Ord. 0558 10-10-88ORDINANCE NO. 558 AN ORDINANCE AUTHORIZING THE EXECUTION OF A CONTRACT, A FACSIMILE OF SAME BEING ANNEXED HERETO, INCORPORATED HEREIN FOR ALL PUR- POSES DESIGNATED EXHIBIT "A" BY AND BETWEEN ROBERT E. TALTON AND THE CITY OF PEARLAND, TEXAS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND: SECTION 1. That the facsimile of contract, annexed hereto, incorporated herein for all purposes, designated Exhibit "A", by and between ROBERT E. TALTON, City Attorney and the City of Pearland, Texas, for the purpose of providing legal services to the CITY OF PEARLAND, TEXAS is hereby authorized and approved. SECTION 2. The City Council finds that such contract is reasonable and necessary and that there are sufficient city funds for the availability of payment. SECTION 3. The Mayor and the City Secretary of the City of Pearland, Texas, are hereby authorized and directed to execute for and on behalf of the City the annexed contract documents, and counterparts thereof. TALTON City Attorney P1:15 THE STATE OF TEXAS COUNTY OF HARRIS AGREEMENT KNOW ALL MEN BY THESE PRESENTS: That this agreement is entered into this the o2 r day of Seitembe, 1988, by and between the CITY OF PEARLAND, TEXAS, hereinafter called City, and ROBERT E. TALTON, Attorney at Law, 308 South Shaver, Pasadena, Texas, hereinafter called Attorney. WHEREAS, Attorney has been duly appointed to represent City in all of its legal affairs; and WHEREAS, the Charter of said City provides that the duly appointed City Attorney shall be the legal advisor of, and attorney for, all of the offices and departments of the City, and shall represent the City in all litigation and legal proceedings; and WHEREAS, the parties desire that said Attorney shall repre- sent the City as provided for by the Charter; and WHEREAS, the parties desire to enter into this agreement specifying certain details of representation by the Attorney and compensation therefor; it is therefore agreed as follows: I. That the compensation of the said ROBERT E. TALTON as City Attorney shall be at a rate of $50.00 per hour which shall cover attendance at the official City Council meetings, the preparation of all ordinances, legal opinions, approval of contracts, and all general representation of the City. II. All services performed by the said Attorney as litigation, and all eminent domain proceedings shall be paid for at the rate of $100.00 per hour and shall be paid upon statements rendered by the said Attorney at the end of each calendar month. III. Either party may cancel or nullify this agreement by giving the other party a thirty (30) day written notice by certified mail, return receipt requested. Attorney understands and agrees that he will be responsible, in case of his absence, to substi- tute another license, capable attorney to perform the services for the City of Pearland. IV.
