ORDINANCE NUMBER
AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, RECEIVING AND
ANNEXING AS A PART OF SAID CITY OF PEARLAND, TEXAS, THE
FOLLOWING INHABITATED TERRITORY LYING ADJACENT TO THE CITY
OF PEARLAND, TEXAS:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, DULY ASSEMBLED:
SECTION 1: WHEREAS, on the p day of k Q'Zk-f--lvt,e1,
A. D. 1963, there was flied with the Mayor of the City of Peartand, Texas,
the following instrument:

COUNTY OF BRAZORIA
PETITION FOR ANNEXATION
TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF
PEARLAND, BRAZORIA COUNTY, TEXAS:
WE, the undersigned, being a majority of the inhabitants, resi-
dents and qualified voters of the hereinafter described territory, which
adjoins the City Limits of the City of Peartand and is not more than one-
half mile in width, do hereby petition your Honorable Body to extend the
present City Limits so as to includ e the following described territory
as a part of the City of Pearland, Texas, to -wit:
Starting at a point for corner in H. T. & B. Section 13,
Abstract No. 240, said point being also described as the
intersection of the South right of way line of Walnut Street,
City of Pearland, Texas and the West right of way Line of
County Road 104 (McClain Road) go westalong the South
right of way Line of Walnut Street and to continuing along
the South right of way Line of State of Texas Farm to Market
Road 518 approximately 2,640 feet to a point for corner where
the West right of way Line of County Road N9. 387 intersects
the South right of way Line of Farm to Market Road No. 518;
THENCE South along the West right of way Line of County
Road No. 387 and continuing South along an extension of the
West right of way Line of County Road 387 approximately
5,280 feet to a point for corner in the South right of way Line
of County Road No. 388;

Road 388 approximately 1,815 feet to a point for corner
being the Northwest corner of 'Willard Thompson 5 acre tract
in Section 14, HT&B RR Survey, Abstract 509;
THENCE South along West Line of WiLLard Thompson Tract
630 feet to a point for corner;
THENCE East paralieL to HT&B Section 14, Abstract No, 509
to point for corner that is 175 feet West of West right of way
Line of County Road No. 104;
THENCE South paraLLeL to and being 175 feet West of West
right of way Line of County Road No. 104 to the point of
intersection of this Line and the South boundary Line of the
City of PearLand that crosses HT&B Section 12, Abstract
508, projected West;
THENCE East 175 feet along aforementioned extension of
South boundary of City of PearLand to point for corner in
West right of way Line of County Road No. 104;
THENCE North aLong West right of way Line of County Road
No. 104 approximateLy 6,732 feet to the point of Beginning.
The above described area shaLL have excLuded any Land now
Located within the boundary of the City of PearLand, Texas,
WE, and each of us, the undersigned, are inhabitants and resi-
dents of the above described territory and are duly qualified to vote for
members of the State LegisLature and have expressed our choice and vote
by affixing our signatures to the petition under the appropriate heading

appeared JAMES M. SMITH, DOROTHY THOMPSON and MRS, H. B.
THORNTON, weL1 known to me and who after being duty sworn, depose
and says: That they are each of them , are inhabitants of the territory
described in the attached and foregoing petition and are duly qualified to
vote for members of the State Legislature, and have had notice of and an
opportunity to vote his or her choice in the matter of annexing said
territory to the City of PearLand, and that a majority of those qualified
to vote, have voted in favor of becoming a part of said City of PearLand,
Texas.

I, E. T. GIBBONS, the duly elected and qualified Mayor of the
City of Peartand, Texas, do hereby certify that on the a day of
`%'A144, , A. D. 1963, there was filed with me, as Mayor
of said City, the folowing instruments:
1) Petition for Annexation;
2) Certificate of ELection in the Territory sought to beannexed;
3) Affidavit showing a Majority of the Residents of the Adjoining
Territory Favoring Annexation.
That an examination of the above described instruments and
petition reveal that an election was held in the herein described territory
adjoining the City of PearLand, Texas, on the ,0 day of
A. D. 1963, and that a majority of the residents who were and are qualified
to vote for members of the State Legislature did vote in favor of the
annexation of the territory described in the petition to the City of PearLand,
and property filed and certified such action to me as the Mayor of the City
of PearLand, Texas.
That the above described territory adjoining the City of PearLand,
Texas, is now LegaLLy susceptabLe of annexation to the City of Peartand,
upon the passage and approval of a proper ordinance.

SECTION 3: ALL of the above mentioned instruments having been
filed with the City Secretary of the City of PearLand, by E. T. Gibbons ,
the Mayor thereof, together with his certificate on this the day of

of PearLand having examined the same and having inquired into the facts
and circumstances surrounding aLL of the said proceedings and being fully
advised of the premises, hereby finds that aLL of the statements therein
contained are true and correct and that the procedure initiated, prosecuted
and concLuded by the inhabitants of said territory was, in aLL respects
proper and in keeping with the Laws of this State prescribing such procedure
and that there has been performed and consummated every LegaL pre-
requisite necessary to a vaLid and effectual election and petition for
annexation of said territory as a part of the City of PearLand.
SECTION 4: The City Council finds as a fact that a majority of
the inhabitants residing in said territory who are qualified to vote for
members of the State Legislature, have duty and reguLarLy cast their vote
in favor of said annexation.
SECTION 5: That said territory described in said proceedings
Lies adjacent and contiguous to the City of PearLand and does not at any
pLace extend one-half mile or more in width.
SECTION 6: There is hereby received and annexed as a part of
the City of PearLand, Texas, the foLLowing territory, being the same as
described in the petition for annexation hereinabove set out:
Starting at a point for corner in the H. T. & B. Section 13,
Abstract No. 240, said point being also described as the inter-
section of the South right of way Line of Walnut Street, City of
PearLand, Texas and the West right of way Line of County Road
104 (McCLain Road), go west aLong the South right of way Line
of Walnut Street and continuing aLong the South right of way Line
of State of Texas Farm to Market Road 518 approximately 2,640
feet to a point for corner where the West right of way Line of

THENCE North aLong West right of way Line of County Road No,
104 approxirnateLy 6,732 feet to the point of Beginning.
The above described area shall have excLuded any Land now Located
within the boundary of the City of PearLand, Texas,
The above described area is approximateLy acres.
SECTION 7: That said territory and the inhabitants thereof shaLL
hereafter have and enjoy aLL the rights, priviLeges and obligations incident
to and flowing with the annexation of said territory and its incorporation in
and within the corporateLimits of the City of PearLand.
SECTION 8: The Corporate Limits of the City of PearLand are hereby
extended so as to incLude and there is hereby incLuded within said Corporate
Limits, the above described territory.
SECTION 9: This Ordinance shaLL take effect immediateLy upon its
passage and approvaL by the Mayor and thence forth said territory shaLL be
and remain a part of the City of PearLand, Texas, as fully and to aLL intents
and purposes as if said territorywere incLuded within the Corporate Limits
