Ord. 0593 05-29-90• 'r ORDINANCE NO. 593 AN ORDINANCE AUTHORIZING THE EXECUTION OF A CONTRACT, A FACSIMILE OF SAME BEING ANNEXED HERETO, INCORPORATED HEREIN FOR ALL PURPOSES DESIGNATED EXHIBIT "A" BY AND BETWEEN THE CITY OF PEARLAND AND DOUGLAS LEIFESTE AND BILL HENSCH FOR THE PURPOSE OF TRAFFIC ENGINEERING SERVICES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND: SECTION 1. That the facsimile of contract, annexed hereto, incorporated herein for all purposes, designated Exhibit "A", by and between DOUGLAS LEIFESTE and BILL HENSCH, and the CITY OF PEARLAND, TEXAS, for the purpose of providing traffic engineering services to the City of Pearland, Texas is hereby authorized and approved. SECTION 2. The City Council finds that such contract is reasonable and necessary and that there are sufficient city funds for the availability of payment. SECTION 3. The Mayor and the City Secretary of the City of Pearland, Texas, are hereby authorized and directed to execute for and on behalf of the city the annexed contract documents, and counterparts thereof. ATTEST: City Secretary City Attorney 7 EXHIBIT "A" THE STATE OF TEXAS 1 I COUNTY OF BRAZORIA I KNOW ALL MEN BY THESE PRESENTS: CONTRACT FOR PROFESSIONAL SERVICES On this the � day of May, 1990, the CITY OF PEARLAND (hereinafter called "City") and DOUGL.AS LEIFESTE and BILL HENSCH (hereinafter called "Contractor") enter into the following contract as approved by the City of Pearland. Purpose The parties enter into this agreement to permit the City to obtain the professional services of the Contractor to assist in determining traffic control needs and expert testimony when needed. to ensure the City complies with local, county, state and federal guidelines, and ensure safe traffic in the City. Term The parties agree that the provisions of this contract shall be effective from the date of execution through , 1990. Services To Be Rendered The City and the Contractor agree that Contractor shall provide preliminary traffic study, analysis and reporting, expert testimony in a court of law. The City and the Contractor agree that the City will use their counter and collect the data for review and analysis by the Contractor and/or pay the Contractor for these services as indicated in the Compensation section of this contract. Compensation The City agrees to compensate the Contractor as follows: Preliminary Study $30. 00 F'er Hour Two (2) Hours Minimum Analysis $50.00 Per Hour One (1) Hour Minimum Reporting $30.00 Per Hour Two (2) Hours Minimum Expert Testimony- - - - - - - - $50.00 Per Hour Data Collection by City - - - - $170.00 Per Location Data Collection by Contractor - Cost not to exceed $300.00 Time Limitation Contractor agrees to complete each assign for the City within ten (10) working days of such notice unless prior to the acceptance of such assign the Contractor and the City have in writing agreed to a different period of time.
