Ord. 0521-01 04-12-93ORDINANCE NO. •21-1 AN ORDINANCE AMENDING CHAPTER 7, ARTICLE II-3/4, SECTION 7-31 AND SECTION 7-31.1., SUBSECTIONS (C), (D), (E), (F), (G), (H) AND (I), OF THE CITY CODE OF ORDINANCES, BY ADOPTING THE STANDARD HOUSING CODE, 1991 EDITION, AND MAKING CERTAIN AMENDMENTS, MODIFICATIONS, ADDITIONS AND DELETIONS THERETO; HAVING A SA INGS CLAUSE; HAVING A REPEALER CLAUSE; PROVIDING FOR C DIFICATION, PUBLICATION AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF Section 1. That Section 7-31 of City of Pearland, Texas, shall be and read as follows: "7-31. Adopted; conflicting pr THE CITY OF PEARLAND, TEXAS: the Code of Ordinances of the the same is hereby amended to visions. For the purpose of establis ing minimum standards for occupancy of existing resident al buildings, regardless of when constructed, as a supplement to the building code, within the corporate limits of the city there is hereby adopted and incorporated herein, by reference, as the housing code of the city, that certain housing code known as the Standard Housing Code, 1991 Edition, with revisions, recommended and published by the Southern Standard Buildin Code Congress International, Inc., which code is published in book form and which is referred to, incorporated herei and made a part hereof for all purposes, a true and corre t copy of which is filed of record in the office of the city secretary. Provided, however, that in the event any onflict may arise between any provision of the housing code a opted by this article and any other applicable provisions of state law or city ordinance, rule or regulation, the provisio s of this Code of Ordinances, state law, or city rules and regulations shall be controlling." Section 2. That Section 7-31.1., Subsections (c), (d), (e), (f), (g), (h), and (i) of the Code of Ordinances of the City of Pearland, Texas, shall be and the same is hereby amended to read as follows: "Sec. 7-31.1. Amendments, modifications, additions, deletions. (c) 103.2.2. Chapter 1, Secti n 103, Subsection 103.2.2, of the Standard Housing code, 1991 Edition, with revisions, is hereby expressly amend d to read as follows: 103.2.2. Whenever the hosing official determines that there are reasonable grounds to believe that there has been a violation of any provision of this code or of any rule or regulation adopted pursuant thereto, he shall give notice of such alleg d violation to the person or persons responsible t»erefor and such alleged violation(s) shall be dee ed to constitute a nuisance. Such notice shall be given as provided in the unsafe building abatement code of the city. (d) 103.2.3. Chapter 1, Section 103, Subsection 103.2.3, of the Standard Housing Code, 1991 Edition, with revisions, is hereby expressly amend d to read as follows: 103.2.3 Service of notice shall conform to the requirements set forth in the unsafe building abatement code of the city. (e) 103.2.4. Chapter 1, Section the Standard Housing Code, 1 is hereby expressly amended 103, Subsection 103.2.4, of i91 Edition, with revisions, to read as follows: 103.2.4. When a residential building is to be demolished, it shall be demolished according to the appropriate provisions of te building code and unsafe building abatement code of he city. (f) 103.2.5. There is added tc the Standard Housing Code, 7 a new subsection 103.2.5, w follows: Chapter 1, Section 103, of 991 Edition, with revisions, rich shall hereafter read as 103.2.5. For enforcement and abatement purposes, any violation of any provision 4f the Standard Housing Code, 1991 Edition, with revisions, as adopted by this chapter, shall be construed to be a violation of the building code of the city, and the proced»re to abate such violations shall be as provided in thatcode and as further provided in the unsafe building aba ement code of the city, the provisions of the housing code being in all respects supplemental to the building code. If any section, s bsection, sentence, clause, phrase or portion of this Ordinance i for any reason held invalid, unconstitutional or otherwise unenforceable by a court of competent jurisdiction, such part shall be de med a separate, distinct and independent provision and such ho ding shall not affect the validity of the remaining portions t ereof. Section 4. All Ordinances in conflict herewith are hereby repealed, but only to the extent of such conflict. Section 5. It is the intent of the City Council of the City of Pearland, Texas, that the provisions of this Ordinance shall be codified as herein provided. Section 6. The city Secretary hall cause this Ordinance, or its caption and penalty, to be published in the official newspaper of the City at least once within ten ( second and final reading.
