A RESOLUTION ORDERING A GENERAL ELECTION TO BE HELD ON
SATURDAY, MAY 12,2007, FOR THE PURPOSE OF ELECTING COUNCIL
MEMBERS TO POSITIONS 1 AND 5 OF THE CITY OF PEARLAND CITY
COUNCIL AND ORDERING A SPECIAL ELECTION TO BE HELD ON
SATURDAY, MAY 12, 2007, FOR THE PURPOSE OF SUBMITTING TO
THE QUALIFIED ELECTORS OF THE CITY OF PEARLAND, TEXAS,
PROPOSITIONS FOR THE ISSUANCE OF PUBLIC IMPROVEMENT
BONDS FOR VARIOUS PURPOSES; AND MAKING OTHER PROVISIONS
RELATED TO THE SUBJECT

WHEREAS, the City Council (the "City Council") of the City of Pearland, Texas (the
"City") is authorized and has determined to call a general election to be held on May 12, 2007
for the purpose of electing members to Position 1 and Position 5 of the City Council;
WHEREAS, the City Council of the City is authorized and has determined to call a
special election for the purpose of submitting six propositions to voters in the City to authorize
the issuance of City bonds payable from ad valorem taxes for the purposes hereinafter set forth;
and
WHEREAS, the City Council wishes to proceed with the ordering of such general
election and special election and the City Council has determined that holding such elections is
in the public interest;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PEARLAND CITY, TEXAS:
Section 1. Call of Elections~ Date~ Elhdble Electors and Hours. (a) It is hereby
ordered that a general election (the "General Election") be held in and throughout the City on
Saturday, May 12,2007, between the hours of 7:00 o'clock a.m. and 7:00 o'clock p.m. at which
General Election all resident, qualified electors of the City shall be entitled to vote for City
Council Position 1 and City Council Position 5. It is further ordered that a special election (the
"Special Election") be held in and throughout the City on Saturday, May 12, 2007, between the
hours of 7:00 o'clock a.m. and 7:00 o'clock p.m. at which Special Election the propositions set
forth on Exhibit A hereto for the issuance of bonds for permanent public improvements for the
City and the levy of taxes for payment thereof, shall be submitted to all resident, qualified
electors of the City.
(b) The General Election and the Special Election (collectively, the "Elections") shall
be held under the provisions of the Charter of the City, the Constitution and laws of the State of
Texas and of this Resolution. All qualified voters residing in the City shall be allowed to vote at
the Elections; and each voter shall vote in the election precinct in which such voter resides.
Section 2. Election Precincts~ Pollin2 Places~ Election Officers. (a) The election
precincts for the Elections shall be the county election precincts and such precincts, the polling

