet to a 1/2 inch iron rod marking an angle point; THENCE S 83° 10' 27" E, a distance of 320.06 feet to a 1/2 inch iron rod for corner, said point being located northwesterly a distance of 350 feet from the south- easterly line of the said 468.92 acre tract of land; THENCE N 38° 17' 50" E, a distance of 427.93 feet to a 1/2 inch iron rod for corner, said point being located northwesterly a distance of 400 feet from the south- easterly line of the said 468.92 acre tract of land; THENCE N 45° 00' 25" E, along a parallel to and 400 feet northwesterly from the southeasterly line of the said 468.92 acre tract of land, a distance of 1740.00 feet to a 1/2 inch iron rod for corner; THENCE N 32° 10' 00" E, a distance of 1150.00 feet to the PLACE OF BEGINNING. Section 2. The above described territory and the area so annexed shall be a part of the City of Pearland, Texas, and the property so added hereby shall bear its prorata part of the taxes levied by the City of Pearland, Texas, and any future inhabitants thereof shall be entitled to all rights and privileges of other citizens of said City, and shall be bound by the acts, ordinances, resolutions and regulations of the City of Pearland. Section 3. That any future inhabitants of the territory hereby annexed for the purpose of voting, shall vote until otherwise changed, in the respective votingprecinct contiguous thereto in the City of Pearland, Texas. -4- Section 4. If any section, sub -section, word, sentence or phrase of this ordinance is held to be invalid it shall not affect the remaining provisions of this ordinance. Section 5. The City Secretary is hereby directed to file a certified copy of this ordinance together with a copy or duplicate of the Petition for Annexation of The Golfcrest Country Club Corporation in the office of the County Clerk of Brazoria County, Texas, and in the office of the County Clerk of Harris County, Texas. Section 6. The City Secretary hereby authorized and directed to publish a copy of this ordinance in accordance with the terms and provisions of the laws of the State of Texas.
