The City Council of the City of Pearland, Texas, convened

The Mayor introduced an ordinance and moved that it be

The ordinance thus adopted follows:
AN ORDINANCE DESIGNATING A TIME AND DATE UPON WHICH
BRAZORIA COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT
NO, 3 SHALL BE ABOLISHED AND THE -CITY OF PEARLAND SHALL
TAKE OVER ALL PROPERTY AND ASSETS AND ASSUME ALL DEBTS
AND PERFORM ALL FUNCTIONS -AND SERVICES OF SAID DISTRICT;
PROVIDING FOR-CERTAIN.TAX LEVIES, REFUNDING BONDS, AND
RATIFYING ANNEXATION OF TERRITORY; AND CONTAINING OTHER
PROVISIONS RELATING TO THE SUBJECT
WHEREAS, on December 26, 1963, the City Council of the
City of Pearland, Texas, adopted Ordinance No.

receiving
and annexing as a part of the said City of Pearland, Texas, that one
acre of land out of Tract Seven (7) of the HT & B RR Company Survey,
Abstract 240, Section 13, Brazoria County, Texas, lying adjacent to
said City and belonging to Brazoria County Water Control and Improve-
ment District No, 3 and more fully described in said Ordinance (said
territory being the last and only remaining territory of Brazoria
County Water Control and Improvement District No, 3 not heretofore
included within the boundaries of said City), whereby all of the
territory comprising said District was, became, and is now included
within the boundaries of said City, and all of the territory com-
prising said District has now been annexed to and has become a part
of said City; and
WHEREAS, said City must within ninety (90) days from
December 26, 1963, take over all properties and assets of said
District and shallassume all its debts, liabilities and obligations,
and shall perform all functions and services of such District, in ac-
cordance with law, and particularly Article 1182c-1, Vernon's Texas
Civil Statutes, as amended; and
WHEREAS, an ordinance should be adopted by said City Council
designating the time and date uponwhich said City shall take over
and such District shall be abolished; Therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS:

1.
That at / ,t / o'clock ,9 .M., C.S.T., on the

day of l.-^L-Cs.+.I , 1964, being within ninety (90) days after
December 26, 1963 (the effective date of the annexation of territory
mentioned in the preamble hereof), the City of Pearland, Texas, shall
take over Brazoria County Water Control and Improvement District No. 3
and said District shall, at such time and date, be abolished, and said
City shall then take over all properties and assets, shall assume all
debts, liabilities and obligations, and shall thereafter perform all
functions and services of such District.
2.
That such City shall, at such time and on such date,
assume all debts, liabilities and obligations of said District, and
said City Council shall hereafter levy and cause to be collected,
upon all taxable property within said City, taxes sufficient to pay
the principal of, and interest on, all such bonds or obligations as
they respectively become due and payable, in accordance with law.

That such City shall be, and is hereby, authorized
hereinafter to issue its refunding bonds to refund any bonds or
other obligations, including unpaid earned interest thereon so
assumed by said City, such refunding bonds to be issued in the
manner provided in the Bond and Warrant Law of 1931, as amended,
provided that it shall not be necessary to give any notice of in-
tention to issue such refunding bonds and no right of referendum
thereon shall be available,
4.
That, although such City does not have outstanding bonds
payable from, and secured by, a pledge of the net revenues of the
City's waterworks and sanitary sewer system (the City having no
such system), said District does have a waterworks and sanitary
sewer system and has outstanding bonds and obligations payable from
the net revenues of such system, and said City should and shall take
over and operate such system and properties and shall apply the net
revenues from the operation thereof to the payment of such outstanding
District revenue bonds, warrants or other bonded obligations.
5.
That the Mayor and City Secretary are hereby authorized and
directed to do any and all things necessary and convenient to carry
out the purpose and intent of this ordinance.
6.
That this ordinance shall talce effect from and after the
date of its passage.