places and the precinct judges are hereby established and shall be as described in Exhibit B
hereto.
(b) The election officials for each City precinct in shall be designated by the County
Clerk of Brazoria County, Texas (the "Elections Administrator"); and such officials shall
conduct the City's Elections in accordance with a Joint Election Agreement and Contract for
Election Services (the "Election Contract") between Brazoria County, Texas and the City. The
Elections Administrator is hereby authorized and instructed to provide and furnish all necessary
election supplies for all City precincts. The official mailing address and physical of the Elections
Administrator is Joyce Hudman, County Clerk, 111 East Locust, Suite 200, Angleton, Texas
77515-4654.
(c) In the event the Mayor shall find that one or more of the polling places listed on
Exhibit B have become unavailable or unsuitable for use at the Elections or if any person or
persons appointed herein do not appear or are unable to perform their duties, he is hereby
authorized to designate substitute polling places and appoint substitute personnel, giving such
notice as he deems appropriate.
Section 3. Candidates in General Election. Persons desiring to become candidates
for Position 1 or Position 5 in the General Election shall, not later than the March 12, 2007 at
5:00 p.m. file their written applications for candidacy for office with the City Secretary, Pearland
City Hall, 3519 Liberty Drive, Pearland, Texas 77581, pursuant to the provisions of Chapter 143,
Texas Election Code, as amended. Each candidate must specify in each instance the City
Council Position for which the applicant is filing and no candidate may file for more than one
City Council position to be filled at the General Election. Candidates must be a resident of the
City and must be a qualified voter and otherwise qualified to hold the position of a member of
the City Council under Texas law.
Section 4. Ballots and Propositions. The City Secretary and the Election
Administrator are hereby authorized and directed to prepare the ballots for the General Election
and for the Special Election in accordance with the provisions of the Texas Election Code. The
ballots to be used in General Election shall have printed thereon the names of the candidates for
City Council Position 1 and City Council Position 5. The ballots to be used in the Special
Election shall have printed thereon the propositions corresponding to each of the propositions set
forth on Exhibit A to this Resolution. The specific ballot language for each proposition shall be
as described on Exhibit C hereto (the number of each of such propositions corresponding to the
number of the propositions for the issuance of bonds for permanent public improvements listed
on Exhibit A to this Resolution) with provision to vote "FOR" or "AGAINST" each proposition.
Section 5. Voting. V oting in the Elections, including early voting by personal
appearance shall be by an electronic voting system adopted by the City and the Commissioners
Court of Brazoria County, Texas for use in elections held by the City and Brazoria County. Each
voter in the General Election shall mark the ballot indicating such voter's choice of candidate for
City Council Position 1 and City Council Position 5. Each voter in the Special Election desiring
to vote in favor of a proposition shall mark the ballot indicating "FOR" the proposition, and each
voter desiring to vote against a proposition shall mark the ballot indicating "AGAINST" the
proposition. Voting shall be conducted in accordance with the Texas Election Code.

Section 6. Early Voting. Early voting by personal appearance shall be conducted at
the dates, times and polling places listed in Exhibit D to this Resolution.
The City Council hereby establishes Brazoria County Courthouse West Annex, 451 N.
Velasco, Room 144, Angleton, Texas 77515 as the main early voting polling place at which early
voting by personal appearance shall be conducted.
The Council hereby appoints the Elections Administrator as the early voting clerk. The
Elections Administrator shall receive applications for a ballot to be voted by mail. The mailing
address to which ballot applications and ballots voted by mail may be sent is as follows: Joyce
Hudman, County Clerk, 111 East Locust, Suite 200, Angleton, Texas 77515-4654. Applications
for ballots by mail may be received no earlier than March 13, 2007 and no later than 5:00 p.m.
on May 4,2007.
The Council hereby appoints the Elections Administrator as the presiding judge of the
special early voting ballot board to count and return early voting ballots in accordance with the
Election Code. The presiding judge shall appoint election clerks as needed, and such judge and
clerks shall constitute the special early voting ballot board and shall perform the duties set forth
for such board in the Texas Election Code.
Section 7. Notice of Elections. Notice of the Elections, in English and Spanish,
stating in substance the contents of this Resolution, shall be: (i) published one time in a
newspaper of general circulation within the City's territory not earlier than the thirtieth day or
later than the 10th day before the Elections; (ii) posted on the bulletin board used by the Council
to post notices of the Council's meetings no later than the twenty-first (21 st) day before the date
of the Elections; and (iii ) posted, not later than the twenty-first (21 st) day before the date of the
Elections, in three (3) public places within the City and at City Hall.
Section 8. Declaring Results. City Council shall canvass the returns and declare the
results of the Elections.
At the General Election, the candidate for each office who has received a majority of all
votes cast for each particular office shall be declared elected. A runoff election shall be ordered
by the Mayor of the City in the event any candidate fails to receive a majority of all votes cast for
each particular office. The date for the runoff election shall be ordered and held in a timely
manner as prescribed by the general election laws of the State of Texas and the Charter of the
City. The two candidates who receive the largest number of votes cast for each particular office
requiring a runoff election shall again be voted for. The candidate receiving the largest number
of votes in the runoff election shall be declared elected. The City Secretary shall give notice of
such runoff election by causing said notice to be published in accordance with Texas Election
Laws.
In the event that the propositions considered by the voters in the Special Election, or any
of them, are authorized at the Special Election, all matters relating to the issuance of such bonds
or the authorization to proceed with a land exchange within the terms of the respective
propositions shall be determined by City Council. With respect to the propositions related to any
bonds authorized at the Special Election, such bonds may be issued at one time, or in

