Ord. 0545 11-16-87ORDINANCE NO. 545 AN ORDINANCE OF THE CITY COUNCIL OF'THE CITY OF PEARLAND, TEXAS, DECLARING THE PUBLIC NECESSITY FOR ACQUISITION OF A TEMPORARY WORKING EASEMENT IN CONNECTION WITH DRAINAGE IMPROVEMENTS ALONG F. M. 518 IN THE CITY; DECLARING AN EMERGENCY DUE TO THE IMPENDING DATES OF BID LETTING AND CONSTRUCTION; AND HAVING OTHER PROVISIONS RELATING TO THE SUBJECT. WHEREAS, the State of Texas and City of Pearland have obtained a Writ of Possession for right-of-way along F. M. 518 in and upon a tract of real property owned by B. M. Jajnison et ux Frances Jamison, along F. M. 518 between Country Club Drive and Regal Oaks Road in said City, such Writ of Possession granted pursuant to pleadings in Cause No. 87R1889 in the District Court of Brazoria County, Texas; and, WHEREAS, the City of Pearland owns an easement upon which it intends to construct drainage improvements to coordinate with the widening and improvement of F. M. 518 in that area, such easement being located immediately west of and adjacent to said Jamison property; and WHEREAS, the public convenience, and necessity require the obtaining of a 20' wide temporary working', easement immediately east of said easement, and in and upon the Jamison property, to facilitate such drainage work; NOW, THEREFORE, BE IT ORDAINED BY .THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That the City Council of the City of Pearland, Texas, does hereby declare that an urgent public necessity exists for the acquisition of a working easement of 90 days' duration as above - said, same being located on the westernmost 20' of the said Jamison property and immediately adjacent to and to the east of the said drainage easement heretofore acquired by the City. Section 2. That the City Staff is hereby authorized to take any and all steps, including the filing of eminent domain and other legal causes of action necessary, to obtain rights of possession and user in and upon said tract, for the use and benefit of the City of Pearland, 1 as stated above. Section 3. That an emergency exists requiring that the rule requiring reading on two separate occasions at regular meetings of the City Council be suspended, and that this', Ordinance shall take effect immediately from and after its passage on emergency ordinance, due to the fact t first and only reading as an hat the State of Texas has scheduled the F.
