Ord. 0570 07-24-89ORDINANCE NO. 570 AN ORDINANCE AMENDING CHAPTER 2. "ADMINISTRATION", ARTICLE I. "IN GENERAL" BY CREATING SECTION 2-5, "ADMINISTRATION AND ENFORCEMENT" OF THE CODE OF ORDINANCES OF THE CITY OF PEARLAND, TEXAS, PROVIDING FOR A REPEALING CLAUSE, SAVINGS CLAUSE, AND A SEVERABILITY CLAUSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: SECTION 1. That Chapter 2. "Administration", Article I. In General" of the Code of Ordinances of the City of Pearland, Texas is amended by creating Section 2-5 named "Administration and Enforcement" and as created shall hereinafter read as follows: Sec. 2-5. Administration and Enforcement A. The City Code Enforcement Division is hereby authorized to enforce the provisions of the following chapters: Chapter 3, (Advertising); Chapter 4, (Alcoholic Beverage); Chapter 7, (Building (Building Code, Swimming Pool Code, Standard Housing Code, Unsafe Building Abatement Code, Mechanical Code)); Chapter 9, (Electricity); Chapter 11, (Food and Food Handlers); Chapter 12, (Garbage and Trash); Chapter 13, (Health and Sanitation); Chapter 16, (Massage Establishments); Chapter 17, (Mobile Homes); Chapter 22, (Peddlers); Chapter 22i, (Planning); Chapter 23, (Plumbing and Gas); Chapter 26, (Streets and Sidewalks); Chapter 27, (Subdivisions); Chapter 30, (Utilities); including Ordinance No. 509 and all amendments and such other and further ordinances as may be assigned by the City Manager for time to time. B. The City Fire Marshal's office is hereby authorized to enforce the following chapter: Chapter 10, (Fire Prevention and Protection). C. Such departments are hereby authorized to issue cita- tions, give notice, make inspections and file charges arising out of violations of the City of Pearland ordinances assigned to them by the City Manager. SECTION 2. All rights and remedies which have accrued in the favor of the City under this Chapter and amendments thereto shall be and are preserved for the benefit of the City. SECTION 3. All ordinances or parts of ordinances, if any, in conflict herewith shall be, and the same are hereby expressly repealed to the extent of such conflict only. SECTION 4. The City Council of the City of Pearland, Texas, does hereby declare that if any section, subsection, paragraph, sentence, clause, phrase, word or portion of this Ordinance is declared invalid, or unconstitutional, by a court of competent jurisdiction that, in such event it would have passed and or- dained any and all remaining portions of this Ordinance without the inclusion of that portion or portions which may be so found to be unconstitutional or invalid, and declares that its intent is to make no portion of this Ordinance dependent upon the validity of any other portion thereof, and that all said remain- ing portions shall continue in full force and effect.