installments from time to time as City Council may determine, and bonds for different purposes
may be issued separately, or combined in single multi-purpose issues, or issued in any other
lawful manner, in the discretion of the City Council.
Section 9. Notice of Meeting. It is further found and determined that a sufficient
written notice of the date, hour, place and subject of this meeting of the City Council was posted
at a place convenient to the public at the City Hall of the City for the time required by law
preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required by law at all times during
which this Resolution and the subject matter thereof has been discussed, considered and formally
acted upon. The City Council further ratifies, approves and confirms such written notice and the
contents and posting thereof.
Section 10. Authority of the Mayor. The Mayor shall have the authority to take, or
cause to be taken, all actions reasonable and necessary to insure that the Elections are fairly held
and returns properly counted and tabulated for the canvass of the Elections returns by the City
Council in accordance with state law.
Section 11. Effective Date. This Resolution is effective immediately upon its passage
and approval.

PROPOSITIONS
PROPOSITION NO.1
Shall the City Council of the City of Pearland, Texas be authorized to issue bonds of the
City in the amount of $84,190,000 maturing serially or otherwise at such times as may be fixed
by the City Council not to exceed 30 years from their date or dates and bearing interest at any
rate or rates, either fixed, variable or floating, according to any clearly stated formula, calculation
or method not exceeding the maximum interest now or hereafter authorized by law as shall be
determined within the discretion of the City Council at the time of issuance, and to levy a tax
upon all taxable property in the City sufficient to pay the interest on the bonds, and to provide a
sinking fund for the payment of bonds as they mature, for the purpose of making permanent
public improvements as follows: (1) purchasing and otherwise acquiring land for and
constructing, repairing and improving streets, bridges and sidewalks of the City with first priority
to be given to the construction, repair and improvement of Bailey Road, Cullen Boulevard, Dixie
Farm Road and McHard Road, (2) purchase of equipment and support facilities in connection
with street, bridge and sidewalk improvements, (3) engineering and related studies in connection
with street, bridge and sidewalk improvements in the City, and (4) all matters necessary or
incidental thereto?
PROPOSITION NO.2
Shall the City Council of the City of Pearland, Texas be authorized to issue bonds of the
City in the amount of $35,305,000 maturing serially or otherwise at such times as may be fixed
by the City Council not to exceed 30 years from their date or dates and bearing interest at any
rate or rates, either fixed, variable or floating, according to any clearly stated formula, calculation
or method not exceeding the maximum interest now or hereafter authorized by law as shall be
determined within the discretion of the City Council at the time of issuance, and to levy a tax
upon all taxable property in the City sufficient to pay the interest on the bonds, and to provide a
sinking fund for the payment of bonds as they mature, for the purpose of making permanent
public improvements as follows: (1) purchasing, acquiring, enlarging, extending, equipping and
constructing drainage improvements and facilities at various locations within the City, including
acquiring lands and rights-of-way for any of such purposes, (2) purchase of equipment and
support facilities in connection with drainage improvements and facilities, (3) engineering and
related studies in connection with drainage problems in the City and (4) all matters necessary or
incident thereto?
PROPOSITION NO.3
Shall the City Council of the City of Pearland, Texas be authorized to issue bonds of the
City in the amount of $2,895,000 maturing serially or otherwise at such times as may be fixed by
the City Council not to exceed 30 years from their date or dates and bearing interest at any rate
or rates, either fixed, variable or floating, according to any clearly stated formula, calculation or
method not exceeding the maximum interest now or hereafter authorized by law as shall be
determined within the discretion of the City Council at the time of issuance, and to levy a tax

