Ord. 0091 1964-07-18AN ORDINANCE ACCEPTING BIDS AND AWARDING CONTRACTS FOR !f - a-' FURNISHING LABOR AND MATERIALS FOR CONSTRUCTING PERMAN- ENT WATERWORKS SYSTEM IMPROVEMENTS FOR THE CITY OF PEARLAND, TEXAS. THE STATE OF TEXAS § COUNTY OF BRAZORIA § The City Council of the City of Pearland, Texas, convened in Caw-- session at the City Hall within said City on the day of June, 1964, with the following members present, to -wit: E. McClellan City Secretary and the following member(s) absent, to-wit:ut when the following business was transacted: The Mayor introduced an ordinance which was read in full. Alderman 7) cw o adopted as read. Alderman made a motion that the ordinance be seconded the motion for adoption of the ordinance. The motion, carrying with it the adoption of the ordinance, prevailed by the following vote: AYES: Aldermen ShukanPs, Sanders, Kegley, Alexander and Nolen, and Mayor Gibbons. NOES: None. The Mayor thereupon announced that the motion had duly and lawfully carried, and that the ordinance had been duly and lawfully adopted. The ordinance thus adopted follows: AN ORDINANCE ACCEPTING BIDS AND AWARDING CONTRACTS FOR FURNISHING LABOR AND MATERIALS FOR CONSTRUCTING PERMAN- ENT WATERWORKS SYSTEM IMPROVEMENTS FOR THE CITY OF PEARLAND, TEXAS. WHEREAS, on the day of June, 1964, the City Council of the City of Pearland, Texas, adopted an ordinance authorizing the issuance of $110,000 City of Pearland Waterworks System Time Warrants, Series 1964, dated June 15, 1964, for the purpose of evidencing the in- debtedness of the City of Pearland, Texas, for all or any part of the cost of constructing permanent improvements, additions and extensions to said City's waterworks system, including personal and professional services to be rendered in connection therewith and other incidental ex- penses in connection therewith; and WHEREAS, by resolution adopted by the City Council of the City of Pearland, Texas, on May 22, 1964, the City Secretary of said City was authorized and directed to give notice that sealed bids would be received by the City Council of the City of Pearland, Texas, until 10:00 o'clock a.m. on the 12th day of June, 1964, for furnishing all labor, materials, supplies, machinery, equipment, tools, and superin- tendence for constructing permanent waterworks system improvements for said City, to -wit: (1) A water well; (2) A water storage tank; (3) A water treatment plant; and (4) A water distribution system, and that it was the intention of the City Council of said City to authorize and issue time warrants in the maximum sum of $150,000, being the time warrants described above, for the purpose of evidencing the indebtedness of the City for all or any part of the cost of making such improvements, additions, and extensions, including said personal -2- and professional services and incidental expenses mentioned above; and WHEREAS, said Notice was given in the manner and for the time prescribed by law; and WHEREAS, the City Council convened at the time and place specified in said notice, to -wit: at 10:00 o'clock a,m, on the 12th day of June, 1964, at the City of Pearland City Hall, and received sealed bids pursuant to said notice, for such construction; and WHEREAS, after opening and considering all bids so received, the City Council referred the same to the City's Engineers for study, tabulation and recommendation; and WHEREAS, said Engineers have studied and tabulated said bids and have recommended to the City Council of the City of Pearland, Texas, that it accept the following bids: (1) For construction of the water well - the bid of Layne Texas Company, Inc., Houston, Texas, in the amount of $21,350.00, the lowest and best bid received; (2) For construction of the water storage tank - the bid of Chicago Bridge and Iron Company, Houston, Texas, in the amount of $21,075.00, the lowest and best bid. received; (3) For construction of the water treatment plant - the bid of George C. Cox, Inc,, Houston, Texas, in the amount of $29,500.00, the lowest and best bid received; and (4) For construction of the water distribution system - the bid of Mora Construction Company, Friendswood, Texas, in the amount of $21,880.02, the lowest and best bid received; and WHEREAS, after considering all bids received, the said City Council has determined, and hereby affirmatively finds and declares, that the following respective bids, for the purposes and in the amounts shown, are, respectively, the lowest and best bids received, and that said bidders are, respectively, the lowest and most responsible bidders: (1) For construction of the water well - the bid of Layne Texas Company, Inc., Houston, Texas, in the amount of $21,350.00; (2) For construction of the water storage tank - the bid of Chicago Bridge and Iron Company, Houston, Texas, in the amount of $21,075.00; (3) For construction of the water treatment plant - the bid of George C. Cox, Inc., Houston, Texas, in the amount of $29,500.00; and (4) For construction of the water distribution system - the bid of Mora Construction Company, Friendswood, Texas, in the amount of $21,880.02; and WHEREAS, the City Council of the City of Pearland, Texas, further affirmatively finds that the subject matter of said bids in all ways meet the specifications relating to such construction; and WHEREAS, said City Council wishes to accept said bids and award contracts to said bidders; and WHEREAS, No petition of any kind whatsoever has been filed with or presented to the City Council or any officer or official of the City requesting a referendum on the question of issuing bonds for such construction, and no written or other protest relating to the acceptance of said bids or the letting of the contracts or the issuance of said time warrants has been filed with or received by the City Council or any officer or official of the City, and it is hereby affirmatively found and declared that the City Council of the City of Pearland, Texas, is authorized to accept said bids and award said contracts to said bidders; therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That the bids described in the preamble to this ordinance, to - wit: (a). The .bid ..of Layne Texas Company, Inc., Houston, Texas, in the amount of $21,350,00 for the construction of the waterwell, (b) The bid of Chicago Bridge & Iron Company, Houston, Texas, in the amount of $21,075.00 for the construction of the water storage tank, (c) The bid of George C. Qox, Inc., Houston, Texas, in the amount of $29,500.00 for the construction of the water treatment plant, and (d) The bid of Mora Construction Company, Friendswood, Texas, in the amount of $21,880.02 for the construction of the water distribution system,` are hereby found to be the lowest and best bids, and said bidders are hereby found and declared to be the lowest responsible bidders;, and the contracts for the construction of the respective improvements, additions and extensions to said City's waterworks system, covered by the said respective bids, are hereby awarded to said respective bidders. Section 2. That the contracts awarded. by Section 1 of this ordinance are hereby authorized, approved, ratified and confirmed. Section 3.
