AN ORDINANCE OF THE CITY OF PEARLAND, AUTHORIZING,
DIRECTING, AND RATIFYING PLACEMENT AND ERECTION OF
CERTAIN STOP SIGNS IN THE WOODCREEK SUBDIVISION OF THE
CITY OF PEARLAND, TEXAS; ESTABLISHING A NO STOPPING,
STANDING OR PARKING ZONE ON THE EAST SIDE OF WOODY ROAD
AND A STUDENT LOADING AND UNLOADING ZONE ON THE WEST SIDE
OF WOODY ROAD; PROVIDING A SAVINGS CLAUSE, A SEVERABILITY'
CLAUSE, AND A PENALTY; AND DECLARING AN EMERGENCY BECAUSE
THE NEED OF IMMEDIATE INSTALLATION BEARS DIRECTLY ON THE
SAFETY OF THE TRAVELING PUBLIC AND THE CHILDREN OF THE
CITY AND, THEREFORE, INURES TO THE GENERAL HEALTH SAFETY
AND WELFARE OF THE CITIZENRY.
WHEREAS, Texas Revised Civil Statutes Annotated, Article
6701d, Section 91(a) provides, in part, that local authorities may,
with reference to highways under their jurisdiction, designate any
intersection as a stop intersection; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS:
Section 1. Pursuant to the grant of authority contained in
the preamble hereof, the following intersections are designated as
stop intersections:
Shady Creek, southbound, at its intersection with Timber
Creek.
Shady Creek at its intersection with Prairie Creek (four-way).
Prairie Creek, westbound, at its intersection with Oak Creek.
Winding Creek, westbound, at its intersection with Shady
Creek.
Meadow Creek, westbound, at its intersection with Shady Creek
Crooked Creek, westbound, at its intersection with Shady
Creek.
Section 2. There is hereby established a "No Stopping,
Standing, or Parking During School Hours" zone on the east side of
Woody Road, beginning at its intersection with FM518 and extending
to Cherry Street.
Section 3. There is further established a "Student
Loading/Unloading This Side Only" zone on the west side of Woody
Road beginning at FM518 and extending to its intersection with
Cherry Street.
Section 4. The City Manager, or his designated agent, is
hereby authorized and directed to place and erect stop signs
conformable with the Manual and Specifications for Uniform Traffic
Control Devices as adopted by the State Highway Commission as
nearly as practicable to the nearest intersection of the crosswalks
or, if none, at the nearest line of the roadway with respect to the
stop signs established in Section 1. hereof.
Section 5. The City Manager, or his designated agent, is
hereby authorized and directed to place and erect signs conformable
with the Manual and Specifications for Uniform Traffic Control
Devices as adopted by the State Highway Commission at locations
appropriate to the prohibitions contained in Sections 2. and 3.
hereof.
Section 6. Any person, firm or corporation who shall violate
or fail to comply with the requirements of any provisions of the
Code herein adopted shall be guilty of a misdemeanor, and shall,
upon conviction -by a Court of competent jurisdiction, be punished
as provided in Section 1-11 of the City Code of Ordinances.
Section 7. All rights and remedies which have accrued on
behalf of the City are hereby preserved.
Section 8. If any section, subsection, sentence, clause,
phrase, or portion of this Ordinance is for any reason held invalid
or unconstitutional by any Court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 9. The City Secretary shall cause this Ordinance, or
its caption and penalty, to be published in the official newspaper
of the City of Pearland, upon passage of such Ordinance. The
Ordinance shall then become effective ten (10) days from and after
its publication, or the publication of its caption and penalty, in
the official City newspaper.
Section 10. The need of immediate installation bears directly
on the safety of the traveling. public and the children of the City,
and, therefore, inures to the general health safety and welfare of
the citizenry, thereby creates an emergency.
