Sincerely, Leslie Schroeder Asst. to City Secretary Enclosure 4) RIMS on Recycled Pagmt ORDINANCE N0. 630 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF PEARLAND, AT CHAPTER 10, FIRE PREVENTION AND PROTECTION, BY ADDING A SECTION 10-91, FOR THE PURPOSE REQUIRING EMERGENCY OVERRIDE CONTROL DEVICES IN PARKING AREAS HAVING SECURITY GATES; PROVIDING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, A PENALTY, PUBLICATION, AND AN EFFECTIVE DATE. WHEREAS, Emergency Override Control Devices for Parking Areas Security Gates are essential to the rapid ingress and egress of such areas for the delivery of fire and police services necessary to the preservation of the public health, safety and welfare; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That the Code of Ordinances of the City of Pearland, Texas, as the same may have been from time to time amended, is further amended at Chapter 10 by the inclusion of Section 10-91, which shall hereafter read as follows: "Sec. 10.91. Parking Area Security Gates - Emergency Override Control Devices Required. Except as otherwise provided in this section, owners or operators of controlled vehicle parking areas which use mechanical parking gates to control motor vehicle ingress or egress shall install and maintain an emergency override control device (approved by the fire official) on each gate. Said device shall be a master - key -operated type switch. Said master -keys shall be provided in sufficient quantity as requested to be furnished to the fire official at the owner's or operator's expense. Except as other- wise provided in this section, emergency override control devices shall be required for all said mechanical parking gates whether or not said gates were installed before or after the effective date of this ordinance." Section 2. All rights and remedies which have accrued in the favor of the City under its Code of Ordinances, and amendments thereto, shall be and are preserved for the benefit of the City. Section 3. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance, is for any reason held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 4. Any person, firm or corporation who shall violate or fail to comply with the requirements of any provision of the Code herein adopted shall be guilty of a misdemeanor, and shall, upon conviction by a Court of competent jurisdiction, be punished as provided in Section 1-11 of the City Code of Ordinances. Section 5. The City Secretary shall cause this Ordinance, or its caption and penalty, to be published in the official newspaper of the City of Pearland, upon passage of such Ordinance. The Ordinance shall then become effective ten (10) days from and after its publication, or the publication of its caption and penalty, in the official City newspaper.