upon all taxable property in the City sufficient to pay the interest on the bonds, and to provide a
sinking fund for the payment of bonds as they mature, for the purpose of making permanent
public improvements as follows: (1) purchasing, acquiring, constructing, repairing and
improving land, facilities and equipment for public safety purposes (including fire fighting
needs), (2) engineering and related studies in connection with public safety improvements in the
City and (3) all matters necessary or incidental thereto?
PROPOSITION NO.4
Shall the City Council of the City of Pearland, Texas be authorized to issue bonds of the
City in the amount of $19,990,000 maturing serially or otherwise at such times as may be fixed
by the City Council not to exceed 30 years from their date or dates and bearing interest at any
rate or rates, either fixed, variable or floating, according to any clearly stated formula, calculation
or method not exceeding the maximum interest now or hereafter authorized by law as shall be
determined within the discretion of the City Council at the time of issuance, and to levy a tax
upon all taxable property in the City sufficient to pay the interest on the bonds, and to provide a
sinking fund for the payment of bonds as they mature, for the purpose of making permanent
public improvements as follows: (1) purchasing, acquiring, constructing, repairing and
improving land, facilities and equipment for park and recreation purposes, (2) engineering and
related studies in connection with park and recreation improvements in the City and (3) all
matters necessary or incidental thereto?
PROPOSITION NO.5
Shall the City Council of the City of Pearland, Texas be authorized to issue bonds of the
City in the amount of $16,225,000 maturing serially or otherwise at such times as may be fixed
by the City Council not to exceed 30 years from their date or dates and bearing interest at any
rate or rates, either fixed, variable or floating, according to any clearly stated formula, calculation
or method not exceeding the maximum interest now or hereafter authorized by law as shall be
detennined within the discretion of the City Council at the time of issuance, and to levy a tax
upon all taxable property in the City sufficient to pay the interest on the bonds, and to provide a
sinking fund for the payment of bonds as they mature, for the purpose of making permanent
public improvements as follows: (1) purchasing, acquiring, constructing, repairing and
improving land, facilities and equipment for park and recreation purposes, with first priority to

C. Al vendedor de condado del condado de Brazoria senalaran a los funcionarios de
la eleccion para cada recinto de la ciudad adentro, Tejas (el "administrador de las elecciones"); y
tales funcionarios conduciran las elecciones de la ciudad de acuerdo con un acuerdo y un
contrato comunes de la eleccion para los servicios de la eleccion (el "contrato de la eleccion")
entre el condado de Brazoria, Tejas y la ciudad. Autorizan y se mandan al administrador de las
elecciones por este medio proporcionar y a equipar todas las fuentes necesarias de la eleccion

sera conducida.
El consejo designa por este medio a administrador de las elecciones como el vendedor de
votacion temprano. El administrador de las elecciones recibira los usos para que una balota sea

fijar los avisos de las sesiones del Consejo no mas adelante que el vigesimo primer (21ro) dia
antes de la fecha de las elecciones; y (iii) fijado, no mas no adelante que el vigesimo primer
(21ro) dia antes de la fecha de las elecciones, en tres (3) lugares publicos dentro de la ciudad y en
la ciudad pasillo.
Declarar resultados. El consejo de ciudad solicitara votos de las vueltas y declarara los
resultados de las elecciones.
En la eleccion general, el candidato a cada oficina que ha recibido una mayoria de todos
los votos que el molde para cada oficina particular sera declarado eligio. Una eleccion de la
salida sera pedida por el alcalde de la ciudad en el acontecimiento que cualquier candidato no

el numero mas grande de votos en la eleccion de la salida eligio. La secretaria de la ciudad dara
el aviso de tal eleccion de la salida causando el aviso dicho de ser publicado de acuerdo con
leyes de la eleccion de Tejas.
En caso que los asuntos considerados por los votantes en la eleccion especial, o
cualesquiera de ellos, se autoricen en la eleccion especial, todas las materias referentes a la

COUNCIL AND ORDERING A SPECIAL ELECTION TO BE HELD ON
SATURDAY, MAY 12, 2007, FOR THE PURPOSE OF SUBMITTING TO
THE QUALIFIED ELECTORS OF THE CITY OF PEARLAND, TEXAS,
PROPOSITIONS FOR THE ISSUANCE OF PUBLIC IMPROVEMENT
BONDS FOR VARIOUS PURPOSES; AND MAKING OTHER PROVISIONS
RELATED TO THE SUBJECT

