ORDINANCE CLOSING, VACATING AND ABANDONING THAT
PORTION OF JASMINE STREET IN THE CITY OF PEARLAND,
BRAZORTA COUNTY, TEXAS, LYING BETWEEN THE EAST
LINE OF GRAND BOULEVARD AND THE WEST LINE OF PARK
AVENUE IN SAID CITY, IN ACCORDANCE WITH PETITION OF
THE BOARD OF TRUSTEES OF THE PEARLAND INDEPENDENT
SCHOOL DISTRICT, AND DECLARING AN EMERGENCY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND:
Section 1. It is hereby ordered and ordained that that portion
of Jasmine Street in the City of Pearland, Texas, lying between the east line
of Grand Boulevard and the west line of Park Avenue, shall be,and it is here-
by, closed, vacated and abandoned, as prayed by the petition of the Board of
Trustees of the Pearland Independent School District on file with this Council,
all in accordance with authority granted to this Council by Article 1016, as
amended, R. S. 1925,
Section 2. There is hereby expressly reserved to the City of
Pearland and its successors the right of ingress, egress and regress, over
and along that portion of Jasmine Street described above for the purpose of
providing drainage in such form as may be determined by the City Council
and for the purpose of maintaining, renewing, repairing and relaying exist-
ing water or sewer lines, or for installing additional lines for water and
sewers, including both sanitary and storm sewers.
Section 3, The fact that the Pearland Independent School
District plans additional improvements to be constructed upon a portion of
the property abutting on the above described portion of Jasmine Street, and
that the plans for erecting such improvements are contingent to some extent
upon the adoption or refusal to adopt this ordinance, and that the public
interest requires action upon the petition filed by the Board of Trustees of sai
District promptly, and that such situation creates an emergency and an
imperative public necessity requiring the suspension of the rule that
ordinances shall be read at three meetings of this Council, and said rule is
therefore accordingly hereby suspended, and this ordinance shall become
effective immediately and is put upon its final reading and passed by a vote

PETITION TO CLOSE THAT PORTION OF JASMINE STREET
LYING BETWEEN THE EAST LINE OF GRAND BOULEVARD
AND THE WEST LINE OF PARK AVENUE
TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE
CITY OF PEARLAND, TEXAS:
The Pearland Independent School District, a public free
school corporation created under the general laws of Texas, acting herein
by and through its Board of Trustees, respectfully prays that the Honorable
City Council make, adopt and enter in the minutes an ordinance closing,
vacating and abandoning that portion of Jasmine Street in the City of Pearlan
lying between the east line of Grand Boulevard and the west line of Park
Avenue, and in connection therewith, respectfully shows to your Honorable
Body that the Pearland Independent School District is the sole and exclusive
owner of all of the property abutting on that portion of Jasmine Street above
described and which petitioners pray be vacated and permanently abandoned.

All Alderman voted "Are" with no "Noes".
A motion was r,ade by Tom Alexander that the subdivision ordinance be revised to
prescribe a minimum lot si ze of 70 120 feet or gquivalent square footage, were

seconded by Gene Sanders. All Aldermen voted "tlye't IN1th n.o "Noes".
A motion vas made by Ton Alexander and seconded by V. A. Nolen that a contract
for employment be executed with I`-r. Jack Harrison for city attorney for a
•period of one. year and at a fee of4 (.250.00 per mont4, and other -items as prescribed
in the contract dated February 6, 1964. A substitute ::lotion was mcd. e by Gene
Sanders that the mayor and two councilmen review other attorney. The substitute
motion died for lack of a second. Nolen, Alexander and Smith voted "Aye"
Sanders voted ."No".
After due discussion it was agreed that inspectors should be solicited to work
for the city of Pearland, Texas .
