Ord. 0076 1963-12-1918885 VOL. 868 ocr10 ORDINANCE NO. f (; AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, RECEIVING AND ANNEXING AS A PART OF SAID CITY OF PEARLAND, TEXAS, THE FOLLOWING INHABITATED TERRITORY LYING ADJACENT TO THE CITY OF PEARLAND, TEXAS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, DULY ASSEMBLED: SECTION 1: WHEREAS, on the 2nd day of November, A. D. 1963, there was filed with the Mayor of the City of Pearland, Texas, the following instrument: "THE STATE OF TEXAS X COUNTY OF BRAZORIA X PETITION FOR ANNEXATION TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF PEARLAND, BRAZORIA COUNTY, TEXAS: WE, the undersigned, Ben Anthony and wife, Laura Del Anthony, being the sole and only qualified voters residing on the lands hereinafter described and which are located and situated im- mediately adjacent and contiguous to the existing limits of the City of Pearland, Brazoria County, Texas, do hereby petition and request 1'L that the Honorable Mayor and City Council of the said City annex the lands herein described into and make same a part of the Corporate Limits of the said City of Pearland, all in accordance with the laws of the State of Texas, said premises to be considered for said annexation being described by metes and bounds as follows: A TRACT OF LAND 300 feet by 200 feet out of Section 5, HT&B RR Co. Survey, Abstract No. 237, Brazoria County, Texas; BEGINNING AT THE POINT OF INTERSECTION of the North right of way line of Farm to Market Road 518 with the East line of said Section No. 5, being also the South- west corner of Mimosa Acres as shown by the plat thereof recorded in Volume 7, page 15, Map Records of Brazoria County; THENCE West along said North right of way line 300 feet to a point for corner; to' E VOL 8&8 ag.E305 THENCE North, being parallel to the East line of said Section 5, a distance of 200 feet to a point for corner; THENCE East, being parallel to the aforesaid North right of way line, 300 feet to a point for corner on the said East line of said Section No. 5, being also the West line of Mimosa Acres; THENCE South along said East line 200 feet to the place of Beginning and containing 1.377 acres of land, more or less; Any lands included in the above described tract of land which have been previously annexed and are now a part of the City of Pearland are hereby excluded from this Petition. It is the further request and petition of the said Ben Anthony and wife, Laura Del Anthony, that the said City Council immediately hear such petition and grant this request and petition and that there be an annexation of the lands herein described by the City Council of the City of Pearland and that the said body by proper ordinance receive and annex such territory and premises described hereinabove as a part of the said City and that there- after the petitioners and any and all future inhabitants of the said premises be invested with all rights and privileges of other citizens of the said City and be bound by the acts and ordinances of the said City. GIBBONS, Mayor of the City of Pearland, Texas, certified to the City Council of the City of Pearland, Texas, the following: THE STATE OF TEXAS ) COUNTY OF BRAZORIA ) CITY OF PEARLAND I, E. T. GIBBONS, the duly elected and qualified Mayor of the City of Pearland, do hereby certify that on the,/ day of November, A. D. 1963, there was filed with me as Mayor of said City, the following: PETITION FOR ANNEXATION That an examination of the above described instrument and petition reveal that an election was held in the therein described territory adjoining the City of Pearland, Texas, on the Adaday of November, A. D. 1963, and that the owners petitioned the City of Pearland, through the City Council for annexation and did vote in favor of the annexation of the territory described in the petition to the City of Pearland, and properly filed and certified such action to me as theMayor of the City of Pearland, Texas. of L .868 .EArE -. .) 7 That the above described territory adjoining the City of Pearland, Texas, is now legally susceptable of annexation to the City of Pearland, upon the passage and approval of a proper ordinance. Nolen, Secretary SECTION 3: And the above mentioned Petition having been filed with the City Secretary of the City of Pearland, by E. T. Gibbons, the Mayor thereof, together with his certificate on this the ;(i day of \'lt A 11. , A. D. 1963, the City Council of the City of Pearland having examined the same and having inquired into the facts and circumstances surrounding all of said proceedings and being fully advised of the premises, hereby finds that all of the statements therein contained are true and correct and that the procedure initiated, prosecuted and concluded by the owners of said territory was, in all respects proper and in keeping with the laws of this State prescribing such procedure and that there has been performed and consummated every legal prerequisite necessary to a valid and effectual annexation of said territory as a part of the City of Pearland, Texas. SECTION 4: That said territory described in said pro- ceedings lies adjacent and contiguous to the City of Pearland, and does not at any place extend one-half mile or more in width. SECTION 5: There is hereby received and annexed as a -4- vn1. 868 FACE308 part of the City of Pearland, Texas, the following territory, being the same as described in the petition for annexation, herein - above set out: A TRACT OF LAND 300 feet by 200 feet out of Section 237, Brazoria 5, ET & B RR Co. Survey, Abstract County, Texas; BEGINNING AT TEE POINT OF right of way line of Farm East line of said Section corner of Mimosa Acres as recorded in Volume County; Number INTERSECTION of the North to Market Road 518 with the No. 5 being also the Southwest shown by the Plat thereof 7, page 15, Map Records of Brazoria THENCE West along said North right of way line 300 feet to a point for corner; THENCE North, being parallel to the East line of said Section 5, a distance of 200 feet to a point for corner; THENCE East, being parallel to the aforesaid North right of way line, 300 feet to a point for corner on the said East line of said Section No. 5, being also the West line of Mimosa Acres; THENCE South along said East line 200 feet to the place of Beginning and containing 1.377 acres of land, more or less; And lands included in the above described tract of land which have been previously annexed and are now a part of the City of Pearland are hereby excluded from said annexation; SECTION 6: That said territory and the inhabitants thereof shall hereafter have and enjoy all the rights, privileges and obliga- tions incident to and flowing with the annexation of said territory and its incorporation in and within the corporate limits of the City of Pearland, Texas. SECTION 7: The Corporate Limits of the City of Pearland, are hereby extended so as to include and there is hereby included within said Corporate Limits, the above described territory. SECTION 8: This ORDINANCE shall take effect immediately upon its passage and approval by the Mayor and thence forth said -5- a VDt 8 t : , ffiOE=. 09 territory shall be and remain a part of the City of Pearland, Texas, as fully and to all intents and purposes as if said territory were included within the Corporate Limits of the City of Pearland as originally incorporated.