WHEREAS, the City Council (the "City Council") of the City of Pearland, Texas (the
"City") is authorized and has determined to call a general election to be held on May 12, 2007
for the purpose of electing members to Position 1 and Position 5 of the City Council;
WHEREAS, the City Council of the City is authorized and has determined to call a
special election for the purpose of submitting six propositions to voters in the City to authorize
the issuance of City bonds payable from ad valorem taxes for the purposes hereinafter set forth;
and
WHEREAS, the City Council wishes to proceed with the ordering of such general
election and special election and the City Council has determined that holding such elections is
in the public interest;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PEARLAND CITY,TEXAS:
Section 1. Call of Elections; Date: Eligible Electors and Hours. (a) It is hereby
ordered that a general election (the "General Election") be held in and throughout the City on
Saturday, May 12, 2007, between the hours of 7:00 o'clock a.m. and 7:00 o'clock p.m. at which
General Election all resident, qualified electors of the City shall be entitled to vote for City
Council Position 1 and City Council Position 5. It is further ordered that a special election (the
"Special Election") be held in and throughout the City on Saturday, May 12, 2007, between the
hours of 7:00 o'clock a.m. and 7:00 o'clock p.m. at which Special Election the propositions set
forth on Exhibit A hereto for the issuance of bonds for permanent public improvements for the
City and the levy of taxes for payment thereof, shall be submitted to all resident, qualified
electors of the City.
(b) The General Election and the Special Election (collectively,the "Elections") shall
be held under the provisions of the Charter of the City, the Constitution and laws of the State of
Texas and of this Resolution. All qualified voters residing in the City shall be allowed to vote at
the Elections; and each voter shall vote in the election precinct in which such voter resides.
Section 2. Election Precincts; Polling Places; Election Officers. (a) The election
precincts for the Elections shall be the county election precincts and such precincts, the polling

places and the precinct judges are hereby established and shall be as described in Exhibit B
hereto.
(b) The election officials for each City precinct in shall be designated by the County
Clerk of Brazoria County, Texas (the "Elections Administrator"); and such officials shall
conduct the City's Elections in accordance with a Joint Election Agreement and Contract for
Election Services (the "Election Contract") between Brazoria County, Texas and the City. The
Elections Administrator is hereby authorized and instructed to provide and furnish all necessary
election supplies for all City precincts. The official mailing address and physical of the Elections
Administrator is Joyce Hudman, County Clerk, 111 East Locust, Suite 200, Angleton, Texas
77515-4654.
(c) In the event the Mayor shall find that one or more of the polling places listed on
Exhibit B have become unavailable or unsuitable for use at the Elections or if any person or
persons appointed herein do not appear or are unable to perform their duties, he is hereby
authorized to designate substitute polling places and appoint substitute personnel, giving such
notice as he deems appropriate.
Section 3. Candidates in General Election. Persons desiring to become candidates
for Position 1 or Position 5 in the General Election shall, not later than the March 12, 2007 at
5:00 p.m. file their written applications for candidacy for office with the City Secretary, Pearland
City Hall, 3519 Liberty Drive, Pearland, Texas 77581,pursuant to the provisions of Chapter 143,
Texas Election Code, as amended. Each candidate must specify in each instance the City
Council Position for which the applicant is filing and no candidate may file for more than one
City Council position to be filled at the General Election. Candidates must be a resident of the
City and must be a qualified voter and otherwise qualified to hold the position of a member of
the City Council under Texas law.
Section 4. Ballots and Propositions. The City Secretary and the Election
Administrator are hereby authorized and directed to prepare the ballots for the General Election
and for the Special Election in accordance with the provisions of the Texas Election Code. The
ballots to be used in General Election shall have printed thereon the names of the candidates for
City Council Position 1 and City Council Position 5. The ballots to be used in the Special
Election shall have printed thereon the propositions corresponding to each of the propositions set
forth on Exhibit A to this Resolution. The specific ballot language for each proposition shall be
as described on Exhibit C hereto (the number of each of such propositions corresponding to the
number of the propositions for the issuance of bonds for permanent public improvements listed
on Exhibit A to this Resolution) with provision to vote "FOR"or"AGAINST" each proposition.
Section 5. Voting. Voting in the Elections, including early voting by personal
appearance shall be by an electronic voting system adopted by the City and the Commissioners
Court of Brazoria County,Texas for use in elections held by the City and Brazoria County. Each
voter in the General Election shall mark the ballot indicating such voter's choice of candidate for
City Council Position 1 and City Council Position 5. Each voter in the Special Election desiring
to vote in favor of a proposition shall mark the ballot indicating"FOR"the proposition, and each
voter desiring to vote against a proposition shall mark the ballot indicating "AGAINST" the
proposition. Voting shall be conducted in accordance with the Texas Election Code.

