Ord. 0513-03 04-08-91ORDINANCE N0. 513-3 AN ORDINANCE AMENDING CHAPTER 10, ARTICLE IV., FIREWORKS, OF THE CODE OF ORDINANCES OF THE CITY OF PEARLAND, FOR THE PURPOSE OF REPEALING SECTIONS 10-76(4) AND 10-76(5); PROVIDING A SAVINGS CLAUSE AND A SEVERABILITY CLAUSE; AND PROVIDING FOR CODIFICATION AND AN EFFECTIVE DATE. WHEREAS, the City Fire Marshal has recommended the repeal of Sections 10-76(4) and 10-76(5) of the Code of Ordinances of the City of Pearland for the purpose of removing the exceptions to application of the Code which have grandfathered certain existing fireworks stands within the 5,000 feet of the City Limits; Now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND: Bection One. That .the Code of Ordinances of the City of Pearland, as same may have been heretofore amended, be, and is hereby further amended at Chapter 10, Article IV, Fireworks, by repeal of Sections 10-76(4) and 10-76(5) and none other. Section Two. All rights and remedies which have accrued in the favor of the City under Ordinance No. 513, and amendments thereto, shall be and are preserved for the benefit of the City. Section Three. If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect any other provision or application of this Ordinance which can be given effect without the invalid provision or application and to this end the provisions of this Ordinance are declared to be severable. Section Four. It is the intent of the City Council of the City of Pearland, Texas, that this Ordinance shall be codified in the City's Official Code of Ordinances as provided hereinabove.
