AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, DECLARING THE PUBLIC NECESSITY FOR THE PLACEMENT
OF A SANITARY SEWER LINE EAST OF OLD ALVIN ROAD IN THE
CITY AND FOR THE ACQUISITION OF PROPERTY FOR SUCH PLACE-
MENT; DESCRIBING NEEDED TRACTS BY METES AND BOUNDS; PRO-
VIDING FOR AN EFFECTIVE DATE AND DECLARING AN EMERGENCY
DUE TO THE URGENT NEED FOR SUCH SEWER LINE TO COMPLY
WITH STATE WASTEWATER TREATMENT GUIDELINES.
WHEREAS, to promote growth and development in the area located
east of Old Alvin Road and north of F. M. 518 within the territorial
limits of the City of Pearland it is necessary to install a sanitary
sewer line to service such area, which would extend from the Twin
Creek Woods Sewer Treatment Plant southeastward to the Barry Rose
Sewer Treatment Plant; and
WHEREAS, such sewer line is urgently needed in order to conform
to the compliance order of the Texas Water Commission as regards the
closing of the Twin Creek Woods Sewer Treatment Plant and routing of
waste to the Barry Rose facility for treatment; and
WHEREAS, the City of Pearland does not possess the necessary
easements and rights -of -way for the placement of such sanitary sewer
line; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That the City Council of the City of Pearland,
Texas, does hereby declare that an urgent public necessity exists for
the placement of a sanitary sewer line to service that area within the
territorial limits of the City located east of Old Alvin Road and
north of F. M. 518, to run from the Twin Creek Woods Sewer Treatment
Plant southeastward to the Barry Rose Sewer Treatment Plant, generally
following the proposed east right-of-way line of the proposed GAP
(Galveston-Alvin-Pearland) Parkway.
Section 2. That since the City of Pearland does not now possess
all of the needed easements and rights -of -way for the placement of
said sewer line in such location, an urgent public necessity exists

25, 1944 and recorded in Volume 382, Page 190 of the Rrazoria
County Deed Records, D.H.M. Hunter Survey, Abstract No. 76,
Rrazoria County, Texas, said 0.3594 acres being more particularly
described as follows:
BEGINING at a 3/4 inch iron rod set in concrete for the South
corner of that certain 10 acre Tract One described in the Exhibit
"A" in City of Pearland vs John Alexander, as Independent
Executor and Trustee of the Estate of C.H. Alexander, et al, as
recorded in Volume 10, Page 481 of the County Court Records,
being the East corner of a 40.00 foot wide easement, Tract Two in
said Exhibit "A";
THENCE North 41°40'16" East along the Southeast line of said
10.00 acre tract, a distance of 15.02 feet to a 5/8 inch iron rod
set for corner;
THENCE South 48°19'44" East a distance of 15.00 feet to a 5/8
inch iron rod set for corner in the South line of said D.H.M.
Hunter Survey, and the North line of the Thomas J. Green Survey,
Abstract 198;
THENCE South 41°40'16" West along the South line of said A.H.M.
Hunter Survey, and the North line of said Thomas J. Green Survey,
a distance of 455.15 feet to a 5/8 inch iron rod set for corner;
THENCE North 48°19'44" West a distance of 175.00 feet to a 5/8
inch iron rod set for point of curve;
THENCE with a curve to the right, having a radius of 1765.44
feet, an arc length of 722.82 feet, a central angle of 23°27'31"
and a chord bearing of North 36°35'58" West, a distance of 717.79
