Ord. 0196 05-22-70ORDINANCE NO. 196 AN ORDINANCE ANNEXING CERTAIN PROPERTY AND TERRITORY TO THE CITY OF PEARLAND, 'TEXAS AND EXTENDING THE CORPORATION LIMITS OF SAID CITY TO INCLUDE AND EMBRACE SAID 'TERRITORY WHICH IS ADJACENT TO AND CONTIGUOUS WITH THE PRESENT CORPORATE LIMITS OF SAID CITY AND IS NOT WITHIN THE CITY LIMITS OF ANY OTHER CITY AND LIES WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF PEARLAND; SAID TERRITORY BEING FULLY DESCRIBED BY METES AND BOUNDS IN THIS ORDINANCE; PRESCRIBING THE VOTING PRECINCTS FOR THE FUTURE IN- HABITANTS WITHIN SAID ANNEXED 'TERRITORY; PLACING SUCH FUTURE INHABITANTS ON EQUAL FOOTING WITH PRESENT INHABITANTS OF THE CITY OF PEARLAND PROVIDING A SAVINGS CAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, Green Tee Corporation has heretofore filed a petition for Annexation with City Council of the City of Pearland, Texas, pursuant to the Constitution and Laws of the State of Texas, including particularly Articles 974g Vernon's Texas Civil Statutes, as amended, which Petition describes the land to be annexed by metes and bounds and is duly acknowledged as required for deeds by each and every person or corporation having interest in said land; WHEREAS, pursuant to notice given to the public for publication on April 30, 1970, in the Tri County Sun Progress, a newspaper of general circulation within said City and within the territory described in the Petition for Annexation, a Public Hearing has been held before the City Council of the City of Pearland, Texas, where City Council heard such Petition and the arguments for and against same and all interested persons were provided an opportunity to be heard on the proposed annexation of the property and territory described in said 1. petition and hereinafter described in this ordinance, in the temporary quarters of the City Council located in the Pearland Volunteer Fire Department's Office, 3501 Orange Street, Pearland, Texas on the llth day of May, 1970, which date is not more than twenty (20) and not less than ten (10) days prior to the institution of annexation procedures; WHEREAS, the hereinafter described territory lies within the extraterritorial jurisdiction of the City of Pearland, Texas; WHEREAS, the land and territory hereinafter described is not more than one-half (1/2) mile in width, is vacant and without residents lies adjacent to and adjoins the City of Pearland, Texas, is contiguous with the presently existing city limits and is not within any other city; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF P.EARLAND, 'TbXAS , Section 1. The Petition for Annexation of Green Tee Corporation is hereby granted in all respects and the following described vacant land and territory lying contiguous and adjacent to the City of Pearland, Texas, which land does not exceed one-half (1/2) mile in width is hereby received by, added and annexed to the City of Pearland, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City and the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Pearland, Texas, to which land and territory 2. is more particularly described as follows to -wit: Being all that certain tract or parcel of land lying and situated in Harris County, Texas and a part of the W. D. C. Hall Survey, Abstract No. 23 and being a part or portion of that certain 462.5732 Acre Tract of land described as "First Tract" in that certain deed from James W. Fair, Trustee dated July 10, 1968 as recorded in Volume 7529, Page 11 of the Harris County Deed Records to which reference is hereby made and said part or portion being described by metes and bounds as follows: BEGINNING at a point in the Westerly line of the W. D. C. Hall Survey, A-23, said point being located N 45° 001 30" W. 10476.90' of the most Westerly intersection of said Westerly line of the W. D. C. Hall Survey and the new meanders of Clear Creek; THENCE N 45° 00' 30" E, 111.70' along the Westerly line of the W. D. C. Hall Survey, A-23, said line also being the Easterly line of the E. M. House Survey, A-1075 to the Northeast corner of said E. M. House Survey, said point also being the Southeast corner of the A. M. Gentry Survey, A-292; THENCE S 45° 17' 22" E, 2084.91' to the Northeast corner of the aforementioned "First Tract"; THENCE S 45° 00' 25" W, 173.54' along the Easterly line of the aforementioned "First Tract"; THENCE N 38° 14' 00" W, 565.29' to a point for corner; THENCE N 61° 17' 00" W, 188.32' to a point for corner; THENCE N 43° 24' 00" W, 1343.00'the PLACE OF BEGINNING and containing 6.454 acres of land, more or less. 3. Section 2. The above described territory and the area so annexed shall be a part of the City of Pearland, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Pearland, Texas, and any future inhabitants thereof shall be entitled to all rights and privileges of other citizens of said City, and shall be bound by the acts, ordinances, resolutions and regulations of the City of Pearland. Section 3. That any future inhabitants of the territory hereby annexed for the purpose of voting, shall vote until otherwise changed, in the respective voting precinct contiguous thereto in the City of Pearland, Texas. Section L. If any section, sub -section, word, sentence or phrase of this ordinance is held to be invalid it shall not affect the remaining provisions of this ordinance. Section 5. The City Secretary is hereby directed to file a certified copy of this ordinance together with a copy or duplicate of the Petition for Annexation of Green Tee Corporation in the office of the County Clerk of Brazoria County, Texas, and in the office of the County Clerk of Harris County, Texas. Section 6. The City Secretary hereby authorized and directed to publish a copy of this ordinance in accordance with the terms and provisions of the laws of the State of Texas.