Section 6. Early Voting. Early voting by personal appearance shall be conducted at
the dates,times and polling places listed in Exhibit D to this Resolution.
The City Council hereby establishes Brazoria County Courthouse West Annex, 451 N.
Velasco,Room 144,Angleton, Texas 77515 as the main early voting polling place at which early
voting by personal appearance shall be conducted.
The Council hereby appoints the Elections Administrator as the early voting clerk. The
Elections Administrator shall receive applications for a ballot to be voted by mail. The mailing
address to which ballot applications and ballots voted by mail may be sent is as follows: Joyce
Hudman, County Clerk, 111 East Locust, Suite 200, Angleton, Texas 77515-4654. Applications
for ballots by mail may be received no earlier than March 13, 2007 and no later than 5:00 p.m.
on May 4,2007.
The Council hereby appoints the Elections Administrator as the presiding judge of the
special early voting ballot board to count and return early voting ballots in accordance with the
Election Code. The presiding judge shall appoint election clerks as needed, and such judge and
clerks shall constitute the special early voting ballot board and shall perform the duties set forth
for such board in the Texas Election Code.
Section 7. Notice of Elections. Notice of the Elections, in English and Spanish,
stating in substance the contents of this Resolution, shall be: (i) published one time in a
newspaper of general circulation within the City's territory not earlier than the thirtieth day or
later than the 10th day before the Elections; (ii)posted on the bulletin board used by the Council
to post notices of the Council's meetings no later than the twenty-first (21st) day before the date
of the Elections; and (iii ) posted, not later than the twenty-first (21st) day before the date of the
Elections,in three(3)public places within the City and at City Hall.
Section 8. Declaring Results. City Council shall canvass the returns and declare the
results of the Elections.
At the General Election, the candidate for each office who has received a majority of all
votes cast for each particular office shall be declared elected. A runoff election shall be ordered
by the Mayor of the City in the event any candidate fails to receive a majority of all votes cast for
each particular office. The date for the runoff election shall be ordered and held in a timely
manner as prescribed by the general election laws of the State of Texas and the Charter of the
City. The two candidates who receive the largest number of votes cast for each particular office
requiring a runoff election shall again be voted for. The candidate receiving the largest number
of votes in the runoff election shall be declared elected. The City Secretary shall give notice of
such runoff election by causing said notice to be published in accordance with Texas Election
Laws.
In the event that the propositions considered by the voters in the Special Election, or any
of them, are authorized at the Special Election, all matters relating to the issuance of such bonds
or the authorization to proceed with a land exchange within the terms of the respective
propositions shall be determined by City Council. With respect to the propositions related to any
bonds authorized at the Special Election, such bonds may be issued at one time, or in

installments from time to time as City Council may determine, and bonds for different purposes
may be issued separately, or combined in single multi-purpose issues, or issued in any other
lawful manner, in the discretion of the City Council.
Section 9. Notice of Meeting. It is further found and determined that a sufficient
written notice of the date, hour, place and subject of this meeting of the City Council was posted
at a place convenient to the public at the City Hall of the City for the time required by law
preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required by law at all times during
which this Resolution and the subject matter thereof has been discussed, considered and formally
acted upon. The City Council further ratifies, approves and confirms such written notice and the
contents and posting thereof.
Section 10. Authority of the Mayor. The Mayor shall have the authority to take, or
cause to be taken, all actions reasonable and necessary to insure that the Elections are fairly held
and returns properly counted and tabulated for the canvass of the Elections returns by the City
Council in accordance with state law.
Section 11. Effective Date. This Resolution is effective immediately upon its passage
and approval.

