AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS,
AMENDING CHAPTER 8, ENTITLED CIVIL DEFENSE OF
THE CODE OF ORDINANCES OF THE CITY OF PEARLAND,
TEXAS, BY ADDING AND DELETING SPECIFIC PROVISIONS
CONTAINED IN SUCH CHAPTER: PROVIDING FOR AN
EFFECTIVE DATE, AND CONTAINING OTHER PROVISIONS
RELATING TO THE SUBJECT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section I.
That Section 8-1. entitled Definitions of Article I, Chapter 8, be and
the same is hereby amended to read as follows:
"Section 8-1. Definitions.
For the Purposes of this chapter the following words and phrases
shall have the meanings respectively ascribed to them:
Committee: The city's municipal civil defense and disaster
relief committee.
Civil Defense Director: The municipal defense director of the City".
Section II.
That Section 8-2. entitled Operational Organization Generally, Article I
Chapter 8, be and the same is hereby amended to read as follows:
"Section 8-2. Operational organization generally.
(a) Composition. The operational civil defense and disaster relief
organization of the city shall consist of the officers and employees
of the city designated by the civil defense director as well as all
volunteer municipal civil defense workers.
(b) Functions, duties. The functions and duties of this organization
shall be distributed among such divisions, services and special staff
as the city council shall prescribe by resolution or the civil defense
director shall provide by directive. Any such resolution or directive
shall set forth the form of organization, establish and designate
divisions and services, assign functions, duties and powers and designate
officers and employees to carry out the provisions of this chapter.
(c) Conform to recommendations.. Insofar as possible, the form of
organization, titles and terminology shall conform to the recommendations
of the State Disaster Emergency Services Council of the state and of the
federal government".
Section III.
That Section 8.25, Subsection (b) entitled Composition, of Article II,
Chapter 8, be and the same is hereby amended as follows:
"Section 8-25. Composition.
(b) The disaster coordinator of the city, who shall serve as vice-
chairman of the committee".
Section IV.
That Article III, Division I and Division 2, entitled Coordinator
and Assistant, of Chapter 8, be and the same is hereby amended as follows:
"Article III. CIVIL DEFENSE DIRECTOR
DIVISION I. GENERALLY
Section 8-39. Office created.
The office of civil defense director of the city is hereby created.
Section 8-40. Named
The Mayor shall serve as the civil defense director.
Section 8-41. Declaration of emergency.
The civil defense director shall have the authority to request the
declaration of the existence of an emergency by the city council
or by higher authority. In the event it is deemed necessary to
declare the existence of an emergency without delay, the civil
defense director may, if the city council is not in session, do so,
but such action shall be subject to confirmation by the city council
at its next meeting.
Section 8-42. Powers, duties generally.
The duties and responsibilities of the civil defense director shall
include the following:
(a) The control and direction of the actual operation or training
efforts of the civil defense and disaster relief organization of the
city;
(b) The determination of all questions of authority and responsibility
that may arise within the civil defense and disaster relief organization
of the city;
(c) The maintenance of necessary liaison with other municipal,
district, state, county, regional, federal or other civil defense
organizations;
(d) The marshaling, after declaration of an emergency as provided
for above, of all necessary personnel, equipment or supplies from
any department of the city to aid in the carrying out of the civil
defense plan;
(e) The issuance of all necessary proclamations as to the existence
of an emergency and the immediate operational effectiveness of the
civil defense plan;
(f) The issuance of reasonable rules, regulations or directives which
are necessary for the protection of life and property in the city.
Such rules and regulations shall be filed in the office of the city
secretary and shall receive widespread publicity unless publicity
will be of aid and comfort to the enemy;
(g) The supervision of the drafting and execution of mutual aid
agreements, cooperation with the representatives of the state and of
other local political subdivisions of the state, and the drafting and
execution, if deemed desireable, of an agreement with the county
in which the city is located and with other municipalities within
the county, for the countywide coordination of efforts in defense
and disaster relief;
(h) The supervision and final authorization for the procurement of
all necessary supplies and equipment, including acceptance of
private contributions;
(i) The authorizing of agreements, after approval of the city
attorney, for the use of private property for air raid shelters
and other purposes.

DIVISION 2. DISASTER COORDINATOR
Section 8-49. Office created.
The office of disaster coordinator is hereby created.
Section 8-50. Appointment, term.
The disaster coordinator shall be appointed and hold his position
at the pleasure of the civil defense director.
Section 8-51. Duties generally.
The disaster coordinator shall prepare a civil defense plan for the
city as well as such other duties as the civil defense director may

Section VI.
This ordinance shall take effect and be in full force and effect
from and after its adoption on second and final reading.
