AN ORDINANCE AMENDING RATES OK CHARGES FOR THE USE AND
SERVICE OF THE SEWAGE SYSTEM OF THE CITY OF PEARLAND, TEXAS,
REPEALING ORDINANCE NO. 208, REPEALING ALL LAWS IN CONFLICT
HEREWITH, PROVIDING A SAVINGS CLAUSE AND ESTABLISHING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
SECTION I: There be and there is hereby established rates or charges
for the use and service of the sewerage system of the City of Pearland. Such
rates or charges shall be upon the following basis:
Section A: Commercial and Industrial
1. Commercial and Industrial customers having City Water Service:
The monthly sewer service charge for all Commercial and Industrial
customers having City Water Service will be 60% of the monthly bill
for water usage. $2.00 Monthly Minimum.
2. Commercial and Industrial Customers not having City Water Service:
The monthly sewer service charge for all Commercial and Industrial
customers having sewer service but not having City Water Service will
be 60% of comparable bill for City Water Service. The City will install,
at its expense, a water meter in the private water supply and read the
meter monthly to determine the amount of water consumption. $2.00
Monthly Minimum.
3. Com~ercial and Industrial customers who have waste water discharge
split between the Sanitary Sewer and other methods of discharge:
In the event that only a portion of the customers waste water is
discharged into the Sanitary Sewer, the City Council, upon the customers
request, shall estimate what portion of the water usage is discharged
into the sanitary sewer and his monthly sewer charge will be. figured
accordingly. $2.00 Monthly Minimum.
4. Commercial and Industrial customers who use the water that is a part
of their product or production process and that is not discharged into
the sanitary sewer system:
If water is a part of a Commercial or Industrial customers product or is
used in his production process in such a manner that there is no discharge
into the sewer system then, upon the customers request, the City Council
will establish the amount of water used for such purpose and the customer
will be billed accordingly. $2.00 Monthly Minimum.
Section B: Residential
t. Residential customers having City Water:
The monthly sewer rental charge for all customers having City Water will
be based on 60% of the average water bill for the preceding winter
months of December, January, and February. This amount, so established,
will be the monthly sewer service charge for the following twelve
months. $2.00 Monthly Minimum.
2. Residential customers having City Sewer Service but not having City
Water Service:
If a customer is connected to the Sanitary Sewer System but not connected
to the water system then the private system wilt be metered and the sewer
rate equated to an equal amount of City Water usage during the three
winter months. $2.00 Monthly Minimum.
3. New Customers who have not established an average winter month water
usage:
New customers connecting to the City Sewer System after February of each
year will pay a monthly charge based on 60% of the monthly water bill.
After the succeeding winter months consumption has been established,
this established rate will be used to determine the past months' sewer
charge. Any excess paid by the customer over the previous months Will
be applied to the ensuing years bill. $2.00 Monthly Minimum.
Section C: Multi-Family Housing
1. Multi-Family Housing with separate water meters:
Multi-family housing projects in which each residential unit is separately
metered will be charged a monthly sewer service charge as shown in
Section B, Residential above. $2.00 per unit Monthly Minimum.
2. Multi-family housing with common water meter for all housing units:
Multi-family housing in which the housing units are served through a
common water meter will be billed as shown in Section A, Commercial and
Industrial'above. $2.00 per unit Monthly Mini~a]m.
SECTION II: Ail ordinances, resolutions, or parts of ordinances or
resolutions, in conflict herewith, are hereby repealed. Ordinance No. 208 is
hereby expressly repealed.
SECTION III: If any article, subdivision, paragraph, clause, section,
phrase, or sentence of this ordinance, or the application, thereof to a particular
person, set of persons, or to a particular set of circu/nstances, should for any
reason, be held invalid, such invalidity shall in no wise affect the remaining
provisions hereof, and to such end the various provisions hereof are declared to be
separable.
SECTION IV: This Ordinance shall be Effective after its passage and
adoption on second and final reading.