Shall the City Council of the City of Pearland, Texas be authorized to issue bonds of the
City in the amount of$84,190,000 maturing serially or otherwise at such times as may be fixed
by the City Council not to exceed 30 years from their date or dates and bearing interest at any
rate or rates, either fixed, variable or floating, according to any clearly stated formula, calculation

• or method not exceeding the maximum interest now or hereafter authorized by law as shall be
determined within the discretion of the City Council at the time of issuance, and to levy a tax
upon all taxable property in the City sufficient to pay the interest on the bonds, and to provide a
sinking fund for the payment of bonds as they mature, for the purpose of making permanent
public improvements as follows: (1)purchasing, acquiring, enlarging, extending, equipping and
constructing drainage improvements and facilities at various locations within the City, including
acquiring lands and rights-of-way for any of such purposes, (2)purchase of equipment and
support facilities in connection with drainage improvements and facilities, (3) engineering and
related studies in connection with drainage problems in the City and (4) all matters necessary or
incident thereto?
PROPOSITION NO. 3
Shall the City Council of the City of Pearland, Texas be authorized to issue bonds of the
City in the amount of$2,895,000 maturing serially or otherwise at such times as may be fixed by
the City Council not to exceed 30 years from their date or dates and bearing interest at any rate
or rates, either fixed, variable or floating, according to any clearly stated formula, calculation or
method not exceeding the maximum interest now or hereafter authorized by law as shall be
determined within the discretion of the City Council at the time of issuance, and to levy a tax

WHEREAS, the City Council (the `City Council") of the City of Pearlan 1, Texas (the
"City") is authorized and has determined to call a general election to he held on Hay 12, 2007
for the purpose of electing members to Position 1 and Position 5 of the City Council;
WHEREAS, the City Council of the City is authorized and has determined to call a
special election for the purpose of submitting six propositions to voters in the City to authorize
the issuance of City bonds payable from ad valorem taxes for the purposes hcrcinatter set forth;
and
WHEREAS, the City Council wishes to proceed with the ordering of such general
election and spatial election and the City Council has determined that holding such elections is
in the public intettsl:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PEARLAND CITY, TEXAS;
Section .1. Call of Elections, Date: Eligible Electors and Hours. (a) It is hereby
ordered that a general election (the "General Elections') be held in anti throughout the City an
Saturday, May (2, 2007, between the hours of 7:00 o'clock air. and 7:00 o'clock p.m. at which
General Election all readcnt, qualified electors of the City shall be entitled to vote for City
Council Position I and City Council Position 5, It is further ordered that a spacial election (the
"Special Election' ) be held in and throughout the City on Saturday, May 12, 2007. between the
hours of 7:00 o'clock a.ttt. and 7:00 o'clock pin. at which Special Election the propositions set
forth an Exhibit A hereto for the issuance of bonds for permanent public improvements for the
City and the levy of taxes for payment thereof, shell be submitted to all. resident, qualified
electors of the City,
(b) The General Election and the Special Election (e.ollectiv°ely, the "Elections") shall
be held under the provisions of the Charter of the City, the Constitution and laws of the State of
Texas and of this Resolution. All qualified voters residing in the City shall be allowed to vote at
thc Election; and each votes shall vote in the election precinct in which such voter resides,

precincts for the Elections shall be the county election precincts and such precincts, the polling
places and the precinct. judges are hereby established and shall be as described in Eltit3bit B

