Ord. 0200 06-22-70c2 / t2 ORDINANCE NO. a n O AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, PROVIDING FOR THE RESTRICTION OF PARKING UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF PEARLAND, AS SET OUT IN THIS ORDINANCE, REPEALING PRIOR ORDINANCES IN RELATION HERETO, AND PRO VIDING FOR PENALTY OF A FINE -NOT LESS .THAN $5 AND -NOT TO EXCEED $25 FOR THE VIOLATION `OF THIS ORDINANCE:'‘ WHEREAS, Article 67O1D, Vernon's Annotated Civil Statutes of the State of Texas provides that whenever the governing body of the City shall determine that parking restrictions are required to promote and provide for free movement of traffic, the City may determine and declare the required restrictions by passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such locations, now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS; Section 1. No person shall stop, park or leave standing any vehicle, whether attended or unattended on either side of State Highway Farm Road 518, Broadway Street, from the West City Limit to the East City Limit where signs have been placed prohibiting or restricting such parking. Section 2. Whenever any police officer finds a vehicle standing upon that portion of the roadway in violation of the foregoing provision of the ordinance, such officer is hereby authorized *Le move such. vehicle, or require the driver or other person in charge of the vehicle to move same, to a position outside the restricted area, Section 3. Any person violating any provision of Section 1 of this ordinance, shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than FIVE DOLLARS ($5.00) nor more than TWENTY FIVE DOLLARS ($25.00). Section 4. That ordinance No. 159, enacted by the -City Council of the City of Pearland, enacted on the 23rd day of May, 1968, A.D., be and the same is hereby repealed all and singular. Such repeal not to effect existing litigation, if any, and not to operate as an abatement to any action or proceeding now pending under or by virtue of the above numbered ordinance so repeated.
