Ord. 0107 1965-01-28ORDINANCE NUMBER 107 AN ORDINANCE OF THE CITY OF PEARLAND, BRAZORIA COUNTY, TEXAS, APPOINTING A PLANNING COMMISSION FOR THE CITY OF PEARLAND, CONSISTING OF FIVE MEMBERS; PRESCRIBING THE DUTIES OF OFFICE;FIX- ING THE TERMS OF OFFICE;PROVIDING FOR THE TAKING OF OATH OF OFFICE; PROVIDING A METHOD AND PRO- CEDURE TO BE FOLLOWED BY SAID COMMISSION; AND FIXING THE QUALIFICATIONS FOR THE HOLDING OF OFFICE AS A MEMBER OF SUCH COMMISSION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, BRAZORIA COUNTY, TEXAS: SECTION ONE (1): The City Council of the City of Pearland, Brazoria County, Texas, pursuant to the provisions of Article 1011a-1011j, Revised Civil Statutes of Texas, 1925, as amended, hereby establishes a commission to be known as the Planning Commission of the City of Pearland, Texas. SECTION TWO (2) : Said commission shall consist of five (5) qualified voters who are resident citizens of the City of Pearland, Texas, each of whom owns real property within the City of Pearland, Texas. Said members of said commission shall be appointed by the City Council of the City of Pearland, Texas, for the term of two years, or until their successors have been duly appointed. Provided, however, the appointed members, below named, of said commission - numbered One (1), Three (3), and Five (5) shall hold office for a term of one year on this first appointment in order that three members will be appointed in the even numbered years and two members shall be appointed in the odd numbered years. SECTION THREE (3) : The City Council of the City of Pearland, Brazoria County, Texas, hereby nominates, constitutes, and appoints the following named qualified persons as members of the Planning Commission of page 2 bCity of Pearland, Texas, to -wit: 1. David Armbruster 2. Kelly Sims 3. James Inman 4. Dr. Lloyd Ferguson 5 Lloyd Yost. SECTION FOUR (4): Said members of said commission above appointed shall, "before entering upon the performance of the duties of office, be sworn in the manner following: "I, , do solemnly swear ( or ''affirm) that I will faithfully execute the duties of the office of member of the Planning Commission of theCity of Pearland, Texas, and will to the best of my ability preserve, protect and defend the Constitution and laws of the United States and of this State; and I furthermore solemnly swear (or affirm) that I have not directly nor indirectly paid, offered or promised to pay, contributed nor promised to contribute any money or valuable think, or promised any public office or employment, as a reward to secure my appointment or confirmation thereof. So help me God" SECTION FIVE (5): Said commission shall elect from their numbere a Chariman, Secretary, and Vice Chairman, They shall promulgate their own rules of order and shallestablish regular meeting dates. Special ;meetings may be called by the Chairman or by any three (3) mem- bers of the commission. A majority of the commission shall constitute a quorum for the transaction of business. The Secretary shall keep Minutes of the commissions' Meet- ings. pg. 3 The Chairman shall preside at all meetings and, in the ab- sence of the Chairman, the Vice Chairman shall preside. SECTION SIX (6): Said Planning Commission shall be and is charged with the duties of studying, reporting and recommending to the City Coun- cil regulations and restrictions on the height, number of stories of buildings, size of buildings, and other structures, the per- centage of lot space that may be occupied, the size of yards, courts, and other open spaces, the density of population, the location and use of buildings, structures and land for trade, industry, residence or other purposes, places designated as historic and cultural importance, and regulation and restriction on construction, alteration, reconstruction or razing of buildings and structures, and health, safety and morals. SECTION SEVEN (7): The fact that a pressing need for zoning exists in the City of Pearland, creates an emergency, to protect the health and wel- fare of the citizens therof, and any statute or ordinance re- quiring more than one reading of an Ordinance is hereby suspend- ed, and this Ordinance shall be effective from and after its pas- sage.