(b) Thti election officials for each City precinct in shall be designated by the County
Clerk of Brazoria County, Texas (the '`Elections Administrator"); and such officials shall
conduct the City's Elections in accordance with a Joint Election Agitiement and Contract for
Election Services (the "Election Contract") between Maria County, Texas and the City. The
Elections Administrator is hereby authorized and instructed to provide and furnish all necessary
election supplies for all City precincts, The official mailing address and physical of the Elections
Administrator is Joyce Hudman, County Clerk, 111 East Locust, Suite W40, Angleton. Texas
77515.4654.
(c) in thc event the Mayor shall find that one or more of the polling places listed on
Exhibit B have become unavailable or unsuitable for use at the Elections or if any person or
persons appointed Mein do not appear or are unable to perform their duties, he is hereby
authorized to designate substitute polling places and appoint substitute personnel, giving such
notice as .hw deems appropriate.
Section 3. Candidates in Genwal Electiop, Persons desiring to become candidates
for Position 1 or Position 5 in the General Election shall. not later than the March 12, 2007 at
5:01) p.m. file their written applications for candidacy for office with the City Secietary, Pearland
City Hall, 3519 Liberty Drive, Pearland, Texas 1758L pursuant to the provisions of Chapter 143,
Texas Election Code, as amended. Each candidate must specify in each instance the City
Council Position for which the applicant is filing and no candidate may the for more than one
City Council position to be tilled at the General Election. Candidates must be a tesident of the
City and must be a qualified voter and otherwise qualified to hold the positron of a member of
the City Council under Texas law,
Section 4. thiliotatd Proms. The City Secretary and the Elcctinn
Administrator are hereby authorized and directed to prepare the ballots for the General Election
and for the Special Election in accordance with the provisions. of the Texas Election Code. The
ballots to be used in General Election shall have printed thereon the names of the candidates for
City Council Position 1 and City Council Position 5. The ballots to be used in the Special
Election shall have printed thereon the propositions corresponding to each of the propositions set
forth on Exhibit A to this Resolution, The specific ballot language for each proposition shall be
as &scribed on Exhibit C hereto (the number of each of such propositions corresponding tot the
number of the propositions for the issuance of bonds fur permanent public improvements listed
on Exhibit A to this Resolution) with provision to vote "FOR" or "AGAINST" each proposition.
Section 5 hag Voting 'in the Elections,. including early -voting by personal
appearance shall be by an electronic voting system. atioptcd,by the Cif and the Commissioners
Court of Brazos to County, Texas for use in elections held by the City and Brazoria County. Each
voter in the General Election shall mark the ballocindicanng such voter's choice of candidate for
City Council Position 1 and City Council Position 5, Each voter in the Special Election desiring
to vote in favor of a proposition shall mark the ballot indicting "FOR" the proposition. and each
voter desiring to vote against a proposition shall Malt the ballot indicating "AGAINST" the
proposition. Voting shall be eotidut:ted in accordance with the Texas Election Code.
Section 6. Early Voting. Early voting by personal ;appearance shall he conducted at
the dates, tinws and polling places listed in Exhibit t) to this Resolution,

or method not exceeding that maximum interest now or hereafter authorized by law as shall be
determined within the discretion of the City Council at the time of issuance, and to levy a tax
upon all taxable property in the City sufficient to pay the interest on the bonds, and to provide a
sinking fund for the payment of bonds as they mature, for the purpose of making permanent
public improvements as follows: (1) purchasing., acquiring. constructing, repairing and
improving land, facilities and equipment for park and recreation purposes. (2) engineering and

for such board in the Texas Election Code.
Section 7. Notice of Elections. Notice of the Elections, in English and Spanish,
stating in substance the contents of this Resolution, shall be; t i) published one time in a
newspaper of general circulation within the City's tcrritor) not earlier than the thirtieth day or
later than the 10th day bcforc the Elections; (ii) posted on the bulletin board used by the Council
to post notices of the Councilti meetings no later than the twenty-first (21 st) day before the date
of the Elections; and (iii ) posted, not later than the twenty-first (21st) day before the date of the
Elections, in three (3) public places within the City and at City Nall,
